Biafra: FG Urges ECOWAS Court to Dismiss Kanu's Trial. The Federal Government of Nigeria has told the ECOWAS community court sitting in Abuja to hands off a matter brought before it by the embattled leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu, over his continued detention and trial. The government accused Kanu of threatening the peaceful co-existence of the country. It also noted that the sub-regional court lacked, “the requisite jurisdiction” to hear and determine the matter before it. The FG also asked the court to immediately dismiss and/or strike out the action for want of jurisdiction, “stemming from incompetency in initiating the application against the defendants.” The government noted that instead of waiting for conclusion of his application before the Nigerian Domestic Court of Appeal on his bail, the plaintiff proceeded to the ECOWAS court, a move it stated, amounted to, “an abuse of court process or subjecting the Nigerian law to ridicule. Faulting the inclusion of the Attorney General of the Federation and the Director General of State Security Service as defendants in the suit, the government stated that in the context and framework of ECOWAS, only member states and community institutions can be sued before the sub-regional court for alleged human rights violation. It submitted that the court has no jurisdiction over the two defendants because they, “are neither member -states or community institutions of ECOWAS and therefore, not amenable to the jurisdiction of the community court of justice”. When you biase the court proceedings and influence judgement, what do you expect from a defendant like Dasuki and Nnamdi Kalu... FG knows that the Dasuki case is the test of litmus to that of Nnamdi Kalu... Nnamdi's legal knowledge will lead to the fall of this government... He is in their oesophagus which the Fed doesn't know if throwing off or swallowing is better... It has nothing to do with his trial for alleged treason same way the judgment in favour of Dasuki had nothing to do with the $2.1 billion arms deal saga. It's strictly on d enforcement of human rights which the court has jurisdiction to entertain. You might as well read up on d law creating d Court and its jurisdiction which Nigeria is of course signatory to. |

biafran1stson:Ecowas court is ridiculing itself. It's meant for arbitration among member states or communities that belong to the member states. It doesn't have its own police, prison, and doesn't become a court of coordinate jurisdiction.In fact, it's completely laughable that the court will entertain a case outside its purview or a case already in court in any of its member states. Nigeria may soon withdraw herself from the memorandum that set it up if it keeps going out of its jurisdiction. |
