Good day lawyers and bankers in the house! There's this my friend who his father got missing in 2013 and has not been found till now. Before he got missing, he had over N5 million naira in his UBA bank account and till now they've not been able to withdraw the money. He consulted one of the senior lawyers in our community and the man told him to wait till 2020 (7yrs after). But as it is now, some of the man's children are dropping out of school because there's no money to finance their education. Pls is there any way they can go claim the money in time before the 2020 proposed by the lawyer? And if there's any way, how do they go about it? Lalasticlala, pls you can move this to the necessary section/front page..This is urgent pls because his children are no longer finding it funny! |

Since he aint certified dead, there is nothing they can do for now... But if u want to go round it, declare the man dead, make his funeral poster, then proceed to the court to get a letter of Administration. With that u start the process provided his next of kin is around... 1 Like |

Elchappo:Your suggestion makes little sense. You cannot get a letter of administration without a death certificate and to get one involves a process which is impossible in this case. See below. Except you want the OP to lie under oath that the death occurred at a location and cook up the cause of death in connivance with a hospital.If that is your suggestion then I can only weep for Nigeria. OP, the lawyer is no fool. Process for getting death certificate in Nigeria The death must be registered by the registrar of birth and death in the area where death took place An applicant must have proof of death An applicant must be a blood relative of the deceased Death must be reported within seven (7) days from date of death Death reported after thirty (30) days from date of death and within twelve (12) months may be registered at a fee as may be prescribed by the commission Death reported after twelve (12) months from date of death can only be registered with written authority of the Deputy registrar. A death certificate obtained from the health institution where the death occurred is gotten. If the death occurred outside a health institution, there will be need to apply for one at a hospital. The certificate obtained above is then taken by the relatively authorized person to the registrar of birth and death in any designated registration centre |

Until he is declared legally dead, there is no way they can even start the process of transferring the rights of administration of the account to the next of kin or the man's kids. I think they have to wait for 7 years from the date he was reported missing, so the senior lawyer who advised the family is correct. |

@op u dont need many posters...just one will do. Go to d court n tell them u want a death certificate...d wil only ask u his birth date...death date..state of origin..place of death..and prolly cause of death..u musta framed up these before goin....d will charge u and hand over d death certificate and affidavit to u....d need not verify if actually d person is dead..and of course d will believe u since ur sayin hes ur dad.. proceed to probate registry..pay d necessary funds n present d papers d ask of u..d will open up a file for u and in due time u will b issued ur letter of administration.. Take it to d bank..d bank wil ask for d poster n death certificate..den will go verify d letter of administration u gave dem..once d bank verifies it ..d will pay u the money |
