Hello fellow nairalanders. I greet you all. I really need your help .I will try to cut the whole story short and wudnt mention names. The Federal Government leased some pieces of land @ a particular location to entitled civil servants who are interested. My mum who occupies the said building that was written to and then we started running around for the payments as outlined by the implementation committee.My dad has been in partial paralysis since 2007 and the family has been managing actually.We contacted my dads step brother to assist us with the finance to get the land and in return my parents promised to give him a certain portion of the land. I am very aware of this because I was among those that accompanied my parents to show him the place. He actually assisted us with the bulk payments but the receipts where done in my mums name cos she is the entitled worker. The issue now is that my uncle never called us or asked us anything .We were waiting for him to come develop his part of the land only for us to travel home for Xmas in 2014 and there was a general extended family meeting.This land issue was brought up and my uncle told everybody that we never showed him any part of the land,that he gave us money to buy the land. My dads body began to shake and his blood pressure rose immediately.He started urinating frequently . We calmed him down in the meeting and I told my uncle and the extended family that we will get back to them after we must have discussed as a nuclear family. I called my uncle one day and told him that we will give him back his money .But the issue is that he goes about telling people that gave us money to buy the land for him. Fast forward to yesterday.We got a letter from a chamber that we should submit all the original documents and C of O( All the documents are in my mums name) to him and vacate the premises within 21 days of the date of the letter. Since yesterday me and my brothers have been putting heads together to know wat to do next. Also my dad has been urinating quite often because his BP has increased.The letter was dated 5th of Dec 2016 and we got it yesterday.Please Nairalanders I need sound advise of wat to do. A.) First and foremost, DONT VACATE THE LAND AND DONT GIVE THE DOCUMENT OF THE LAND TO ANYONE!

B.) Just ignore the silly letter written by that useless Lawyer but incase they try to "harass" you, you need to first report him and the Lawyer to the Police (l dont trust those ones too, to do "justice" so be on the lookout for "connivance" ..... money talks!)

C.) You also need to get a trustworthy Lawyer, (l said 'trustworthy', because in Nigeria of today, corruption is so much that anyone, including your Lawyer, can receive money and connive against you! Always be Watchful.

Infact, get the documents kept at a very safe place, away from your home because such people can burgle the place and steal the document.

D.) DONT EVER GIVE THE ORIGINAL DOCUMENTS to ANYONE, not even your Lawyer!
Make photocopies, take one of the copies (with the original) to another 'separate and independent' Lawyer and let him "sign and stamp it" to say "original sighted". It is this sighted copy that you will be taking around and showing anyone that wants to see but dont hand it over! (they can clone it!
You can show your Lawyer the original at the onset [/b]but he should be satisfied with seeing the "sighted copy" afterwards. Only in a court of Law should you bring out the original again, even at that, it is for the Judge to just see it.


Now, to the nitty-gritty.
1.) From what you wrote, the documents are in your Mum's name - [b]That means she is the owner, irrespective of where the money came from.

2.) Your Uncle claimed he "gave your Mum money to buy land FOR HIM" - let him present any document signed by your Mum, showing that she was buying for him, as against buying for herself. Otherwise, his claim is just word of mouth! ... of No effect.
I reckon your Mum is still alive to say she was not under any agreement to buy it for him.
Let her decide how many plot or size she wants to give the creep (your Uncle) and stick to that value.

The fact that he has gone as far as getting a Lawyer to write your Parents, shows that he is greedy, wants to play dirty and cant be treated with kid's glove or respected.
He has made himself an ENEMY of you and your Parents.
Be ready for whatever he is ready to do but since you are on the side of truth, you will vanquish him, eventually.

3.) Tell the Lawyer to take you to Court. You might need to get a lawyer to write him, so that he knows that you cant be bamboozled.

4.) if your Uncle makes too much trouble, let your Mum insist she is paying him back the Money he "loaned her" and nothing more.
Let me inform you, he can only shakara you and your Mum but he cant force you to hand-over the land or its documents, except you guys are afraid of him. But legally, he cant do nothing, except play at your own terms.

5.) Tell your Mum and Dad to relax! Tell your Dad not to kill himself over the matter.
It is your Mum that is entitled to the Land, being the Civil Servant. It was your Mum that the Government issued the land to, not your Uncle so she remains the bonafide owner of the land.

I will personally swear for you, if you allow your Uncle to cheat your parents out of their entitlements.. and probably cause the death of your Dad in the process.
