This is just last minute card playing which cannot save Jammeh. When your matter has been concluded by powers that be, it has been concluded. The greatest mistake he made was conducting an election, as if it was not enough....he went ahead to concede defeat, turn around to reject election results and made parliament to extend his rule...
...piiiiiissssh.....he is a goner...only folks that are wise are ministers that resigned and fled.

You have, without realising it, turned the Constitution of Gambia on it's head. Gambia is not at war. Declaration of a state of emergency by the President of Gambia at this time is illegal and unconstitutional. He declared the emergency in anticipation of war. This is at variance with their constitution. Therefore, Jammeh cannot unilaterally extend his tenure. Your arguement in this regard is full of holes, Op.

You should understand wailers by now, they support anybody that is either an enemy or antagonist of Buhari and hate anybody that Buhari support. Can't you understand that they hate Barrow- an election victor, because he has the support of Buhari.
Re: Jammeh Tenure Extension : What I Found Inside The Gambian Constitution by PHIPEX(m): 7:00pm On Jan 18, 2017
Gambia is not yet at war so your position doesn't apply. The state of emergency is illegal cos the expected war can only happen after the tenure of the incumbent, the president therefore has no right to declare such. We must not applaud his stupidity which he mistakes for smartness. If we go by the OP's thinking then every president will extend their tenure by simply declaring a state of emergency.

There is always loophole in the constitution reason judges can never be caught even when they collect all the bribe in this world

[quote author=seunmsg post=52916379]Seriously, why are you wailers so terribly dishonest? You twist facts just to come to your dishonest opinion. This thread is supposed to be about Gambia's constitution but you can't just resist the temptation to slyly attack the president once again. For the records, challenging the result of an election is part and parcel of the electoral process and to the best of my knowledge, Buhari accepted all the decisions of the supreme court on all three occasions that he went to court.

As regards Gambia, you wailers can keep urging Jammeh on. After tomorrow, ECOWAS forces will move in and he will be dislodged so easily. If some of you like, you can go and fight for him, you will be roundly defeated together.
Young man, go read very wel if u werent born when PMB was defeated. He neva acepted defeat in gud faith rather he asked u d cleules ilitrates 2 fight n shed blood. Was even shamelesly craying n sayin AYI KARE JINI BIRI JINI.

A Nigerian Warship is Patrolling the shores of Gambia as we speak.. Senegal is hosting Ecowas' Forward Operation Base filled with battle ready soldiers waiting to invade the Gambia when given the order..

Technically, Gambia is at War..

If what I described above doesn't sound like war, I wonder what it sounds like?

Op
They may call you a wailer which you are by the way. That said, you have spoken the truth.

Any intervention by Nigeria, Senegal with their Ill equipped army will be illegal. Jammeh has good lawyers and seems to be smarter than all the leaders of West Africa put together.

He should go anyway.
It's on BBC, Senegalese troops are already massed on the border. This time tomorrow "ill equipped" Nigerian troops who have already jammed all radio stations in Gambia and taken control of the air over Gambia will be on the Banjul streets.

Sit there carping.

Dont mind wailers and their warped reasoning, even the Nigerian Constitution states that the president is not at liberty to hold elections and can extend his tenure if the country is at war

(3) If the Federation is at war in which the territory of Nigeria is physically involved and the President considers that it is not practicable to hold elections, the National Assembly may be resolution extend the period of four years mentioned in subsection (2) of this section from time to time, but no such extension shall exceed a period of six months at any one time.
So all Buhari has to do to extend his tenure beyond 4 yrs is to anticipate a war and declare a state of emergency. (this is according to wailers reasoning.

Wars begin long before the first shots are fired. And it'll be foolhardy to wait till the first shots are fired before getting ready?

With NNS Unity lurking around the coast of Gambia without an explicit permission of the Gambian Government, Gambia is at War.

With this singular act of his, the state of emergency, he is going no where tomorrow. Ecowas and useless Nigeria President who cannot think for himself have just played to the games of Jammeh. I promise you, nothing would happen tomorrow. Mark my words.

It's foolishness to create a crises and cry wolf. He is the one that's declaring war on the Gambian people. Ecowas is coming to help the people. Gambia is not at war, the (ex)president is on his own. He lost legitimacy with the people, Ecowas, AU and the rest of the world. After tomorrow he becomes a nobody.

I agree.. His time is over..

But ECOWAS should be careful.... They cannot disobey the one part of the Gambian Constitution in their quest to enforce another part of that Constitution.

With Senegalese troops on the border within the last 30 mins, sea blockaded and Nigerian jets roaming the Gambian sky without a peep from the Gambian army.

There is no plan for Jammeh. Nigeria has for once acted decisively in the W.A region.

The Gambian Constitution was breached when Jammeh sent soldiers to the electoral commission before filing an appeal. You cannot be a judge in your own case neither can you build a case on an illegality. Those are two cast iron legal maxims.

I don't care what happens to Jammeh.. I honestly don't care..

But the OP presented the constitution. And Jammeh is taking advantage of that constitution. He got the approval of the parliament (representative of Gambia people).

So, Tell me.. If Ecowas go in blazing tomorrow, will they be seen to be protecting the Gambian people or constitution when they are in fact disregarding the constitution and the Gambian people represented by the Parliament?

I think Ecowas needs to rethink their strategy.. Force won't cut it.
