My Dad had the same experience.She has to take drastic actions and be ready to go to court.Actions like dumping a heap of sand at the entrance,locking up the main gate and leaving the pedestrian gate etc.Please do not remove their doors,windows or roof.

Am surprise some people don't like due process. If you follow some of the advice here, the landlady will end up messing up the whole thing. Get a competent lawyer and sue them. Inability to pay rent is a ground. When it expires yur lawyer should. File the necessary legal suit to recover ur property. Some tenant will ask for extension of time but the judge will over rule that on the ground that they ve spent more than a year already. The best they can get is a week. After that week sherif with eviction order will come and throw their stuff outside. Raining season is the best time to do this so that all their properties will be damaged in lure to the rent they owe you. This method worked for me and also my current landlord used same method to evict one of his stubborn tenants. Thank me later. Must stubborn tenants re yorubas talking from experience.

My advise to Nigerian Landlords is to accept monthly rents, this would ensure that tenants pay their rents as and when due.

We must remember that no one is paid salaries in advance, therefore asking tenants to pay one year rent or sometimes two years rent in advance is really burdensome.

For salary earners the landlords can insist that the tenant reaches an agreement with his/her employer whereby the employer deducts the monthly rent at source and pays same directly to the landlord.

It is much easier to pay N40,000 a month than to pay N400, 000 per annum. This would even earn the landlord a profit of N80,000 per annum.

Wicked is an understatement lol. Anyway sha.. Tenants can be heartless. The one we have here have refused to pay NEPA bill for over 6 months now. Went home last week only to hear that she has packed out..without paying.

See ehn, I'm a tenant myself n that is Wat I advised my aged landlady to do. We got carpenters to remove the roof even mine to pretend d landlady wants to renovate and I preached same to the silly tenants, in less than a week they moved out and mama fixed my roof n doors back. With an extra 20k for job done. It works like fire. Just tell ur friend's mum to forget d lawyer n caretaker, those tenants might v settled them as they too are looking for money. If anyone of them gets police after the act, which ever way, the woman will win, that I can assure you cuz the agreements will serve as strong evidence "exhibit" against the tenants. I'm expecting the great news about the outcome soon.

Hi whizqueen. I empathize with your friend's mum. I had a tenant a while back who played a fast one on me and my undoing was that I trusted him much more than he was worthy of. So when I got a new tenant, I properly wrote an agreement and stipulated one month as the length of the notice to avoid a stories that touch.

To the issue, I will advice that she goes the due process route, more so that she has waited this long. Any resort to self-help may compound the problem more.

So I advise that;

1. Get a lawyer who knows his onions, preferably a young one. (I know a couple of good colleagues in Lagos). Only that competent legal services usually come at a cost.

2. He'd write a letter to these tenants detailing their atrocities and also serve them the Notice of Owners Intention to Recover Possession (7 day's Notice)

3. At the expiration of 7 day's he'd institute an action in a Magistrate's court.

Stage three is where he needs to be really smart. He ensure that the processes are served on time, get early dates and ensure that max. 3 months the suit is completed and decided in his favour. Then, he moves to execution of the judgmenr if they refuse to comply. Their luggage would be removed from the premises and moved to the court.

As an aside, she can disconnect the power source to their apartment for starters. grin
the fear is she doesnt want it taking more time than it hass already. they have spent extra 9 months, and i guess the caretaker and his lawyer are not doing justice to the said matter.

Get a lawyer to write to them officially: address the letter to all the 'illegal' occupants of the property. Give them 2 days to vacate the premises in view of the renovation work that will commence soon. That way, no tenant can claim damages because you already wrote them and notified them indirectly that they are illegal occupants, having no case or claim whatsoever.

Within the said 2 days, commence your renovation work which involves pulling off roofs, doors and windows. Unless the woman picked the money she used to build the house from the drain. She has every right to enjoy her properties.

Next time, get a good lawyer to draft an agreement with prospective tenants. I learnt the bitter way too. In my own case, the worst was the 14months NEPA bill of N195,000 but my lawyer was good. He initiated the quit notice 4months after the tenant defaulted: tenant was served 6 months 'paid' notice, 3 months follow-up notice, 1 week reminder and then another 3 months at the court. At the end, he ensured the court siezed the tenants properties so as to recover the rent and utility bills. Court auctioned the said properties and part of the money recovered was used to settle NEPA bills.

Sometimes you count your loss and move on. I couldn't recover my rent but I doubt if I would make the same mistake again. The tenants has already seen the landlady as a weakling, if they perceive weekness on the part of caretaker/lawyer then you are done for.

Bribe the judge and the process will become shortlike magic. Most times they deliberately stall ur case to see if u go roger. Trust me...ask any one who works in a court.

A similar case happened in my area last year... What the landlord did (still a suspect) was to set fire in one of the flats.... O boy nobody told them to all packed out

Dont take off anyones roof or use force. Dont listen to what some irrational beings post here. This will put u in problems as some tenants might claim loss of properties due to ur action....u mite be sent to a cell or adked to pay for the ''missing items''.

The caretaker and lawyer are very incompetent.
Quit notice time has elapsed. There's no need going to court. I repeat, there's no need 'cause she'll be wasting her time and limited resources.

If she really wants to get her property back, she should take a practical step.

Go there and get the roof removed. This will work 100%, writing from experience.

She owes no one an explanation after giving them enough tome to make necessary arrangements to vacate.

Get the roof off and the inconsiderate leeches will quit in 2 days max.

She shouldn't even tell the caretaker, 'cause he may be selling her out without her knowledge.
Let her bargain with a carpenter that'll take it off and re-fix it afterwards. By the time they're done un-roofing two of the flats, the occupants of the other flats will get the message loud and clear.

we serve them 3 days renovation notice and on the third day capenter and an electrician will visit the place on most likely a sunday morning, roofs off and wire disconnected. subsequently we go crazier... we go hire agbero that day. we would have gone all civilian but i doubt her recovering the debt back and this will take longer process.

Guy pray you dont see case, I know of a man who bought a house in my area, he gave the tenants quit notice, they refused. He decided to remove the roof and claimed that he wanted to renovate the house he just bought. The tenants sued him for damages the case was in the for months the useless tenants didn't leave.
He had to plead and pay dem out of court.

My dad always shine teeth with he's tenants,even invite them atimes to he's house,I have told him countless times that over familiarity will soon start making them feel comfortable to owe and like play,it started 2 years ago,dem know me as jaguda when no dey smile by the time I show like this nobody tell them na.

some tenants can be cunning and troublesome despite the existence of a written agreement between the landlord and tenant. Your mom should take them to court or get street urchins to move them out immediately. Desperate situations requires desperate actions. My hubby starts mounting pressures on his tenants the very month their rent expires. Two of our tenants were owing rents of about 4 &7 months respectively and decided to move out but we recovered every bit of our money including NEPA bill from them. We took one to the welfare unit of the police force while we seized the other's property equivalent to his arrears until he liquidated his indebtedness which he did faster than we expected.

Next time, tell her to use the agreement that reads "fixed and certain". Under this agreement, the tenant is deemed to have rented the apartment just like a hotel rent per night, and is not entitled to any 3 or 6 months notice. Once the rent is expired, he or she has Max of a week to pack out and if he or she doesn't, you can apply to the court to recover your property from the tenant.

Please what is this 'fixed and certain' agreement?

I av been in almost a similar situation just that mine wasn't upto 3 yrs, My dad was an influencia and lenient person that he never cared how his tenants paid, what the tenants do is to bribe the barrister in charge and make payment when ever and however and as a student I studied how those things were going though never had any power to exercise and the only person that understood me was my mum, at a point she felt my dad was under a spell by his tenants.

So when I decided to take the bull by the horn , I first made my dad relive the old gay barrister of his job which he did, then I went to court and made a very authentic agreement which I knew that once they sign it and defaults they will be hunted till there grave . At first the barrister who helped me acquire the aggrement try convincing me that when a tenant and landlord case is brought to a court by a lawyer that magistrate could be concerned on when a power of attorney was handed to the lawyer that filed a suit which could be a flaw to the landlord in other words he was trying to push me into giving him the power of attorney so he could go ahead and mess things up just like the other.

So what I did was serve them the stated agreement which some failed to sign and thinking it was a business as usual, I then went ahead to involve police since there was no lawyer manageing the building so the plan was to take records of the properties thrown out so they wont say their millions was stolen in the couse of it. it was now that they relaised what was going on, they filed a suit againt me but that was after I made sure they were out of the compound. it was now I paid a lawyer to defend my case which was very fair on my part.

It's like leasing a hotel room. Your rental tenure is fixed. You move out as soon as your rent is due. You are not entitled to any notice to quit.

This is going to be on hell of a long post. Please read and bear with me. I'm writing on behalf of someone who happens to be my bestie and her mom is like my mom too.

So bestie's mom is a civil servant that earns on monthly basis, she took loan severally to build herself a house located in ogun state. With plenty of pains, starvation and hunger she finally completed 4 flats of two bedrooms each after like 10 years. Ever since the building has been ready she has never for once enjoyed steady flow of rentals her tenants, it's either they are unable to pay and get kicked out or the new tenant comes up with a story of how his business went bad.

The house has been ready for not less than 6 years now with various categories of tenants. Mom is really sad and decided to hand over to a caretaker, the caretaker suggested that all old tenant be sent out and fresh new people taken in. The debt of some of the old tenants was up to 2 years oo. For one particular guy who happened to be a colleague of my friends' mom , his own debt is up to 3 years without single pay. He keeps coming up with cock and bull stories. The idea of the caretaker was that  mom holds a meeting with the tenants and tells them that she sold the house to someone and that the old tenants should move out as per they don't kuku have rent in advance. The meeting was held a lawyer was called and quit notice was served to those tenants giving them 6 months.


Now the issue is 6 months lapsed with 3 month on top of it. Meaning for going to 3 years for some tenants no pay and she hasn't gotten paid for 3 years by any of the 4 flats. Salary isn't steady again, debt has risen and bills has skyrocketted. My friends' mom seriously and badly needs money. The supposed caretaker and Lawyer isn't handling the issue like they should and our mommy is fed up. The caretaker keeps saying she should still hold on because if the matter is taken to court it might even take much longer than it has already. She keeps thinking about it daily and begin to get worried that it's not worth the stress building a house. These tenants are bunch of frustrating beings.

 Is there a way to send those people out more quickly? Have you ever been in this situation and how did you handle it? What are the consequences of getting a court involved? Is there a better way of sorting this.

I need your opinions please mom dey worry too much. I tire biko
