How EFCC Can Win Corruption Cases In Court – Obasanjo by Sanchez01: 5:40am On Apr 10, 2017
Former President Olusegun Obasanjo yesterday advised the Economic and Financial Crimes Commission (EFCC) on how in corruption cases, declaring that they needed ‘ogbologbo’ (competent) lawyers, among others.

Obasanjo, who spoke while playing host to members of the Correspondents’ Chapel and some media practitioners in Ogun State at his Hilltop residence in Abeokuta, also said there was no truth in the allegation made by Gen. Ishiaya Bamaiyi that his administration wanted to kill him.

The former president said for the EFCC to be result-oriented, it must adopt a three-pronged approach of thorough investigation, diligent prosecution and committed judiciary.

He said, “I was reading today when the President (Muhammadu Buhari) said the EFCC should stop losing cases. They lose cases for a number of reasons. One, they engage more of outside lawyers. I believe that they need staunch, ogbologbo lawyers inside that will do the work.”

He gave the second factor as thorough investigation and third factor as judges who must be committed in fighting corruption, “because if the investigation is very sound and you have ogbologbo lawyer to handle the case, if you have Salamigate, you know what the answer will be.”


Obasanjo also denied the allegations by Bamaiyi in his book. Bamaiyi was detained in October 1999 and charged for the attempted murder of the late publisher of the Guardian newspaper and former Internal Affairs Minister, Alex Ibru. He was, however, discharged and acquitted in April 2008.

But last week during the launch of his book, Vindication of a General, in Abuja, Bamaiyi said the Obasanjo government plotted to kill him in detention.

Obasanjo who played host to members of the Correspondents’ Chapel and some media practitioners in Ogun State at his Hilltop residence in Abeokuta, said in response to a question on the matter, “My government did not plot to kill him. My government asked him to answer to those that were alleged to have been killed by him and that is legitimate. That if there is an allegation that you have done something, that you have committed a crime, then you are arrested, you should answer. And that’s all.”

Our judiciary is still as corrupt as the other arms. Having your own prosecution team is indeed the best way to winning.

Putting an end to media trial should as well cease so as to keep the element of surprise intact.

The fight against corruption would remain futile so long our judiciary remains the way it is. And the annoying thing is almost every lawyer has been bought just as majority of the judges who would readily preside over these cases. The FG should suspend its fight on other arms while it intensifies investigations of most judges, through the DSS and anti-graft agencies. Until then, we would keep running in a vicious cycle.

Do your homework well and you'll be sure of amazing results

They should also get rid of insider dealings. The legal team should assess cases before going to courts.

Legal team at the other sides too are not sleeping, they can get ogbologo lawyer.

But he knows that's not happening soon. That's long term solution. A short term solution would be for EFCC to have its own court and judge.

Presently we have no judiciary.
Politicians have bought them all.

When the govt loses a court case, those who hate this govt always rush to scream "media trial". But when they win, the same haters get ashamed and hide their ugly faces to the EFCC's success. Truth is, in legal matters, you win some and lose some.
But I keep wondering... Is it not money that belongs to all the citizens of Nigeria that was looted? How come some are happy that criminals will keep their loots and walk free when others don't know where their next meal will come from?
Why has politics so blinded us to our suffering reality that we overlook it for people who don't care about you.
I expect every single Nigerian to always condemn corruption whether you hate the president or not. We should not be this shameless if we expect the country to become better in the near future.
Having said that, the only case where it looks like the judiciary gave corrupt judgement is the Justice Ademola's case which the F. G has appealed.

Is that an Euphemism for calling for a clampdown on Judges? You people subjected people to media trial without any shred of evidence and expect to win? Even if the Judges hate the suspects they will still walk.

Stop blaming the judiciary rather blame the incompetent and vindictive EFCC for going after people because there are corrupt rather because there are seen to be friends of the past government or critics of this present government.

the only problem is the judiciary, if legislators and executive are both corrupt, judiciary should be above board.
But what we have now is worst, every arms of govt is corrupt and the people are also corrupt.
Even my Jesus cannot fight corrupt.
Corruption is a culture, who dont do it, wil look like an outcast

1999 constitution can't be used to fight corruption, draft a new constitution and corruption issues will diminish, there are loopholes in the present constitution

What about the prosecuting agencies like DSS and EFCC.

are they really providing enough evidence to help these lawyers get a conviction?

And are you aware that mode of arrests and seizure also matters a lot. A good defense counsel can take advantage of this . If you don't follow the legal guidelines when making an arrest or freezing an account then definitely a good defense counsel will pick holes

Efcc have to be independent first before they can make real positive progress in their fight against corruption, what we have today is a direct opposite of what an anti corruption agency should be. they are a farce.
