N1.5bn Contract Scam: Appeal Court Discharges Ex-NIMASA DG source: http://www.eyesoflagos.com/2017/05/n15bn-contract-scam-appeal-court.html Reprieve yesterday came the way of embattled former Director-General, Nigerian Maritime Administration and Safety Agency (NIMASA), Raymond Omatseye as the Lagos Division of the Court of Appeal overturned the five-year conviction imposed on him by Justice Rita Ofili-Ajumogobia of the Federal High Court. The upper court in a unanimous verdict discharged and acquitted Omatseye of all the 24 count charge of bid rigging and contract splitting upon which he was convicted of at the lower court. It would be recalled that the Economic and Financial Crimes Commission (EFCC) had re-arraigned Omatseye in 2013 before Justice Ofili-Ajumogobia on an amended 27 counts. In the amended charge the EFCC accused him of engaging in contract splitting and bid rigging to the tune of over N1.5billion while in office as the DG of NIMASA. The offence, the anti-graft agency said, contravened Section 58(4) of the Public Procurement Act 2007. In her judgment, the trial judge found Omatseye guilty of 24 out of the 27 counts charges. She however, discharged and acquitted him on three counts bordering on bid rigging. Justice Ofili-Ajumogobia sentenced him to five years imprisonment for each of the 24 proven counts, holding that the sentences would run concurrently. But the Court of Appeal, presided over by Justice Yargata Nimpar yesterday held among others, that the trial court did not properly evaluate the evidence. Justice Nimpar resolved all five grounds of appeal in the appellant’s favour.

blackpanda:Hello? Are u there or have u hidden ur head in shame. I am still patiently waiting for your list of those convicted and imprisoned for looting by this pmb's regime. Sustantiate ur claims. |

blackpanda:Ha!ha!ha!ha!ha!ha! Bros eehh! The unknown and unverifiable source u referred me to wrote cases from 2007 to 2015. Non in this regime whose main focus is fighting corruption. Even the "corrupt GEJ secured some convictions but none for this regime. Dasuki nothing Orubebe discharged, Metu nothing Deziani no case Omatseye discharged Tompolo nothing Ozokhime nothing Ffk nothing Etc. Your source was even quoting the nations newspapers. It said that the nation newspaper said that efcc said that it has 127 convictions in 2016 of breach of trust, money laundrying, etc, still no name of a convicted looter was mentioned. It mentioned those still in court during pdp era with specific names mentioned but none in this regime. What a shame! |

jusRadical:You see the problem with wailers! You cant differentiate between political party and government institutions. EFCC was there long before pmb came to power, and it will remain long after he has left. It is not PMB that arrests looters and thieves, infact once his tenure is over even PMB himself can be arrested. Try to grow some sense |

jusRadical:Well your reasoning is not surprising. You are unable to reason beyond selfish political bias Am not interested in comparing pmb to gej. But in any case, the fact that you can even mention so many people that have been indicted so far shows that it is no longer business as usual. EFCC is being given the free reign to do its job and no, it is not the job of efcc to convict. That is the job of the judiciary. i wish you can grow up and think in a more matured manner rather than this sill rabble rousing. |

blackpanda:As a child, u are ignorant. Cases are won based on evidences and proving a case beyond all reasonable doubts. Has ur pmb been able to do these, noooooo!!!! Courts work on evidences and not market women gossips like this regime is engaged in doing. Media trial gullible child. Why seek for secret trial against dasuki? Propaganda government that does not know that elections campaigns were over 2 years ago. Efcc has been given free hand and yet no result. U guys like to display ur ignoble ignorance: dasuki, metu and co still stand as ACCUSED persons. This means that they have not been found guilty by any court if competent jurisdiction, so they are NEVER CONVICTED and guilty yet unless pmb and apc can prove their guilt before a competent court. Rubbish. Gullible folks. |

blackpanda:What nonsense did i just read. The job of the EFCC is to provide proof beyond all reasonable doubt to nail alleged corrupt people and not expect the judiciary to pander to akara sellers rumour mills and beer palour gossips. |

blackpanda:Ha!ha!ha!ha! Bros eehhh? Take am easy ooo. So u that lives in courtrooms does not know that cases are won based on proofs, evidences and logics? So after living in courtrooms, u do not know that it is only a court that can declare one guilty and not market women gossips on newspapers? O di egwu oooo. Like president like his worshippers (illiterates). I heard he signed a handover note without reading it. Puaaaa. |

Agimor:Its nobody's fault if you decide to be ignorant. So because there have not been any high profile conviction you call the anti corruption fight a failure? Shame on you. EFCC\ICPC have sucesfully prosecuted hundreds of cases and have gotten hundreds of convictions. Its no use arguing with you guys or making you reason since everything to you is PDP VS A PC, GEJ/BUHARI . hundreds of civil servants , business men , politicians are cooling off in various jails all over the country . E.g. Bala Ngilari. Whether you play politics with it or not the fight is ongoing and is a success , your only excuse is that most accused are members of opposition party but a thief whether in opposition or not is a thief. |

jusRadical:Taaa stop making all these blank false statements like " companies are folding up, investors avoiding Nigeria like plague e.t.c Many new companies are opening up and employing Nigerians . Even in the best of times when our economy was growing 7%, oil was above 100$ , dollar was 160naira........... companies were closing down, there was high unemployment (growth without employment ala voodoo economics of NOI) investors were relocating to Ghana so what are you blabbing about? |
