It is sagay himself that is confused. The Senate can't decide for executive who to nominate for a position but the executive too can't decide for the Senate who to confirm and as long as you are not confirmed as an EFCC chair, you can't hold on to the office illegally. The law envisaged a situation whereby the president may eventually nominate his wife as EFCC chair for vendetta and personal reasons so it created a check and balance via confirmation with the Senate which are representatives of the people. Once the Senate says no, it means no. If you are not happy with your senator decision you can recall him but whatever he does in his capacity today as your senator is legal and must be respected. So it is partisan sagay that is a comedian
MR Helpee. is like you and the Senates needed help because all of you are confused.
if not, ask your self which ordinary man could have eighteen counts charge of corruption cases will go free?. you and the Senate didn't think abt that.
take it or live it.

The Senate under the 1999 Constitution has the right to confirm or reject Executive nominees for certain Federal Agencies. The EFCC falls into this category.

Unfortunately, the moral and integrity deficiency plaguing our Senate has made them to be seen as albatross to national development rather than as agents for enforcement of good governance.

That is only applicable if they are yet to send his name for confirmation. This is abuse of our constitution. The constitution envisaged that some people chosen to act in some sensitive post by the executive may not be in the best interest of all that is the essence of confirmation. You can't be rejected for a substantive position and now claim to exercise same powers only in acting capacity. You yourself knows this is an aberration but i wonder when nigeria will ever be ok if we all see that this is not right but based on our partisan stand we close a blind eye. If the executive can keep people perpetually in position without confirmation by the Senate the essence of checks and balance is defeated we will never grow as a nation
love the way you argue.

For how long are we going to beat
Around the bush and not fix the broken door. The Senate is trying to pursue real seperation of powers but the propaganda from the executive is swaying emotions.

The senate might not be what we want but their decisions so far is justified. I saw executive rascality during Obj tenure that made democracy look like military regime because the legislature were rubber stamped.

Magu who is in the eyes of this storm has been indicted by the DSS and the Senate needs to consider all reports before approving Magu did the right thing by rejecting him.

Do you know that when you are tainted that it provides a leeway for an opponent to hold you to ransom. Magu will be a later day disaster if we don't do the right thing today.

Let Magu go and a better replacement should be done
U people just come online to say nonsense. Magu was indicted by the DSS, and the Senate sent reports to the presidency and AGF for possible prosecution. The AGF found out that most of the allegations were false and frivolous and cleared Magu and sent back to Senate. The senate knowing they don't want Magu went back to bring another version of DSS report, almost same as the previous which Magu as been cleared of, and used that to reject him again. Now it is important to note that the Constitution which supercedes the EFCC act does not state that Magu' confirmation is subject to Senate approval. So wake up!

If their approval was not needed, why was the nominee's name sent to them? Hypocrites.

Chairman of the Presidential Advisory Committee against Corruption (PACAC), Prof. Itse Sagay has described the Senate as a ‘confused’ assembly.

Sagay said this while reacting to the suspednsion of confirmation of appointees over a statement made by Acting President Yemi Osinbajo.

Osinbajo had reportedly said the President was empowered to make some appointments without seeking legislative approval as provided in Section 171 of the Constitution.

He was reportedly speaking about the refusal of the Senate to confirm Ibrahim Magu as chairman of the EFCC.

Sagay however said the senators wee afraid because their hands were not clean.

He said Magu was an executive appointee who could not be sacked by legislative pronouncement.

He said, “Those who have profited from the corruption that has ravaged this country for years are the ones the Senate is trying to please. Magu is an executive official appointed by the executive arm and he has powers under the EFCC Act, and clearly, the constitution gives the President the power to appoint him.

“The Senate cannot be both legislature and executive. They cannot determine who should be sacked or not. They can do that for their legislative aides but not for members of agencies under the executive branch.

“This is a confused Senate which does not know whether it is a legislative body or an executive body. It wants to be co-executive with the Presidency which is not possible.”

U people just like jumping into things that u don't even understand. The senate knows there a gullible folks like u that's why they keep whining. 1. No where in the Constitution does it give a time stipulation for Magu to act. 2. The Constitution which supercedes the EFCC act does not state that Magu is subjected to confirmation by the senate. 3. The senate forwarded the DSS report to the presidency for investigation which was in turn forwarded to the AGF for investigation and possibly prosecution, the AGF found out that most allegations were false and frivolous and cleared Magu, which the presidency notified the senate and sent Magu's name again. The Senate who does not want Magu confirmed still brought in another DSS report, almost the same as the previous and used that again as a reason for him not to be cleared. The question is wat is the 7th senate scared of? The executive should not have even sent Magu's name for confirmation in the first place cos they didn't have to. Lol. It was just a traditional, and this present senate attitude have exposed a loop hole. Every sane person now knows the Executive does not need senate confirmation on Magu.

which mean they still insist on their report and by the way DSS is the number 1 intelligence agency
Let's follow this logically.
DSS make allegation against Magi
Presidency acting as judge, declared him innocent
Presidency forwards name to senate again
Senate rejects Magu, based on the DSS report that Magu has already been declared innocent on by the presidency.

Do u think the presidency should honour the senate??

I don't think so..

Personally I don't consider Magu a saint or even fighting corruption.. But in these circumstances, Senate have no right to stop him

there is a reason why the crafters of our constitution made compulsory for certain appointees to be confirmed by the senate mainly for checks and balances, the presidency allowing Magu to remain in office despite rejected by senate is an affront to our constitution, must it only be Magu that will head efcc, what if he dies won't Buhari replace him with another person, I think we should make strong institution not strong or supermen.

For our democracy to be entrenched there must be separation of powers and checks and balances between executive, legislatives and the judiciary if not we are heading toward dictatorship, my support for the senate on this matter is not out of any sentiments but facts as relates to our constitution

Sagay is senile. No legislator wants to be part of the failed executive that wrecked Nigeria's economy. Buhari is comatose, fake pastor fake professor Osinbajo is a liar, and Sagay the widow robbing senile fool will taste the wrath of God.

u speak well.. But in an instance where a large proportion of the senators are being investigated by the EFCC. Do u think the Senate can be fair in their judgement?? If an allegation is sufficient for Magu to be rejected, I don't think 90% of the senators will hold office.. By the way, since senate have decided to play politics with the Magu issue, the executive arm have responded accordingly.. No law stops the executive from representing him continuously to the senate.. No law stops him from functioning in an acting capacity..

Again the constitution rightly said that certain appointments must go to the senate such as ministerial and ambassadorial appointments.

“Those of heads of agencies like the EFCC do not have to go to the senate. That’s what the constitution says. But the EFCC act, which of course as you know is inferior, says that EFCC chairman should go to the senate for confirmation.

Yes the confirmation of efcc chairman is by its act but the constitution is just silent, and where the constitution is silent the act can take precedence.

The presidency knows fully well that efcc chairman must do dirty works, but because of laziness it refused to forward it's name for the senate immediately after appointment, instead they waiting for months when Magu may have stepped on toes, my advice to the presidency is to look for another capable hand and appoint him then immediately forward his name for confirmation, because the issue of keeping Magu perpetually is an abuse of our laws, today it may be Magu which the presidency like but what if tomorrow a bad guy that that is liked the another president is kept in a position in acting capacity even when he is rejected by the people, let not create this scenario and strengthen our institution.
