Yyeske:You and I know that you are only joking or not conversant with the law first of all the govt committed contempt of court by invading the house of someone whom they have case in court ,after killing innocent people including his dog he is no where to be found and then you turn around to say you will hold his surety who dropped #100million bail bond .very funny. If abaribe mobilises his lawyers the federal govt will not only refund his #100million but will also be held responsible for providing Nnamdi KANU in court because according to kanus lawyer ,Nnamdi called him while soldiers were still in his house shooting sporadically. |

Take for instance, under our education system the south and the north has a stipulated cut off mark for their wards to gain admission into federal unity school which is not encouraging at all. The Southern kids are require to score higher than their Nothern counterpart before they gain admission with the East having the highest court off mark......what does this imply? It simply means that Chinedu, Tamuno and Olamimide are required to score to a stated cut off mark while Isa, Aminu and Aliu are to score less to gain access into same Fedral school. Let me ask you are the south having a hydra head of a monster why they are bearing one? Are we not subjected to the same environmental conditions and hazards? Are we not from same country? Why must they be discordancy in apportioning scores? I can mention many more, as long as we keep on hiding the truth about inequality of some certain issues or preferential treatment meted to some region or people because they are perceived as illiterates and requires softlanding in life then i bet you we will keep on beign like this. All these i have observed in almost all the ministries not just education. |

Let me reveal part of why I'm supporting Biafra. No hatred please. A bit long but beneficial for your vigilance. I'll summarize. Apart from the genuine reason that self determination is a welcome idea to me and that the whimsically forced union of the independent regions was without consultation with the local potentates, I have other (maybe personal) reason I seriously believe we should allow Igbo's to go. Let's not force it, it's just not working please. I'd begin with what I saw some months ago at Ladipo car-parts market. I took my Toyota Sienna for service and my mechanical engineer decided we should go to Ladipo market to buy the necessary parts. I agreed. When we entered the market, I saw many things. These boys are the ones making most of these things with inferior materials by themselves. Infarct, they also took dead parts, muffled some things inside with fake chemicals, spray them paints and voila, they package it as new ones again. Another time, I took a Volkswagen Golf 3 I just bought for sake of doing only short distance wakawaka, to the same Ladipo market to buy "catalyst" as my engineer called it. The prices ranged from 8k to 25k for that model of car. I went for the unit sold at 18k because I felt that would be close to the better and match effectively as average. After buying and a panel beater was still helping to fix it, I went back there to find a local canteen I had seen around selling Fufu and Eba. The canteen has pieces of net used as demarcation to form of walls which allow for breeze and also enables see-through. I saw through, another shocking revelation of how these boys were slicing up empty pots, loading copper materials inside and packing the both ends in the pots with tiny sheet of the catalyst. Then they seal it up. What this means is that 80% of the content is the copper material, but if you look from both ends of the sealed pot, you'll see catalyst! When I challenged one of them about the daylight fraud, he said, unconvincingly; "if we call big price for una to buy full catalyst, you go fit pay?". I nagged, wailed, wailed and wailed but I was almost becoming nuisance. They were all the same doing it in the market and gave me a dismissive shrug; the kind that street boys call "kò Kan ayé". I later returned for some discreet recording of their fraudulent operations, but the gadget containing that piece of footage and other works was later stolen (another story). But that's not where I'm going. Tonight, I escaped untimely and avoidable deat by chance/grace/luck -whatever! I just picked my small Benz CLK from a mechanic shop. I had complained about a sudden strange noise at the front absorbers. After he examined it, he recommended changing the tie rods, ball joints, linkage and some other parts in that system. He told me about a complete pack that contains everything along the steering line as against buying the identified units in pieces. I preferred the complete pack. He told me about new one versus tòkunbò. I preferred the new one. I did because he told me the new one is original and has not been used, even though it's more expensive. That was 2 days ago. I picked the car this afternoon. I had only driven to Berger from Akoka and was returning, the new complete pack rod broke while I just turned the steering to enter the road from a side I had pulled up. No motion yet; I wasn't speeding and had not entered any craters on the road. Nothing at all that could have triggered a fracture. I quickly called the mechanic to come and "see the life outside" of the new thing he purchased for me. When he arrived and saw it, he opened his mouth wide agape. He examined the rod properly again and confirmed it could only be Aba-made. I actually saw when he first brought the complete unit before installing. It was packed in a shiny transparent nylon just like the original. He confirmed it's the usual way the product is packed by the maker, but this particular unit, examined after the incident, is an imitation put in the same pack. He called the seller he bought from immediately. Guess what the seller said; "that means e don enter pothole with the thing! Let him go to church tomorrow and do testimony". Even if I entered pothole, the old one that was only giving a mildly strange sound NEVER fractured or broke off completely as this supposed new one that hasn't done 150 kilometers I don't know how many victims they must have killed by selling their Aba made imitations. And those that narrowly escaped must have been "doing testimony" in churches over avoidable or unwarranted crises such as this one. Please let's all come out and support them to go to their own way. Then, we shut our borders against imitations and fake products. These things should be limited to Aba, Onitcha, Owerri, etc. I also learned they make imitations of the red wines claimed to have been imported. Same way, people must have been consuming fake drugs and dying slowly or quickly. Enough is enough please, you guys should koman be going to your Biafra land. We're not doing again, please. PS: I have great Igbo friends, but this doesn't justify for the acts of the non-challant, fatally fraudulent, kidnapping rogues who care less about lives of others for sake of "making (blood) money. Yyeske:one of the conditions given for the bail was that senator will stand surety for him and was done. or were you expecting nobody to sign surety for him? my brother it is like you have been watching too many tyrant films and it is really affecting you.we are in a democracy things are not done the way you think,just like the invasion, which is wrong. even if they wanted to arrest him they should have made application to the courts for a warrant of arrest which should have been easier for them than the show of Shame exhibited .we are not in a banana republic or junta. |

THE LEGALITY AND/OR OTHERWISE OF SURETIES TO THE LEADER OF IPOB (NNAMDI KANU) TO SHOW CAUSE: It can be a horrendous nightmare for a Surety when an accused person bailed out by him (by execution of a bail bond) in a criminal proceeding, absconds. *The Consequences to Surety when the Accused Absconds When an accused person on bail fails to attend Court as required, the following consequences follow: 1. The DPP would apply to the Court to issue a warrant of arrest against the accused. 2. The surety would then be asked to show cause why the surety bond he had executed for the appearance of the accused should not be forfeited. 3. The Court will then adjourn the matter for further mention on another date for the Surety to show cause. 4. At the show cause mention, if no cause is shown, the Surety will be provided an opportunity to make a plea in mitigation as to why not all of the bail sum should be forfeited. 5. At the same mention date, the warrant of arrest would also be reviewed. ***The Legal Nature of a Bail Bond*** As to the nature of the obligations entered into by a Surety when a bail bond is executed The extent of the surety’s obligation under the bond is determined by the terms of the bond. A surety bond is no different from a guarantee given in a civil contract. Any breach of the conditions of the bond gives rise to a forfeiture and the amount forfeited is in the nature of a civil debt. Under … the Criminal Procedure Acts, this debt is enforceable by the Court by issuing a warrant for the attachment and sale of the property belonging to that person but this remedy does not prevent the Government from enforcing the bond under the Government Proceedings Act… Therefore ordinary principles of construction apply in the interpretation of the terms of the bond to determine the extent of the surety’s obligation thereunder. ******Show Cause*** If the Surety appears in Court on the date of the mention when the accused’s attendance was required (but on which date the latter did not attend but absconded), the Surety would be informed by the Court that he has an opportunity to show cause why the bail sum should not be paid and a “show cause” proceeding for that purpose would be fixed at the next mention date. If the Surety too does not attend Court on the mention date, a “Notice to Show Cause” will be sent to the address of the Surety to be present at the “show cause” proceeding mention date. At the mention to show cause proceeding (commonly known as “Surety to Show Cause”),in theory, it is possible, in exceptional circumstances, to successfully show cause why the bail sum should not be forfeited. For example, where: (i) a medical certificate is produced stating that the accused was medically unfit to attend Court on the relevant date and time; or (ii) the accused is in lawful custody, ie arrested and in the custody of the police or admitted to a Drug Rehabilitation Centre or remanded or serving sentence in a prison. In all of these situations, the fact that the accused is (or would be) found clearly plays a crucial part. Needless to say, if the accused has not been found on the show cause mention date, it is unlikely that the show cause point would even arise. Of course, if the Surety connived at the disappearance of the accused or aided it or abetted it, or was wanting in due diligence to secure his appearance, he will have no chance of showing cause. In practice, in most cases, however, any attempt at showing cause by the surety would almost invariably fail. IN THE CASE OF NNAMDI KANU: 1.NNAMDI KANU'S bail is still running when the army invaded his house. 2.Nnamdi Kanu's perceived bail violation has not been decided upon by the court that granted same. 3.Since his house invasion by the military, he has been left incommunicado 4.No one is aware of his whereabouts since the invasion. 5.His organization has been proscribed by the govt and the legal implication is that no one should associate with him even his sureties.. SUMMATION The notion that his sureties will forfeit the bonds is neither here nor there. The sureties don’t even have a heavy burden to show court as the reason why KANU may not be in court is in the public domain and any juristic conscience will decide otherwise. #MYHUMBLESUBMISSION#@IKERIOKEYJUSTICE# |
