No employee work for 40 years in Nigerian government working sector. Few private sector comply to tax deduction of their employees. Do you expect a private employer paying meager to also deduct tax from the meager amount?

That doesn't mean? If you've worked elsewhere, it means your termination or retirement will come by age, meaning you will not work up to 35 years again. Retirement comes either by age (60) or active service (35). Your thinking have been taken care by PUBLIC SERVICE RULE. No one works more than 35 years in government working sector.

If you start working at the age of 18 years, your retirement age will be (18+35 = 53). You will retire at the age of 53 instead of 60.
I know you've not laid your hand on Public Service Rule that's why you don't know rules in retirement and termination of appointment of workers both as a civil servant and public servant.

You know my father more than me?. in fact longer than 40 years. You are the one who needs to educate yourself, my father was not a pure civil servant in the ministry sense you know though technically he was a government worker and therefore a civil servant. Educate yourself. Maybe the rules have changed since but my father and hundreds of his colleagues worked for the govt for over 40 years. It is for you to work out which section of govt workers have/had this longevity of service.

educate yourself, I am not going to make it easy for you by telling you what type of govt worker he was but in total he worked for the govt for 46 years of which he was on leave of absense/study leave for 5...I just called him to confirm Go and do your research, i told you he was a govt employee but not a "ministry" worker.

I am not arguing with a man who says he knows my father more than me

And he is currently receiving his pension

It seems you don't know what you're saying. A man retired after spending 35 years in a certain job will now go hunting for another. Do you know what that man's age will be? A man of over 50 years averagely will go fishing for another job when he'll be thinking on how to carter for children and not be other the apron spring of one employer. It means such man doesn't plan well for his retirement. Every sane employee will prefer to be an employer of labour than be employee after 35 years active service.
If this is the mentality you've been carrying to retire and still scouting for job after 35, then you need to redirect your prayer line. Every retiree always prefer contract job than having permanent job after retirement.

You're just confusing yourself the more. There is a clear difference between individual and government worker consistently paying taxes. Government Workers have a maximum window period of 35 years (google is our friend) while individual have unlimited years. No single government workers can consistently pay tax for 40 years except he/she cheated government by not retiring at appropriate time. There are Public Service Rule and it is explicitly stated 35 years active service and 60 years age limit.

Do you think it is so easy to be an employer of labour after working for so long? undecided Many of you chaps have a warped view of entrepreneurship, as well as what it takes to become successful in the private sector.

How many govt workers retired in the past, but were not paid their gratuities or pensions, as and when due? How many pensioners till today are still complaining of non-payment of pensions? So which money will they use to set up a business, or become the employer of labour you so glibly talked about? shocked

Not true. Retirement age is 70 for professorial cadre in public universities same for justices of the Supreme Court. Non teaching staff of universities retirement age is 65 courtesy SSANU/FGN 2009 agreement.

After 35 years they keep on getting paid in what is called pensions and every money paid to you by the government is taxed.

Why mingling preferential treatment given to university dons with what is applicable and written boldly in Public Service Rule. I am quite aware of the advantage given to the university professors on their age limit but here where talking of civil service as claimed by many commentators here that they pay tax for over 40 years. I know many of them may not even know such rule exist and thinking workers can work perpetually, not minding there are rules that guide their stay in service.

STATUTORY CORPORATIONS PENSIONABLE OFFICERS (RETIRING AGE LIMIT) ACT

An Act to provide for the retiring age of officers of statutory corporations subject to extension from year to year by the relevant authority.

[24th May, 19727] [Commencement.]

1. Age limit for all statutory corporations pensionable officers, etc.

(1) The retiring age limit for all pensionable officers of statutory corporations shall be sixty years.

(2) It shall be lawful for any relevant authority by an instrument or in the manner prescribed (by the rules of any statutory corporation relating to the conditions of service of its staff) to require any pensionable officer of such corporation under its authority, or in relation to which it is empowered to deal with matters concerning the conditions of service of the staff of such corporation, to retire from the service of the corporation on his attainment of the age of 55 years.

(3) It is hereby declared that if before the commencement of this Act a pensionable officer of a statutory corporation was retired compulsorily on his attainment of the age of 55 years and before his attainment of the age of sixty years without any grounds being specified for the retirement, the officer shall not be deemed to have retired from the service of the corporation nor be treated as having been retired in consequence of the abolition of his office, but shall instead be deemed to have retired from the service of the corporation at the age of sixty years; and accordingly, he shall be entitled to a grant of pension, gratuity, compensation, allowance or other superannuation benefit which shall be determined and calculated in accordance with the scheme provided by the corporation for such grant.

(4) The foregoing provisions of this section shall have effect notwithstanding anything whatsoever to the contrary, particularly anything to the contrary in any enactment, law, regulation, rule, bye-law, order or any other instrument prescribed in relation to the conditions of service of the staff of such corporation or otherwise provided for, and such enactment, law or instrument shall be construed subject as provided under this Act with any necessary modifications.

2. Power to extend services from year to year

(1) Where the officer has attained the retiring age limit or immediately before his attainment of that age; on being satisfied-

(a) that the services of the officer are required by the statutory corporation after that age; and

(b) that the officer is certified by a medical officer approved by the relevant authority to be physically fit for the purposes of his duties, the relevant authority may elect to continue or extend the services of the said officer thereafter from year to year or for such period or periods as it deems fit but not beyond the age of sixty years, and subject to such conditions as the relevant authority may at its discretion impose.

(2) The statutory corporation may, subject to the provisions of this Act, by regulations, bye-laws, orders or other subsidiary instruments, make provisions for the conditions under which the services of pensionable officers may, subject to the foregoing provisions of this Act, be extended or continued beyond the retiring age limit.

3. Interpretation

In this Act, unless the context otherwise requires-

"statutory corporation" means a corporation established by or under any enactment;

"pensionable officer" means any person employed as a member of the staff of a statutory corporation who under the conditions of service of the corporation or within the terms of his employment is entitled to a grant of pensions, gratuities, compensation, allowances, or other superannuation benefits by virtue of his employment; and

"relevant authority" means the board or authority of the statutory corporation (howsoever named) empowered under any enactment or law or as the case may be, authorized in that behalf to deal with matters concerning the conditions of service of the staff of the corporation.

4. Application


This Act-

(a) applies to all pensionable officers of a statutory corporation whether or not such officer was employed by the corporation by or under any contract, agreement or arrangement or under any instrument whatsoever, and anything under the terms of employment of the officer inconsistent with the provisions of this Act, shall to the extent of the inconsistency be void and of no effect;

(b) applies to all persons who qualify for or become pensionable officers in the employment of any statutory corporation before, on or after the commencement of this Act;

(c) extends to any corporate body established under the Companies and Allied Matters Act which is owned or partially owned by the Government of the Federation or of a State in the Federation, or as respects which the Government of the Federation or of such State owns any shares, stocks or debentures;

(d) shall not be so construed as to affect any action or proceedings begun, instituted or pending before a court of law at the commencement of this Act; and any action or proceedings begun or instituted after that date shall, accordingly, abate.

5. Short title

This Act may be cited as the Statutory Corporations Pensionable Officer (Retiring Age Limit) Act"

Who told you pension is taxed? Did you do Economics in school? Pension is non-taxable income Mr. Man. Anybody taxing pension as engage in double taxation because originally the source of the pension has been taxed. Try and read about non-taxable income. Not all income is taxable.

Are all Nigerian employee working in the Public Service?


Even after retirement some of them is get employment at other places to sustain themselves.

Most retired Military personal are currently working for private Security firms all over the country.


Next time don't just jump-in and defend the your government without properly reasoning.
