This is what people are missing about New York POE and the asylum seeker going to Canada.
New York is quite close to the border of Canada and most Nigerian prefer using New York as their POE because the ticket is generally cheap but unfortunately most Nigerians trying to cross the border into Canada came into U.S through New York so most time if you fill Texas in your form and you entered through New York you will be flagged which means intense scrutiny at JFK POE or your visa will be revoked before you leave Nigeria.
As for those seeking asylum some of them are already resident in U.S maybe for 1 month to 2yrs or more. Most of them decided to move to Canada because of President Trump immigration policy.
My final advice is that don't be caught in the cross fire. Fly to the nearest international airport to your destination and be armed with everything you will need to defend yourself.

@ Bolded.
This is inaccurate. There is no law that says your POE has to be close/your final destination. If going to Texas, you can enter through any POE. If they stop you, it is because of several other reasons or factors and has nothing to do with you entering through New York or any other POE.

Less than a month is fine, even if you arrive a day before your visa expires, its still valid. the duration you are stamped in covers you.

If you arrive a day before your visa expires, you will be sent back. I think the requirement is that your duration of stay does not exceed your visa expiration. Of course you can then delay your travel once you've been admited in. The point is that they will only allow you in if you are staying for "one" day if your visa expires in one day and this is unlikely. The POE officer won't stamp you in for anything over one day. If your visa is close to expiring, renew it before traveling.

This your post is what is actually inaccurate instead of the one you said was inaccurate above.... A day to visa expiry doesn't have relationship with all you have stated with the US, Nairaland is replete with such occurrences and some of us have either experienced it or know those who have. Get to POE a day after visa issuance or a day to expiry, your entry to the US depends on the CBP Officer you meet. A US B1/B2 visa only grants you access to knock at the door of the POE!

Also, what Seye is saying above is just based on today's trend, especially because of Nigerian Canada Asylum seekers, he knows much about all you stated. The stakes are higher and if you don't choose wisely the door to knock on as a first timer, you may just be in for a shocker.... Dazzol!

Sorry to say this, you are not entirely right also, cos i have a friend that traveled 1month to the expiry of his B1/B2 Visa and was still stamped in for 6months.

Someone on the last page said she was stamped for the duration of her visa which was less than 6months.

So i believe it depends on the CBP Officer you approach. i also know someone that was stamped for 14days. maybe cos he said he was staying just 7 days.

So if anyone has an unadultrated story at the POE, He/She wouldn't have any problems with CBP. like the person planning to spend 4-5months on vacation might claim she wants to stay just 2weeks and gets 30days stamped in unluckily. but these are rare ocassions. the big Bosses here knows better.

Before this Canada wahala you can enter through any POE but nowadays especially for families traveling together you can have to think it through before entering through JFK especially if your final destination on ds160 is very far from New York i.e. Florida,Texas,California,Oregon,Arizona etc not that I'm trying to frightening people or travelers but nowadays more than 5 passengers have contacted me after they were deported from JFK and the question asked was "why are you passing through New York" it's important to be equiped maybe have an onward domestic ticket at hand and also hotel reservation or address and phone number of the person you're visiting.
Lastly preparation is key and reduce unnecessary talk on social media about traveling to U.S or using U.S as a route to connect to Canada.
May God help us.

Don't see why yours should be a cause for worry sha. Your previous US travels coupled with the JFK-MCO leg should arrest any unwarranted situation. Has your family never been to the US before? Seeing Delta LOS-JFK; on a code share (via CDG or AMS) or via ATL or how? Good morning....

Oh, okay. Upgraded knowledge now. Genuinely didn't know Delta flies directly from Lagos to New York. The way I previously knew it experientially was that their planes from Lagos will fly directly into ATL first before you connect to wherever else you are going or you fly Air France/KLM to CDG/AMS first before continuing to JFK with any of DL/AF/KL.... Seems that's old school knowledge now!

I asked if your family has previously been to the US but not through JFK like you or is this their first time in the US? Either ways, your onward ticket on the same itinerary from JFK-MCO should be your strength in addition to your personal previous travels and use of JFK. Enjoy....

One is not granted a length of stay beyond the validity period stated on the Passport Data Page. However one can be granted a length of stay beyond the Visa Validity. People tend to confuse the two.

This is what is applicable for the two year visit visa granted to Nigerians. It might be slightly different with other countries.

I find it difficult to believe a CBP officer would grant a length of stay beyond the validity period stated on the Visa Page. If he or she did, then it must be in error.

Note this is what is applicable for the two year visit visa granted to Nigerians. It might be slightly different with other countries.

Oga, did you care to even open and read the link supplied by the other poster after my post? Please do before you start quoting people unnecessarily, please....

I remember one overzealous immigration officer attempting to behave this way while I was on transit the time I personally did engage in the topic at hand, I only told him to worry less and let the US CBP Officers at my designated US POE use my return ticket to take me back home to Naija if need be. I don't think I have ever had the opportunity to chat and laugh with a CBP officer like I did on that trip when I finally got to the US and was allowed in! From our discussion he said he appreciates when he meets with one knowledgeable in these things. Just so you know, I had just a few hours left on that visa and was stamped in for 6 months still.

You have no problem especially if this is not your first time and the delta flight ticket final destination is MCO so I can assume you're leaving for MCO from JFK.

Yeah, I read it here now, and a quick google search confirmed same with links from Delta news and Vanguard. I have even seen the three times a week schedule, flight departs both cities at Night, only Saturday is activity-free.... Good one there, I have once had to fly pass JFK to ATL (my POE) on Delta and reconnect back to JFK a couple of years ago.

Painful when you see New York on the IFE.... I like Delta for sticking with Nigeria when every other airline decided to run.... it's well deserved even though it's expensive.

Good morning to everybody here and thank you for your meaningful contributions. My question is I am due to visit New jersey next month for vacation. Is it advisable that I book my flight to JFK (cheaper flight options) or I should book to the airport nearer to New jersey (Newark, EWR). Which Airline is best advisable I used Inorder to avoid been affected by this present trending Canada asylum through JFK.
***Please note that I am travelling with my wife who has visited New York via JFK about 4years ago.

JFK should be good as long as you don't have plans of any movement towards Canada-US border particularly cheesy and anything to hide generally, you should be fine....

Obviously entry is entirely dependent on the POE officer. If you know of anyone on a tourist visa with one day expiry that was allowed in please share. Some airlines may not even allow you board because if there are any delays, your visa may actually expire before you reach the US.
Let me explain better. If you travel to the US with a day expiry on your visa, what do you think it tells the POE officer? It probably lets him know you are desperate and have immigrant intent. If not, why didn't you renew it before travelling? These are the kind of questions that make it unlikely that you would be allowed in.

Please note that i specifically addressed the one day expiry. If you have one month left and your duration of stay is less than one month, there is no problem with that and the POE officer "may" allow you in. The big question is why risk it when you can simply renew the visa?
