ExxonMobil said a blockade by former employees threatens crude production at oil facilities in Nigeria, adding that “disruptions to these operations have the potential to significantly impact revenues.”

The company made the announcement in a statement after a six-week blockade by former workers at the oil facilities.


Mobil Producing Nigeria, the ExxonMobil subsidiary that released the statement, produces over 550,000 barrels per day of crude oil, condensates and natural gas liquids, according to the company website.
Nigeria’s average production in the second quarter of 2018 was 1.8 million barrels per day, according to the country’s statistics office.

The blockades were described in ExxonMobil’s statement as the “playing of loud music, defacing of company facilities and intimidation of personnel.”

The “continued denial of access to lproduction facilities could impact the company’s ability to safely continue production operations,” ExxonMobil said.

The protest which began on 17 July was over the sacking of 860 Nigerian workers most of whom had worked with the company for over 22 years without regards for the rule of law.

Mr Rasak Obe, the Chairman of ExxonMobil Branch of the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN), said the union was shocked by the mass sack of security personnel who had faithfully served the company for many years.

He said the management should immediately reinstate the employees of the security department and pay all entitlements due to them.

The union leader also urged the management to immediately reinstate the 16 employees purportedly sacked in Dec. 2016 in a similar fashion.

He demanded the immediate release and repatriation of over 20 expatriate personnel in the security department who had been engaged and kept in defiance of extant Nigerian laws and security directives.

According to him, this was an unfortunate situation which the Supreme Court of Nigeria had corrected with its April 20, 2018 judgment.

“This underscored the scale of error in company’s assessment of the reality after the Supreme Court judgment.

“There are tens more who by the judgment are active employees of Mobil Producing Nigeria Unlimited.

“To say the least, this wholesale sack unambiguously conveys management’s disdain for the highest court of the country and mocks its ruling on the subject”.

Obe said the company was quick to indiscriminately sack Nigerians and replace them with expatriates, taking jobs Nigerians have successfully performed over the decades.

He said expatriate security personnel, many of whom were ex-service men, were currently engaged in the security department against the directives of National Petroleum Investment Management Services (NAPIMS) and the Nigerian Defence Ministry.

We shall survive. We should just speed up developing other sectors too. And that Ajaokuta steel is one thing this administration should make operational as fast as possible. This will reduce the pressure on our oil and gas sector.

They should stop crying foul and obey the Supreme Court order and give the workers they sacked after the court order a fair severance package. Can they try this in US or other sane countries?


They are trying to whip up sentiments and make the federal government react instead. That is not going to end up well in the Niger Delta generally.

Akwa Ibom is he most peaceful state in the Niger Delta, Exxon Mobil should livery court order and keep it so.

It's painful that nobody group or human right lawyer is fighting for the former workers of exxonmobil. I see these people everyday at their gates with banners tied to Exxon Mobil gates. It's not like the company doesn't have the money. They have just refused to pay them because they believe nothing will happen. We have some Nigerians working as top management staff and they too have kept mute. The annoying thing is you see the same set of evil people in church every Sunday deceiving themselves. They can have fear of their pastor to pay tithes but won't pay people's entitlement. You can pay tithe to God that you cannot see but refuse to treat a fellow human you can see right. Meanwhile God wants us to love our neighbours, if we can't do that, how then can we love or please God.

Bastards! Re-instate the sacked workers and pay them their money. This kind of nonsense did not happen during Abacha's regime. It did not happen in Ghaddafi's Libya. No wonder they tagged Abacha "corrupt" and since 1996, his imaginary loots are still being recovered. This white bastards would encourage people like Emefiele, Ngozi et al to pass and enforce policies that will favor them at the detriment of Nigerians and in return, they give them honors and awards and we praise them for being "internationally recognized". When this same eediots where mounting pressure on the Presidency to devalue the Naira, some of you were telling Buhari to obey Ngozi, a supposed "Harvard product". The devaluation of the Naira caused economic instabilities and you all were blaming the Presidency while Ngozi was getting more awards from her white masters. Wake up people!

What ExxonMobil did is a shame to the oil industry. The so called industry that shouts standards, standards can do this inhuman thing to people and think they will go unnoticed. The Government should revoke their license. They can never try this with Putin. Check youtube of how Putin deals with corrupt oil companies.

After taking our oil, you still want to impoverish our people. No way! Ko jo. On our own land, in our own country. Exxonmobil should be shut down forever to serve as a lesson to those corrupt oil companies

Most oil companies in Nigeria if not all are guilty of maltreating Nigerian workers. Our leaders and laws are weak, giving these greedy businessmen leverage to exploit us. They partner with our brothers who are obviously against the progress of their countrymen. Even when the whites propose staffing for contract staff, our black brothers will advise otherwise so that only them will be rich. They feel more accomplished seeing poor people around them.
The Petroleum Industry Bill (PIB) has been killed and buried by these animals in human skin.
I stand in solidarity with the striking personnel and pray that they continue to speak with one voice until they are settled.

Barrister Femi Falana SAN is their lawyer. He stood and fought for them up until the supreme court and won the case pro bono. It's now left for ExxonMobil to fulfill their part of the ruling, they had the option of settling out of court before going to the supreme court but they insisted on going to the supreme court and there they lost and they'd have to pay more this time. I'm just surprised why the government is not bending them to obey the final court order.

LET THE TRUTH BE KNOWN IN EXXONMOBIL AND THE WORLD AT LARGE
 
We, the Security Staff of ExxonMobil wish to write and inform your esteemed office the cause of the current picketing at various ExxonMobil locations in Nigeria.
 
This is an all-time truth which the blacks (Nigerians) who were in the helm of affairs in the time past and those present today had hidden from the company for many years.
 
We hope you peruse it and thus make an informed decision therewith as elucidated and enumerated below:
 
1) At various times Mobil Producing Nigeria Unlimited (MPNU) advertised employment opportunities for Security Guards for its operations at Lagos, BRT/PH & QIT locations....There is evidence to that effect.
 
2) We applied for those jobs in response to the advertisements...There are evidences.
 
3) Mobil conducted several recruitment procedures on us, e.g. credentials checks, physical checks, aptitude test, qualifying examination test in Mobil House(level 2), etc. These were also carried out in various locations - Eket/QIT, BRT/PH...There are evidences to prove these.
 
4) In all these processes, there was no 'Third Party' interference. These exercises were done by Mobil solely, directly, and perfectly, though before the merger with Exxon.
 
5) After the successful recruitments by Mobil we were shortlisted and sent documents for confirmation.
 
6) We were equally offered Mobil's ID, Mobil's Medical Certificate, employment letters, security accoutrements, uniforms, etc which represented the image of Mobil. We also had undergone several trainings sponsored and monitored by Mobil.
 
7) After some years, we were directed by Mobil to proceed to Nigeria's Police Colleges/Training School for 'Basic Guards Training', these was done at various times, directly and independently funded by Mobil....There are evidences to prove it!
 
cool The trainings often lasted for about 3-4 months. We returned back to Mobil. At that instance, Mobil gave us Nigeria's Police uniforms and tagged us SPY Police.
 
9) Therefore, having worked for Mobil directly and independently for many years as the ascribed SPY, we were expressly instructed by Mobil that henceforth our 'New Employer' is the Nigeria Police Force (NPF). We were issued document titled "Status Agreement Form." Spy had no knowledge of such agreement, nor partook in such obnoxious undertaken....We evidence to show for this document!
 
10) This was the last straw that broke the camel's back!
 
11) There are Constitutional provisions and Laws for employment into NPF.
 
12) It is unlawful and an aberration for Mobil to recruit personnel's into the NPF....This is unheard of!
 
13) The salient question to ask is this...Is Mobil a recruitment firm for the Nigeria Police or an oil production company?
 
14) What Mobil sought doing was to deny us their lawful responsibilities over us!
 
15) Which the NPF has refused repeatedly too.
 
16) As a law abiding and responsible 'Security Work Force' given the punishment and sack threats meted against us by Mobil if any one fails or refused to sign and accept that compulsory 'Ownership' we sought for the court protection, rather than resort to violence or self help which is typical in Niger Delta area, where Mobil operates. We were like reasonable children who sought to know their true father!!
 
17) In year 2003, in line with due diligence, we approached the Public Complaint Commission, Uyo, for peaceful resolution of the matter. All these documents and items, as aforementioned, that were willingly and directly given to us by Mobil as staff of this organization were tendered and admitted as exhibits. The Commission enjoined Mobil to absorb us as staff and reinstate those SPY sacked by Mobil, but Mobil refused to do the needful.
 
18) At the Federal High Court, Uyo, Akwa Ibom State, the trial started 1st March, 2004 (FHC/UY/CS/568/04) and ended January 24, 2006; the judgment given was inferred a partial judgment on both sides because some reliefs were granted to Mobil while others were given to SPY. There was no clear-cut winner in that ruling.
 
19) SPY sought a proper understanding of that Judgment; hence we proceeded to the Appeal Court which was held in Calabar, Cross Rivers State for further determination which started February 26, 2006 (CA/C/47/2006).
 
20) The indefatigable human rights activist, Femi Falana (SAN), was contacted for this right abuse(s).
 
21) Having expended over 4years in the Court, judgment was delivered in favour of the SPY on May 21, 2009. The Appeal Court set aside the judgment of the Federal High Court which was held in Uyo. The Court expressly directed Mobil to accept us as their employed staff (as was in the beginning) given the preponderance of evidence in our favor and disposal.....This was an irrefutable and flawless judgment.
 
22) Mobil wasn't satisfied with that judgment; hence the company proceeded to the Apex Court of Nigeria - Supreme Court (SC 33/2010).
 
23) The appeal by Mobil to the Supreme Court started May 26, 2010 and ended April, 20 2018 after over 8years in the Court. In a unanimous judgment of 5 justices, the judgment of the Court of Appeal was upheld in favor of the SPY. The Supreme Court expressly states that "it was illegal and without legal backing for Mobil to have employed the Nigerians and sought to offload them to the Nigeria Police through the back door." The Apex Court also ordered Mobil to pay us all outstanding allowances and salaries from the date we were employed. Supreme Court also states "this appeal (by Mobil) lacks merit and it is hereby dismissed."
 
24) Again, in the Supreme Court we got a resounding victory. This judgment was flawless and perfect by any standard (to weigh with); such judgment will serves as 'court precedent' on matters that relates to labor disputation in Nigeria forever.
 
25) After the judgment, we maintained the status quo and were performing our respective duties without any flaw, waiting patiently for the implementation of the judgment by Mobil.
 
26) Almost 3 months had elapsed after the judgment; no word was heard from Mobil.
 
27) However, on July, 13 2018, we were instructed by Mobil to proceed to VCP - Victoria Crown Plaza Hotel, Victoria Island (completely outside Mobil premises) for a meeting with the company's representative. Humbly, we went there and were addressed by one Mr. Kayode Ashoga of ExxonMobil HR Department. He told us to be on the lookout for messages from Mobil to be sent to our respective emails and home addresses. Earlier on a document titled 'ExxonMobil Employee Data Update Form' was given to us by Mobil and submitted back.
 
28) At the end of the meeting which lasted less than 5mins, we proceeded back to our various places of work only to be locked out by Mobil. As at the time of this report, we are still locked outside and our personal effects still inside most offices and various locations/beats. This happened in Lagos!
 
29) Ironically, similar meetings were simultaneously held in other locations, QIT/Eket, BRT/PH and Abuja. In all, over 507 ExxonMobil guards (former SPY) were locked out clandestinely same time, same day, and denied access to our belongings - books and accessories, clothing's and priced possessions.
 
30) Oddly enough, in one full sweep, in a particular day and time, ExxonMobil Nigeria sacked over 507 security staff unlawfully rather than obey and comply with the judgment of the Supreme Court.
 
31) Base on this illegality, we hereby state emphatically that we were duly employed by Mobil, duly affirmed and recognized by the highest Court in Nigeria. This is indeed epoch making for a foreign oil firm (ExxonMobil) operating in Nigeria to abruptly dishonor Nigeria's most revered Court. Can such happen in America?
 
32) It is a known fact that we - The Security Workforce have been peaceful and law abiding since the suit was instituted over 18years ago.
 
33) It is appalling to state that in spite of the harsh, crude and inhuman treatments meted against us for several years, yet Mobil still threw us out like a common criminal and sacked us for no justifiable reason(s) in spite of the good status we have maintained in the company.
 
34) Sadly, for the record, over 171 security guards had died in course of pursuing and seeking for justice due to severe maltreatment by Mobil.
 
35) It is equally instructive to note that about 830 security guards in various locations started this cause and now only 507 remains.
 
36) Mobil calling for such meetings was shredded in deception.
 
37) Deception is obviously a crime and actionable!
 
38) This was what prompted the protest at the first instance, since 13 July, 2018. Those of us still in active service and arbitrarily sacked by Mobil; and those whom Mobil retired for one reason or the other; as well as those who died, have all suffered irreparable damages in the course of working for Mobil - a company that tagged itself "Mobil Cares!"
 
39) These wrongful acts of Mobil clearly negates equity, justice, natural law and good conscience in all ramifications. For many years we worked for this company, yet the company withheld and refused to give us the mandatory condition of service given to other departmental staff.
 
40) The following are some injuries meted on us by Mobil: gross human rights abuses, unfairness, arbitrariness (laid off, suspension and indefinite suspension from work, sack, etc), exploitation, poor remuneration, casualization, force labor, unsafe working environment, lack of medical care, unlawful sack of over 507 security staff in a single day, deprivation, slavery, outright disobedience to Nigeria's Supreme Court Judgment by ExxonMobil, amongst others.
 
41) All these atrocities necessitated this protest against Mobil - a company that has maltreated and inflicted untold hardship on us. Sir, please weigh and opine if such 'Corporate Misconducts' is permissible in your home Country?
 
42) Since it is impossible that a company cannot disobeyed the ruling of a magistrate court in your Country, why has ExxonMobil disobeyed and refused to execute Nigeria's Supreme Court judgment? Instead, the company resorted to an arbitrarily sack of over 507 security staff of the company without recourse to the rule of law and justice. In spite of the subsisting Supreme Court judgment served against it in favor of the security workers. 
 
43) As a result of these illegalities and rights abuses, we embarked on this protest against Mobil for over 6 weeks running now, yet Mobil has refused to do the needful.
 
44) We have been outside since then, day and night, seeking (peacefully) for our lawful rights which are normal under the sun created by God Almighty.
 
45) On August 20, 2018 in defiance of Supreme Court judgment, Mobil approached the Industrial Court holding in Ikoyi, Lagos seeking the court's injunction to stop and remove us from further picketing in their premises. The Court lawfully and smartly rejected the cynical motion of Mobil on the ground that it is lawful to embark on such. Instead of Mobil to comply with the Supreme Court judgment, the company is looking for 'cheap ways and means' to evade the execution of the judgment of the apex court.
 
46) The question to ask this: Can the Industrial Court Superintends the Judgment of the Supreme Court? These inconsistencies by Mobil thus worsen and heighten the situation on ground!
 
47) It is evidently cleared that the so-called intervention by Inoyo Udom and Sadiq Adamu (HR and Legal Director respectively) hasn't yielded any fruit after over 6 weeks of back and forth rendezvous thus wasting company's time and resources, as well as ours!
 
48) The duo deceived Mobil insisting that the matter is that of 'local content' hence they are capable to handle such. What a faulty advice and lie as usual!
 
49) We make bold to lecture them that collective bargaining and crisis management requires expertise, and not ethnic rendezvous.
 
50) We want right thinking individuals (Nigerians), the Expatriate Community working in Nigeria, your humble self, and the World at large to know about our plights and our LAWFUL RIGHTS by this write up.
 
51) These 'Facts and Truth' as enunciated are irrefutable, indisputable and undeniable and it cannot be hidden from ExxonMobil - a Company we have labored and sacrificed so much for many years.

52) For the record, it is worth stating that we had several meetings with the Honorable Minister of Labor, Employments and Productivity, Dr. Chris Ngige, at Abuja; the climax of such was on Wednesday, 28 August, 2018. 

53) Our representatives, Mobil Management, Pengassan representatives were all there and the resolution arrived at by the Minister is nothing but an affront to justice and rule of law. Such cannot be binding on us because that truncates the sanctity of the judgment of the Supreme Court, and it is grossly inimical to equity, justice and fairness!

54) We all applied to work for Mobil Producing Nigeria Unlimited not the Ministry of Labor. Again, we were in several courts in Nigeria for over 18 year; Various Courts tagged it SPY Police Vs Mobil Producing Unlimited (MPNU) at no time has the Ministry of Labor or the Minister mentioned as a party to the suit. Therefore, the Minister and his Ministry cannot and should not self interpret the acclaimed judgment of the Apex Court of Nigeria wrongly. We unequivocally resent, reject, and distastes such maneuvering by the Minister.

55) We therefore urge the honorable Minister to keep aloof from these rights abuses by Mobil. 

56) ExxonMobil has a working document or template which places staff on grouping(s), hence it is wrong and immaterial for the Minister to place us (ExxonMobil Staff) on Civil Service rudiments based on the Minister's self perceived reason(s) or notion. 

57) For over 25 years we have been governed by ExxonMobil's rules, guidelines and policies, and not by the Civil Service Rule (CSR), importing the CSR to this matter is unacceptable by the workforce, and it is at variance with reasonability.

58) Our due entitlements is not a tea affair because this evolved round our lives, our family, our extended families, our future and our destiny! THIS IS NO CHILD PLAY!!

60) The threat by Mobil to forcefully stop us from continuing this lawful protest using MOPOL, Soldiers or any other means shall be resisted by us and the laws of the Federal Republic of Nigeria. The judgment of Nigeria’s Supreme Court cannot be jettisoned by an American company….This is not possible!
 
To this end, as a gallant workforce, we are fully aware that you have good knowledge of what has happened and what is ongoing in the company, yet you have not deemed it fit to 'Right these Wrongs' and put an end to these Human Rights Abuses/denials; and the delay tactics orchestrated by your subordinates

Matter of fact, we have deemed it fit to tell ALL concerned that - ExxonMobil (Nigeria) should be the held responsible for the consequences of their inconsistencies, corporate deception, lies, rascality, and abrupt disobedience to the Judgment of the Supreme Court.
 
Truly, we have always been open to dialogue since this suit was instituted and during this protest, but it has always been abused by Mobil.
 
Therefore, we resolved that 'Enough Is Enough' of this dawdling and we shall resist any of such henceforth. Thus, we shall take all reasonable and necessary measures to ensure that our undeniable rights, privileges and entitlements as staff, of this company gets to us as expected. We have worked and labored for it for many years we deserved our rewards.
 
In the same vein, we also intend to put record straight and inform All concerned that ‘No kobo’ has been given to us so far par the flavor of this judgment. This put to paid all deceitful newspaper publications and text messages sponsored and sent from MPN to us and the public.
 
We hereby request the immediate reinstatement of all the Security Staff; affirm our status as employees of ExxonMobil; recognized our rights and privileges as citizens of Nigeria; pay us our due entitlements in full (backlog inclusive) in line with ExxonMobil Policy, compensate us for the unjust and unlawful dismissal, and TOTALLY COMPLY with Nigeria’s Supreme Court judgment.

Nigeria Is Our Country and Our Cherished Constitution Bequeaths these on Us!   
 
Let this TRUTH BE KNOWN and GOD BE GLORIFIED!!

I always tell people to read and understand employment letters before you append your signature and take up the work.

These security (former) staff were employed as Contractors and were later converted as Main staff (i believe with word of mouth) without any change in their letters.

ExxonMobil is still maintaining they are contract staff. Well, there have been a legal battle for years on this and they finally won at the Supreme court.

ExxonMobil, very stingy since they took over Mobil, should pay them off asap

But if they won a case and the court has ruled that they pay the workers, why have they refused to pay and the useless government is quiet. The govt should force them to obey the court. Their management team should be arrested and forced to pay people what they have worked for.

I don't know why this govt is so useless. I am not so surprised...even Buhari doesn't obey the judiciary. Just so painful to see these people sitting at the gate of the company and being ignored by the evil exxon mobil. The same thing they won't do to their white employees.

Barrister Femi Falana SAN is their lawyer. He stood and fought for them up until the supreme court and won the case pro bono. It's now left for ExxonMobil to fulfill their part of the ruling, they had the option of settling out of court before going to the supreme court but they insisted on going to the supreme court and there they lost and they'd have to pay more this time. I'm just surprised why the government is not bending them to obey the final court order.

Thank you for the clarification...Our govt is just too useless. I don't know why they cannot arrest the management team of exon mobil and force them to pay the workers. They have the money but just refuse to pay. The useless govt only care about their pockets. If na to do ojoro impeachment for NAS, them go pack all the DSS and police go there...wicked leaders.

They're not ignored.
So far they're almost arriving at a conclusive agreement in terms of negotiations... Few people were selected amongst the aggrieved party alongside the union and lawyer to negotiate with the firm's representatives ..

All 860 workers can't be addressed at once for a benefiting negotiations... The remaining staffs at the gate are there to ensure that no one goes into the premises and no one goes out ...

Before you type what you do not know they were not contractors ... They were employed by the company as staffs and later pushed to NPF as if there were contractors that's where the issue started
