Ozekhome said this in an interview with the Newsmen in Abuja on Thursday.

Fayose, whose tenure as governor ended on Monday, had on Tuesday reported at EFCC office in Abuja to answer to some allegations levelled against while in office as governor.

Ozekhome said “Fayose’s lawyers are already taking steps to enforce his fundamental human rights by getting him released.


“Yes, his lawyers will go to court to enforce his fundamental human rights.

“The EFCC has no right to keep him for over 24 hours.

“If they have done that by obtaining a Magistrate Court’s Order that will be in the form of “holding charge” which has been declared unconstitutional and illegal by the Supreme Court.

“Holding charge is illegal. It is unconstitutional.’’


Ozekhome said that the section of the Administration of Criminal Justice Act (ACJA) permitting a magistrate to detain a suspect for 14 days was illegal.

According to him, any action outside the provisions of Section 35 of the Constitution which specifically provides for 24 hours, is illegal and unconstitutional.

He explained that the ACJA allowed for detention of a suspect for 14 days, but that Section 35 of the Constitution made it clear that a person could only be detained for 24 hours.

“So, when there is a clash between the statute, like the ACJA, and the Constitution, the Constitution prevails by virtue of Section 1(3).

“If they have gotten an order for two weeks from the magistrate court, it is unconstitutional,” Ozekhome stressed.

Recalls that Ozekhome was among Fayose’s supporters who accompanied him to the EFCC on Tuesday.

Double standard is when Obanikoro is released on the same offence Fayose is accused of simply because he’s now a saint and Fayose is locked up, Efcc activities is now being teleguided by the govt. Remember power is transient and position is transitory

EFCC can keep anyone guilty of looting public fund as long as criminal investigation is alive. Nigerians are suffering and dying everyday. This was how EFCC started by asking Olisa Metuh to return his money, he was forming bragado spurned on by lawyers like these who care only for their legal fees until such a time that the grace period expired and even when he begged to return the loot, the window had closed.
Since then he has been running from Pillar to post. Fayose's case is a very simple one, they have a key witness in Obanikoro who co operated after his own initial gra gra.

There are other key witnesses who are ready to testify but now is the grace period to release that election money. This is not even about his stewardship as governor yet, Fayemi will see to that later.

I suspect that Mrs Fayose will be seeing less of her husband in the coming months, EFCC will greatly inconvenience the guy, he go know.

I still can't forget how Metuh used to short, if you have any case against me, charge me to court. As soon as he was charged, he started by claiming the judge was his former classmate and so could not hear his case, now he only goes to court on stretcher, I am sure that is Fayose's aim since his gang have already started claiming EFCC want to poison him.

EFCC can’t determine guilt or innocence.

Only the courts have the power to do that, after a trial...and all citizens are presumed innocent until proven otherwise in a court of competent jurisdiction, even if they were caught in the very act with HD clear video evidence.

The guy might have committed a crime, due diligence requires that, he be taken to court to face justices. These are the types of unforced errors that make EFCC and government prosecutors loss cases on technical groups.

And people like Amaechi and Oshiomhole are moving around freely and you want me to believe they are fighting corruption? Tell that story to the uninformed. What is playing out is part of the antics of tyranny and dictatorship which has zero tolerance for critics. The harassment that the late Gani Fawehimi passed through for speaking out against past military governments comes to mind. Get me right. I am not saying Fayose should not be questioned about his actions and inactions while in office but I will appreciate it if all former governors are turned in like this. Not critics of the government.
