Sometimes I wonder how all these people that just talk anyhow without thinking . I wonder how their children feel when they see their stupid statements online .
Well, if your role model ,Fayose refuse to confess before 15 days . EFCC will obtain another one to detain him until he confess to his crimes and sign undertaking to return all th money he received from Dasuki . Or be charged to court and jailed .

Do you guys ever learn ? What he has said is that it is wrong to keep there for 14 days, or you don't want the Lawton be applied here, definitely he will go to court to challenge the that, you just come here looking for likes without thinking and understanding what you are writing and zombies will like it

The Constitution is constantly being AMENDED, from time to time, to reflect current reality.
That is the reason why we have "amendments" to Laws.

Human rights lawyer, Chief Mike Ozekhome (SAN), said efforts had begun to secure release of former Governor of Ekiti State, Mr Ayodele Fayose, from Economic and Financial Crimes Commission (EFCC) custody.

Ozekhome said this in an interview with the Newsmen in Abuja on Thursday.

Fayose, whose tenure as governor ended on Monday, had on Tuesday reported at EFCC office in Abuja to answer to some allegations levelled against while in office as governor.

Ozekhome said “Fayose’s lawyers are already taking steps to enforce his fundamental human rights by getting him released.


“Yes, his lawyers will go to court to enforce his fundamental human rights.

“The EFCC has no right to keep him for over 24 hours.

“If they have done that by obtaining a Magistrate Court’s Order that will be in the form of “holding charge” which has been declared unconstitutional and illegal by the Supreme Court.

“Holding charge is illegal. It is unconstitutional.’’


Ozekhome said that the section of the Administration of Criminal Justice Act (ACJA) permitting a magistrate to detain a suspect for 14 days was illegal.

According to him, any action outside the provisions of Section 35 of the Constitution which specifically provides for 24 hours, is illegal and unconstitutional.

He explained that the ACJA allowed for detention of a suspect for 14 days, but that Section 35 of the Constitution made it clear that a person could only be detained for 24 hours.

“So, when there is a clash between the statute, like the ACJA, and the Constitution, the Constitution prevails by virtue of Section 1(3).

“If they have gotten an order for two weeks from the magistrate court, it is unconstitutional,” Ozekhome stressed.

Recalls that Ozekhome was among Fayose’s supporters who accompanied him to the EFCC on Tuesday.

He had said that the present administration was governed by constitutionalism, and that it was a constitutional democracy.

When contacted for update of Fayose, especially on the detention, Head, Media and Publicity of EFCC, Mr Wilson Uwujaren, he simply said, “there is no update at the moment.”

EFCC can’t determine guilt or innocence.

Only the courts have the power to do that, after a trial...and all citizens are presumed innocent until proven otherwise in a court of competent jurisdiction, even if they were caught in the very act with HD clear video evidence.

The guy might have committed a crime, due diligence requires that, he be taken to court to face justices. These are the types of unforced errors that make EFCC and government prosecutors loss cases on technical groups.

It would have been needless for EFCC to exist provided our judiciary is efficient in the first instance. EFCC was commissioned to specially handle cases related to corruption, which is a top priority crime in nigeria. Countries like Malaysia, Mexico, Thailand, and indonesia have hard justice on drug related offenses, so why can't we fight corruption in similar manner by adopting the most radical stance on the perpetrators. Nigeria must generate global awareness that we are no longer a soft touch for corrupt minds, and perpetrators may risk maximum jail. Criminal investigation takes time, and organization like EFCC is expected to have standard facilities to detain suspects while investigation is ongoing. We have seen IG of police detained and serving prison sentence in this country, there are crime suspects detained in all our police stations during investigations,. Nobody is above the law is a fair and civilized society we claimed to have.
