The Nigerian Breweries Plc has said it has no plan to deprive the government of its revenue, the reason it has ensured compliance with all legitimate demands of the agencies which are in accordance with the rule of law.

The company made the comment in its response to the shutting down of its operations in Abuja and Lagos recently by the National Lottery Regulatory Commission (NLRC) over disputed fees.

In a statement, the firm responded to the commission’s action: “The NLRC last week temporarily shut down our operations in Abuja and our corporate head office in Iganmu, Lagos from the demand for payment of certain disputed fees which the commission is claiming from our company for our various consumer sales promotions.

“No court order was shown to us by the officials of the commission with regard to the shutting down of our company premises.“Prior to the above actions, the Nigeria Employers’ Consultative Association (NECA) on behalf of its member companies (including Nigerian Breweries Plc) had instituted an action at the Federal High Court (FHC) in Suit No: FHC/ABJ/CS/306/12 against the commission challenging its powers to regulate consumer sales promotions in the country moreso as they form part of the marketing and sales activities of the concerned companies.

“The matter is subsisting at the Court of Appeal in Suit No: CA/A/267/2016, the appeal having been brought at the instance of the commission. A cross-appeal was subsequently instituted by NECA against the decision of the FHC.

“As a law abiding corporate citizen, Nigerian Breweries Plc has always ensured that all our consumer sales promotions are vetted and approved by the Advertising Practitioners Council of Nigeria (APCON) and the National Agency for Food and Drug Administration and Control (NAFDAC).”

In the statement, the Head, Government Relations, Nigerian Breweries Plc, Vivian Ikem, said that since being established over 70 years ago, the company had remained one of the highest contributors to government revenue through taxes and levies paid to various levels.

“In 2017, we contributed by way of taxes and other levies, about N75 billion to the treasury at both the Federal and State levels.
“Our company has always ensured that it complies with all legitimate demands of government agencies which are in accordance with the rule of law and has never sought to or seek to deprive government of its legitimate revenue.Nigerian Breweries Plc is committed to winning with Nigeria and will continue to engage with all the appropriate stakeholders while seeking to protect and uphold its reputation as a good corporate citizen in the country.”

Why would a corporate organisation be expected to pay for sales promotions when it's not a lottery company?

This administration keeps making things difficult for Nigerians and corporate investors.

Multiple taxation, increased levels and duplication of duties by ministry and agencies just to shortchange corporate bodies.

At the end Nigerians and the economy will pay for it.

Most organization hide behind consumer sales promo to run a lottery. Questions to ask:
1. Is all participants a winner? (u will find out that one more persons will be selected through draw for a star price, may be a trip to Dubai n others...
2. How do people get into d promotion? (u will be asked to buy up-to a given quantity to qualify : ur meant to spend more than u bargain.
3. The idea is not to reward customers but to make high level sales within a short period.
4. I can go on...... Look for National lottery Act 2005.
Government defined lottery clearly, stating some element that will make an invent a lottery.
5. So if a law has been passed and u know this activity will fall into it, u either regularised with d government or stay off.

I don't think the number 2 is 100% correct, people are winning the lottery and getting paid but the burden of loss will fall on 90% of the partakers. Lotto has it's tricks. Then I wonder whether the Nigeria effect which is highly selective and not based upon merit is applying.

It's the same Omo-Onile mentality the APC brought into governance. It started in Lagos, now its nationwide. I toll you for using a road built with your own tax, I charge you stamp duty for receiving money in your own account, I charge you Land Use Charge of 40% percent of the value of your property, and I am still the one to value the property.
