Justice Sylvester Ngwuta, a Nigerian Supreme Court Judge on trial on charges of money laundering and passport fraud was freed on Friday by a Federal High Court sitting in Abuja.

Justice Ngwuta was among judicial officers whose houses were raided by operatives of Department of State Services in 2016.

He was subsequently arraigned in court on 13 counts charges of money laundering by the office of the Attorney General of the Federation.

Citing a previous ruling of Court of Appeal while dismissing the case, Justice John Tosho ruled that the pre-condition for instituting charges against a judicial officer were not met before Justice Ngwuta was brought to court.

The Lagos division of the court of appeal had in a ruling delivered on December 12, 2017 which was the ground for Justice Tosho’s Judgement, dismissed corruption charges instituted by the Economic and Financial Crimes Commission, EFCC against a serving judge on the basis that a serving judge could not be investigated or prosecuted without being first disciplined by the National Judicial Council.

Chief Kanu Agabi (SAN), who was Justice Ngwuta’s counsel argued that by virtue of the Court of Appeal's judgment, and the provision of section 158 subsection 1 and paragraph 21(cool of the third schedule of the constitution, the charges placed against his clients were incompetent.

He maintained that the complaints which formed the basis of the charges instituted against the Supreme Court judge should have been directed to the NJC which should have discipline Ngwuta, before the government can institute the charges.

people keep on defending these judicial officers just because they hate the present government. But we have seen from time memorial how judicial corruption wiped under the rug, why so? the rely on the provision of the constitution that matters relating to judges be first presented to the NJC, which for once never yield any results because it's just birds of the same feathers. Justice Ngwuta was cleared not because she was innocent but because NJC wasn't involved. The judiciary will keep on playing on US. Because they are partially immuned from prosecution. more over the CJN admitted to pergury, when he said he forgot to update his assets declaration form. Now if the Matter is still refered to the NJC of which he is still the chairman tell me how such an inquiry will turn out, where is the principle of "Nemo Judex en cau sa sua" "no one shall be a judge in his own cause"? For me the principle of checks and balances does not exsits in this country...

CJ admitted to perjury? I beg to differ.

while his excuse of forgetting to do the needful is not acceptable under law, "ignorantia legis neminem excusat", he did not lie.


if anyone has committed perjury, it is actually PMB who claimed in his affidavit submission to INEC that his academic records were with the 'Military Baord (Board)".

PMB is also guilty of false misrepresentation & impersonation since he bears 'Mohammadu' and claims he wrote his Cambridge as 'Mohammed'.

furthermore, within receiving a petition in less than a week, he is already been arraigned, but petitions against Amaechi, Aregbe, Oshio, BRF, Lawal & many others submitted years back are still pending with agencies that the presidency directly controls... what does that tell you?


before you give me labels, note this, I am 101% in support of the CJ being made to answer the allegations regardless of the circumstances surrounding it's exposure, but for Nigeria to move forward, fairness in prosecution of cases must be uniform, we cannot excuse some because they are our friends & kill others for even lesser offences...
