That man is the head of the judiciary, which is a third arm of government. If the head of any arm of government is found wanting, there are disciplinary structures, embedded within such systems so as to respect the dignity of such offices.

Any attempt to circumvent/bypass such system, using legal technicalities by people who are learned, ought to be looked upon with suspicion.

That's why most commentators make reference to Saraki, he is the head of the legislature, the second arm of government. If you dont want him, take advantage of systems within his own arm of government and rid yourself of him, but trying to use strong arm tactics to push him out sets a bad precedence.

Tomorrow what if PDP wins presidential election and the next Senate president is from APC, you have successfully set a bad example for them or any other government to follow.

A simple review of even President Buhari's asset declaration will butress my point. The three arms of government in Nigeria are equally corrupt. Their only motive is to enrich self. Sincerely, I don't care what happens to CJN because the common man don't have access to rule of law. The ruling elite of the three arms have conspire to put the average Nigerian in poverty. Is a pity that most youth in this country are confused. The immediate past president of South Korea was impeached and tried because of alleged corrupt practice. No body has the right to enrich self with our collective wealth. Bros even if a military personnel kills someone in or out of the line of duty, you dont charge to court him with his uniform for criminal cases.

You petition the military, they will review the case in line with extant laws - existing in military circles - and recommend the exoneration or dishonourable discharge (dishonourable discharge takes the uniform from the soldier) and handover to the Police for prosecution. That is the established practice to respect the dignity of the commission of a soldier, a commission that flows from the commander-in-chief of the arms forces that grants him a license to kill based on lawful orders from his superiors.



The same applies, tender your case before it (NJC), they will recommend exoneration or his immediate suspension/dismissal and subsequent prosecution based on existing law that guide their practice within the judiciary as an arm of government. It is the established practice.


Trying to arraign a sitting judge in court on criminal charges is just plain madness gone on rampage, if not that justice Danladi himself has proven to be an APC stooge, he should not even be in the mood to entertain trash without know what NJC has said.

Normally a normal productive human may likely increase in value, so as time progresses an annual review of your asset declaration is ideal. The provisions cover declaration before you occupy an office, thats all. That's why most public office holders do it once and use it consistently, just change the date and resubmit it for time sake.

Someone writes a petition concerning some assets not captured in his asset declaration, an executive that is balanced/stable and not vindictive will simply forward the petition via the NJC copying him, asking to update his asset declaration details (especially if your own asset declaration is like President Buhari's own that has not changed since 2003).

Then when he doesnt including those assets in contention, then you can seek his removal via the same NJC, because you will have established an attempt to hide some assets. Chikena

PREMIUM TIMES has obtained details of a statement given by the Chief Justice of Nigeria, Walter Onnoghen, to the Code of Conduct Bureau which is accusing him of false asset declaration.

In one note seen by this newspaper, Mr Onnoghen said he “forgot to update his asset declaration, after the expiration of his 2005 declaration”.

Mr Onnoghen also explained that he believed that the form SCN 000015 filed in December 2016 after he emerged acting CJN would cover for the period after his confirmation as CJN.

The case against Mr Onnoghen came after a group, the Anti-Corruption and Research Based Data Initiative, sent a petition against him alleging wrongdoing in his asset declaration.

The group said the CJN, Nigeria’s most senior judicial officer, maintained illegal accounts containing foreign currencies and did not declare them.

The group’s head, Denis Aghanya, is a member of the ruling All Progressives Congress and a former publicity secretary of the defunct Congress for Progressive Change.

The group said, its petition was brought “bearing in mind the imminence of the 2019 elections and the overwhelming role of the judiciary both before and after the election.”

A statement by the Code of Conduct Tribunal on Saturday, said Mr Onnoghen would be arraigned for alleged false asset charge on Monday — seven days after the petition was brought.

Some lawyers have alleged the trial is politically motivated.

Sebastian Hon, a senior advocate of Nigeria, told PREMIUM TIMES on Saturday it is “more political than it is honest”.




“While I know that the Chief Justice of Nigeria does not enjoy immunity from criminal prosecution, I see this move by the Federal Government as dangerously political and tendentious,” he said.

“Suddenly, we woke to see a petition leaked to the informal or social media, allegedly received by the Code of Conduct on 9th January, 2019. Suddenly, we are told charges have been filed against the CJN. Why this supersonic rush?”

In his response to the queries raised by the CCB, Mr Onnoghen wrote as follows:

“My asset declaration form numbers SCN 00014 and SCN 00005 were declared on the same day, 14/12/2016 because I forgot to make a declaration of my assets after the expiration of my 2005 declaration in 2009. Following my appointment as acting CJN in November, 2016, the need to declare my assets anew made me to realize the mistake.

“I then did the declaration to cover the period in default. I did not include my standard charted bank account in SCN 000014 because I believed they were not opened.

“I did not make a fresh declaration of asset after my substantive appointment as CJN because I was under the impression that my SCN 000015 was to cover that period of four years which includes my term as CJN,” Mr Onnoghen said in his statement dated January 11.

Mr Onnoghen was first appointed acting CJN on November 10, 2017 following the retirement of the former CJN, Mahmoud Mohammed.

His appointment as acting CJN came amidst criticism of President Muhammadu Buhari’s failure to forward his name to the Senate for confirmation as the most senior judge.

On February 8, 2017 Vice President Yemi Osinbajo returned Mr Onnoghen’s name for confirmation to the Senate on March 1.

Mr Onnoghen was subsequently sworn in to office as Nigeria’s 17th CJN on March 8, 2017.
