The Chairman, Presidential Advisory Committee Against Corruption, Prof. Itse Sagay (SAN), says the prosecution of the Chief Justice of Nigeria, Justice Walter Onnoghen, shows that no one is above the law.

Sagay told our correspondent during an interview that although the prosecution of the CJN was saddening, it showed that Nigeria was slowly becoming a nation of laws.


The Senior Advocate also referred to the arraignment of the President of the Nigerian Bar Association, Mr. Paul Usoro (SAN), which took place last year.

The PACAC chairman said, “It shows that in Nigeria, nobody is above the law.

“I do not rejoice, neither am I pleased that such high officials are being probed or investigated; but it shows that in Nigeria, the law is working and that the rule of law operates and that no one is higher than the law.


“That is the good aspect of it. Otherwise, I am not happy about it.

“But if the reason arises why they should be investigated or invited and they are invited, it shows that the Nigerian legal system is working and that the rule of law operates. But if it is you or I, you know that automatically, we will be indicted; but when the bigger guns in the country who have all the power are also being indicted, it means it is a good sign for the rule of law in Nigeria.”


When reminded of the fact that the CJN will be arraigned before Danladi Umar of the Code of Conduct Tribunal who has also been accused of corruption, Sagay said the Federal Government had no other option.

He said, “I see a point. It is a sad reflection on the state of corruption in Nigeria; but I think at the end of the day, everybody will come to justice and we will have a clean slate. This is the best we can do now.


“He (Umar) is the one on the seat, he has not been removed. So, there is no other choice as long as he is there.

“It is not perfect, but we must not miss the essential principle of this matter and that is that in Nigeria, the rule of law operates.”

It is a sad reflection on the state of corruption in Nigeria; but I think at the end of the day, everybody will come to justice and we will have a clean slate. This is the best we can do now.

Onnoghen’s arraignment was sequel to a petition filed by a civil society group, Anti-Corruption and Research Based Data Initiative (ARDI), accusing the CJN of false asset declaration and other sundry allegations.

He is also being accused of maintaining Domiciliary Accounts which comprised Dollar Account, Pound Sterling Account and Euro Account which were alleged to be contrary to relevant laws, especially for public office holders.

It was also learnt that the FG in addition plan to file a motion on notice praying the tribunal to order the CJN to vacate office and recuse himself from any aspect of the case as chairman of the National Judicial Council so as to prevent alleged interference in his arraignment and trial.

We hope that the right judgement be delivered at the end of it all.
A better Nigeria is all we want.

Hmmm... Honestly I am not happy at all that the whole CJN has to be arraigned just like that. But it is better to be on the side of the law even when it is not convenient.

Can some people also investigate other public figures whether they have disobeyed the same law. The fight against corruption must be total.

Ganduje is a governor enjoying immunity from prosecution. He can only be trialed after he leaves office as governor. See the case of fomer governor Fayose.

This case against Justice Onnoghen apears straightforward and he might be guilty as charged.

What has his Lordship been waiting for since, to correct the anomalies since he became the CJ even when the FG has been alleging that the Judiciary is aiding and abetting corruption

Forgetness/ignorance of law they say is not an excuse.

His Lordship should not step down. He should go the line of FG Vs Saraki. But his adversories will want Justice Ayodele Salami treatment under PDP.

The same dirty politics PDP used few years ago is being repeated by the ruling APC.

Politics (Nigerian) is indeed very dirty!

We knew how long the FG waited for Fayose before dragging him to EFCC after he was no more under immunity!
But wailers will always wail, its in their DNA!

Immunity has done more harm than good anyways, even if there are some few good things about is one good thing about it!
Immunity has just one positive thing to it as far as we know!

This Say at just chose the twilight of his life to rubbish the perceived image he had built for decades because of the useless Buhari , Nobody is above the law but where all here when Fulani killer herdsmen who have killed over 20 thousand people where raised above the law by this evil Buhari govt , we have seen Gandollar Ganduje being raised above the law, we have seen Buratai been raised above the law , we have seen the Cheif of staff to Buhari raised above the law he was accused of collecting over 500 million in bribes from MTN , we have seen Isa Funtua and his son inlaw rise above the law after using illegal and criminal means to acquire Keystone bank and Etisalat , we have seen Kami Adeosiun rise above the law after grand forgery and we have even seen the Dullard himself rise above the law after commiting many crimes against the law of this country ranging from forgery to perjury to outright disobedience of court orders .

CJN AND THE CASE OF A DESPERATE TYRANT

A petition was written against the Chief Justice of Nigeria (CJN), honourable Justice Walter Onnoghen on the 7th day of January 2019 by a former media Aide to President Muhammad Buhari, one Mr Dennis Aghanya who is also the former National publicity Secretary of Congress for Progressive Change (CPC), a party on which platform President Buhari contested the 2011 Presidential poll. The said Dennis is also the founder of a pro-Buhari group named The Buhari Organization (TBO). This petition was submitted to the Code of Conduct Bureau (CCB) two days after it was written which would be on 9th. On the same 9th, the Code of Conduct Bureau sent it to the Code of Conduct Tribunal which supposes that the CCB investigated the matter within few hours. On 10th, charges were filed against the CJN and he was served the following day being 11th with trial fixed the next working day being Monday the 14th of January 2019. Everything done within just one week.

With just 4 weeks to a make or mar general election widely expected to end at the Supreme Court headed by the same CJN and with the knowledge that there is a subsisting 2017 court pronouncement in Nganjiwa versus Federal Republic of Nigeria to the effect that a judicial officer cannot be prosecuted until such an officer has been investigated and found guilty by the National Judicial Council, President Buhari's action is nothing but an act of desperation which reveals so much about the psychology of the President and his handlers:

1)The President is not the invincible Strategist some mistake him for. He's but a desperate man living in perpetual fear. Perpetual fear of losing the election either at the polls or the Supreme Court where the case is expected to end up before the CJN. So it makes perfect sense hounding the CJN who is a southern Christian out of office knowing that next in line to the position of the CJN is a Northern Muslim. If I were a hopelessly desperate ethno-religious bigot afraid of having the Supreme Court upturn a victory I hope to secure through mindless rigging, I would behave exactly like President Buhari. But if I were a good Strategist, I would not do that because it will only end up winning more friends for the CJN and uniting the whole judiciary, legislature and those who ordinarily were not interested in the election against me. I will now be marked as a common existential threat who must be stopped at all cost. Indeed, the President and his handlers are not as sophisticated as we give them credit for.

2) Nigerians are being ruled by a bunch of political terrorists whose madness has no known method. They are willing and ready to do just about anything to win re-election. Burning down the whole country won't be a problem to them if only they could rule over the ashes.

3)Democracy, if not well guarded by men and women of conscience, can also be a victim of its own institutions. In a 2018 book by Harvard University political Scientists Steven Levitsky and Daniel Ziblatt titled HOW DEMOCRACIES DIE, They wrote:

"The tragic paradox of the electoral route to authoritarianism is that democracy’s assassins use the very institutions of democracy—gradually, subtly, and even legally—to kill it"

This is exactly what we've been witnessing under Buhari.

The daura ex soldier is not sure of victory in the 2019 poll. Not at the polls. And certainly not at the court. All these his antics are aimed at just one thing: He simply want us to think he has already won. That way, many people won't bother voting at all. With that, his plan to rig will be hitch-free and even the court will find it difficult upturning such fraudulent victory.

This is no longer a case of PDP versus APC. Thia is a case of Nigerians versus a dyed-in-the-wool Autocrat. Giving up is not an option. We owe it to ourselves to come out enmass and use our votes against this enemy of Democracy and leave cases of rigging to the judiciary to handle.

If we don't stop this man, he will stop us.

In all these, one truth stands out: No matter how powerful Tyrants think themselves, they always fall. The masses always win in the end.

This Sagay didn't allowed the same due process to take its course during the Kemi Adeosun NYSC certificate forgery scandal but defended the illegality till the very end.The hypocrisy of anything APC is so annoying.
