Ahead of NJC meeting tomorrow there are insinuations that acting CJN justice Tanko maybe suspended by the Council for offering himself to be sworn in as acting CJN but I want to submit that it is not going to happen.

The question to ask is whether he offered himself as justice Obisike did in Abia State?

He did not just offer himself, he offered himself based on a valid court order by the CCT which up on till now has not been vacated except it's vacated tonight Justice Tanko is going nowhere.

The NJC being a law abiding body will also take note of that in arriving at a decision tomorrow.

In the case of justice Obisike of Abia State as cited by Olisa Agbakoba, he drove to Govt House at the instance of the Governor to be sworn in just like that...

Secondly, the NJC has to look at that Oluwole Order whether it is genuine or otherwise.

Let me explain some things in lay man terms.

When you asked a lawyer to sue someone on your behalf, he files let us a say a process asking the court to help you recover money- this is called the Substantive suit.

Now while you are trying to recover the money, you heard that the person wants to sell all his properties. If he does that you won't be able to recover nothing. So your lawyer rushes to the Court to file what we call interlocutory application to stop him from selling his properties pending the determination of the substantive.

Now, you cannot have interlocutory if you don't have substantive. In this present case, the interlocutory was filed on January 9, 2019 while the substantive was filed on January 11, 2019. How is that possible? It is like you have a house and you are now putting a foundation on it.

Now to the Order, when a court gives an Order, it is usually like , Upon the motion on Notice/Ex Parte dated .... And upon hearing Ojike Ebere Esq (that is the lawyer that came to court to argue ) for the plaintiff, It is hereby Ordered....

Now the Order did not satisfy this rule.

Not only was he sworn in based on a valid court order, he is actually the second most senior. And in judiciary tradition, the second most senior takes over when the cjn is removed

Then go and challenge d order in court of appeal. But until that is done and the appellate overturns d order, it remains 100% valid! Tanko shall be sworn in as the next CJN before the year runs out!
