To Anser your question, Inec did not declare ihedioha winner in error with the following explanations.

1. He score the highest number of valid vote cast.

2. To ascertain if he score 25% of total valid vote cast in at least two third of the local government.

This calculation is applied:

Total valid vote = 686,037

One third of valid vote : 686,037÷3 = 228,679

Two third of the valid vote cast : 228,679 × 2 = 457,358

25% of total valid vote cast : 457,358 ÷ 100 x 25 = 114,339.5

Which 25% of 2/3 of local government valid vote is around 76,226


So pdp candidate score : 277,582 which is above 76,226

What sort of voodoo mathematics is this? The OP asked a valid question which I have been asking too; but apparently, people are becoming more sentimental than being objective. Personally, Rochas and co are a disgrace; but you cannot build legality on illegality. The constitution is clear, and Ihedioha did not get the required spread.

Most likely, Uche will get a court injunction to stop Ihedioha from getting sworn in and nobody sits at Douglas house until the case is resolved.

INEC had better include Imo in the rerun so APC do not take over administrative duties in the state during the trial/rerun period. No sane judge will overlook this rape on our constitution. Hilary Clinton got the highest number of votes in the last US election but Trump won more electoral college votes and the rest is history. Let us not set bad precedence because you don't know who will misuse it tomorrow.

This looks like the kind of defense pdp lawyers would present at the tribunal.even a kid knows how to calculate electoral percentage better than this.the constitution clearly mention in at least each which means we look at each local govt one by one in isolation to see what he got.it didnt say two third or 25% of total votes cast during the imo guber.we are to treat each lga separately.
Lets take ideato south for instance.total votes recorded for all parties is 50 000.ihedioha got 4000 which is below 25% which should be 12500.that is how it will be treated.

What about Peter Obi, how long did it take him to regain his mandate during his second term?

The court made him Governor after 3 years and within one year INEC conducted election and sent him out even when his tenure has not expired. He went to court just for interpretation of how long the tenure of an elected Governor is, which both of us know is 4 years.

But guess how long it took the court to do that? Find out yourself.

Before Tribunal will conclude them matter, Ihedioha has been made Governor.

Its the same thing i am saying.because of sll these lays,the electoral act was amended before 2015 to give tribunals maximum of 6 months to rule,appeal courts 3 months and supreme courts a month.but since its a matter of constiyutional interpretation,it will take lesser time,highest 3 months.ihedioha will be governor by then but he wont settle down much.being governor wont change much especially if nwosu gets federal might.
If i was nwosu,i will go to court to get an exparte motion stopping the swearing in of ihedioha or inec from giving him return certificate.rochas on the other hand can sue inec on using the state government which will directly involve the supreme court to get quicker justice.

No court has jurisdiction to entertain that matter at first instance.

You are not in tune with current realities.the ruling atiku got to inspect inec materials was from an exparte motion.the case nwosu has have never been tested before.its a constitutional breach which happened during elections or after elections.therefore it can be taken to a normal court.it can be argued as a civil case,you know our laws have many loopholes.
Its not the conventional rigging,electoral malpractice,violence and other cases associated with electoral petitions.it is purely to ascertain and interpret a part of the constitution which inec abused.it is straightforward.

You guys are just talking like kids.

A winner has been returned and no court has the jurisdiction to entertain that case at first instance. AA is calling for the interpretation of Chapter 6 while APGA is challenging the legality of the election itself. So Tribunal cannot entertain AA's prayer unless it has disposed of APGA's claim and before it will get Ihedioha would have been sworn in.

Even if Tribunal issue a injunction barring the Chief Judge of Imo from swearing-in Ihedioha, PDP will apply for stay of execution until Appeal Court determines if the Tribunal has the power to give such injunction.

By the time Appeal Court will hear the matter, Ihedioha would have been sworn-in.

Re-run might happen, but Ihedioha will be Governor when it happens.

You made a lot of valid points but tried to be partisan when muddling apga and aa together.apga and aa are different parties and will file it separately.but they can both join their suits concerning the 2/3 breach for faster delivery.i can confidently tell you that both parties will challenge the election on two separate suits based on the two third and based on electoral malpractices.even a kid knows that the court will first of all dispense with the 2/3 suit before the other.
The tribunal may delay but the higher courts wont.the summary is that the will be a rerun which can go either way.

You don't know political calculations.how will he sweep imo when apc came fourth during the polls? Why didnt he sweep the polls? The apc candidate only divided nwosu's votes which if added to nwosu would have made him governor.with him out,nwosu has the whole of orlu zone to himself.

Before nko, we expect them to file their suits separately and don't forget it is in the same Tribunal.

Before you can determine if 2/3 is met, you have to determine first if there had been an electoral malpractice. For Tribunal to determine if the 2/3 requirement is met, they have to upload the election first.

No matter what happens, Ihedioha would be sworn in and Ugwumba will be appeal the judgement from prison.
