I saw this beautiful extract from a Facebook page by Mazi Tochukwu Ifeduba

Nigeria Constitution Forbids An ex post facto law Nigerian Constitution Part II (9)

This can be interpreted that ex post facto laws are not allowed by the Nigerian constitution meaning you cannot convict me of a supposed crime that I committed when it's not yet law at the time of such crime .

An ex post facto law is a law that retroactively changes the legal consequences (or status) of actions that were committed, or relationships that existed, before the enactment of the law

Atiku is not a Nigeria is a big Joke and depicts that whosoever handling the APC defense teams are not grounded in legal law or maybe they have no defense and merely using distraction and delay tactics .I'm not a lawyer or SAN but I can defeat APC legal team in less than 5 minute

Let us assume that Atiku is actually from Jada a province in Northern Cameroun that joined Nigeria in 1961 .The Question is which constitution and law is in place when Northern Cameroun joined Nigeria in 1961?

The Law in place at the time when Atiku people joined Nigeria is the October 1960 constitution which actually retained Queen Elizabeth as the Head of state in Nigeria . Nigeria's first constitution as a sovereign state was enacted by a British order in council so as to come into force immediately upon independence, on 1 October 1960. Under this constitution Nigeria retained Queen Elizabeth II as titular head of state.

So technically and legally there is no office of the President in 1960 we have the queen as the Head of State and we also have the Nigeria prime Minister this is the legal standing as of the time Northern Cameroun joined Nigeria.

This current Nigeria Presidential system of Government was first adopted in 1979 constitution (Second Republic)
The 1979 constitution, which brought in the Second Republic, abandoned the Westminster system in favour of an American-style presidential system, with a direct election,directly-elected. To avoid the pitfalls of the First Republic, the constitution mandated that political parties and Federal Executive Council (Nigeria cabinet) positions reflect the "federal character" of the nation: political parties were required to be registered in at least two-thirds of the States of Nigeria or states, and each state had to have at least one member of the cabinet from it.

Let us not divide Nigeria and discriminate because of Politics and power there is nothing like Northern Cameroun in Nigeria we are all Nigerians and one people .
There is no law under the 1960 constitution at the time of Northern Cameroun joining Nigeria that bar them from aspiring to be the president there is no law that stipulate they are second class citizen you cannot judge them with a 1979 law it will amount to Ex Post Facto Law which is not allowed both in international law and Nigeria law

Atiku is a Nigerian today but we are made to believe a Cameroonian at birth.

Our constitution is explicit on who can be president, and one of the criteria is being Nigerian at birth.

Does Atiku meet this criterion ?

The Ex Post Facto law is not concern whether Atiku or Adamawa people are citizen by Birth but exclusively concern with the fact that Atiku is already a Nigeria citizen before that law for presidency was formulated 19 years after Nigeria independence in 1979 constitution . you cannot adjudicate a case with a law that is not in existence when the so called event happened .

If Northern Cameroun joined Nigeria in 1980 then such law can be applicable to them

No Atiku is not in trouble that case will be thrown out it's a new law you cannot use to make legal judgement for event that happen before that Law
