The NJC recommended he be retired, and he handed over his letter to the President's chief of staff. PMB wants the NJC to clarify their position on their findings.

If you read my post well and you can comprehend, am only asking for a question which I don't know the answer, you have not provided the answer as well, and I don't think the NJC has the power to ask for an extension either, if this were the cases, when onneghen was acting, why the hollabalo about the 3 months then? Thru could av just extend his temporary tenure, so all I want to know is under which section of the constitution did the President act? If a president can do this he is more or less a dictator /King, because he can have anyone has chief justice without the approval of the National assembly as long as he wants, Magu has being in acting capacity of the efcc for the past 3 to 4years now, that's absurd, is it that someone else can not do his job? What if he drops dead with heart attack today, won't someone else step in? This government has alot to do to improve it self, it's just making senseless decisions week in week out that is of no real impact.

President Buhari has zero, absolutely zero powers to extend the tenure of the CJN.

I think it is time time NJC alters the procedure of appointing the CJN. It should be by election by the members of the NJC. As it is, the Executive is having overriding powers over the Judiciary. This is a democratic anomie and it should not stand.

The NJC recommended the old man be retired with full benefits, and in anticipation of PMBs acceptance he quickly sent in his resignation, which was reported by practically all the media houses. Whether he resigned or not, the NJC, which has the authority, has effectively retired him.

The NJC also recommended Tanko for confirmation.

The only reason the president has not confirmed Tanko ia because he's worried about the ambiguity regarding the NJC's findings whether onnoghen is found wanting or not. PMB does not want to retire with full benefits a probable criminal


When that question is settled, then Tanko can be confirmed in line with the NJC's recommendation.

That's left for the President to determine. Every new CJN/ IG acts in acting capacity for the first period of 3 month. The president at his wisdom can either send his name to senate for approval within the first 3 months or he may choose to extend his acting capacity from the first 3 months to 6 months, within this period he can send his name to Senate for approval.However,there are few of Federal Government appointees, like Sec to the FG and EFCC Chairman, who don't need Senate approval.
