There are Always a probable cause. grin
All the had to say is there have been a robbery at the next street few hours Ago and you fit the DESCRIPTION of one of the SUSPECTS.
Remember, Nigeria is not a place to use the probable cause argument because our Justice system is still very much archaic. The Rule of Law is never sacrosanct.
But my response was in respect to the person who tried to compare Nigeria with saner climes, by saying they could also search you randomly in the saner societies.
For instance in saner climes, the police cannot just fabricate a story that there was a robbery and the suspect fit the description else they will need to provide evidence of the robbery and might need to produce the person that gave the description and if the description was a 911 call they might also be asked by the defense counsel to provide that for the jury/judge to hear it.
But in Nigeria, anything goes. So if you're stopped "na to jejely" allow them search you and answer them "yes sir" because if they accuse you of anything false, you might as well be gone, if you don't have someone in the ranks in politics/army/police to save you.

Yes, you are correct, But random searches without probable cause can Also lead to An Arrest of a criminal or criminals, I believe police are allowed Also to an extent to conduct random searches.

I can understand your elaborations Above, but i think it all boils down to preventing crimes and yes!! in Nigeria Anything goes so probable cause would be out of "Normality" for Nigerian police and Nigerians..

Imagine you asking a Nigerian police why he stopped and wants to search you. grin

Why didn't he attend to the forcing of citizens to unlock their mobile phones at gunpoint?

That's where we have a big problem!

I get your point about how random searches could help catch an unsuspecting criminal.
But in the US, any criminal arrested on random search without a probable cause with a good defense counsel could walk. That's how interesting their judicial system is.
Murderers who gave confessions under duress have walked because the confessions became inadmissible in court after it was proved beyond reasonable doubt that the confession was obtained the wrong way.
But sometimes probable cause may not be hard to prove, for instance. If a Lexus 300 was stolen around here, the police in the nearest checkpoint has a probable cause to stop all Lexus 300 and request for particulars. But most times proving probable cause over random searches could be a herculean task.
And my point has been that, if they want to search, they had better have probable cause for the search, so that it is not just unnecessary harassing of law abiding citizens just like SARS is wont to do.

Aboyomi Shogunle is the Assistant Commissioner of Police and Director of Police Public Complaint Rapid Response Unit. His official handle on Twitter is @YomiShogunle; it’s his verified account.

Mr. Aboyomi noted down some points on your responsibilities during police encounter. One of the numerous points he made is that “you, bag & car can be searched without warrant.”

A lot of people are of the opinion that the police should not search them unless they have a warrant to do so.

On the issue of police officers searching individuals without warrant, the ACP just cleared the air.

Read the tweet of the police ACP below;

Your responsibilities during police encounters #YsGuide;
•Be polite & stay calm
•Do not resist or be abusive
•Do not push/hit an officer
•Do not interfere with or obstruct police
•You, bag & car can be searched without warrant.
If u don’t like encounter, report @PoliceNG_CRU

In sane countries, police can stop you and search if everything looks suspicious, they don't need warrant for that now.

How do they bust guys with guns and drugs over there? Nigerians should chill and allow d police do their job biko
This is how random checks are conducted in Ontario Canada.

Notice how it says you can decide to answer them or not and they cannot stop you from leaving.

Last I checked, Canada is a sane country.

Never u argue or say never to a man carrying gun not to talk a Nigerian Policeman carrying gun.

Be calm, pretend that u love and appreciate their job. Thank them for risking their lives to be on the road.
What u want is to pass them with ur life intact.
After that u can go ahead hating and cursing them behind them.

Only the wise can live in this country.

I'm not against the search without warrant rather am worried on this two points :
•Do not resist or be abusive
•Do not push/hit an officer
As As Nigerian I don't see my self looking like a zombie when any force abuses me all in the name of being a force wo/man.
If they want the citizens to comply then they need to be polite in the when doing their work.

fuckerstard:
Uhmmm

Unfortunately , the guy is right! If you don't want to be search at the checkpoint then you can go ahead to the station for more inspection.

One thing I've learnt about police encounter is that you need to open your eyes and ears, it's not all them that are coming to abuse you or harass you. E.g

I was pulled over at a checkpoint recently, i was driving a fully tinted car that you won't even see anything unless i tap down the windows. This guys are with CIB. I picked up my vehicle paper and tint permit etc from the safe and locked the car because you never can tell what next. When i gave him the papers, he check the tint permit and requested for the original and i told him i rarely go out with that since i have a copy.

He insisted, i explained to him that I've been driving around with this permit for a while now and no issues. He said i shouldn't say that cos police different from police, I was like really?? Issokay. So what's gonna happen now, he told the other guy to take me to the station. I didn't budge because i know say i no dey go any station today. So i con ask am say but why him wan make my day worse, this thing we you dey hold me for na minor thing, he said no it's not minor. Then he dropped this points

He said the government does give tint permit for cars except for SUV's, that i won't be surprised if i see say na another suv dem use prepare my permit. I was like you don't mean it!

He also said how can i tint my car so dark that nobody can see the inside at all, he said for my own safety it is bad. Some trigger happy cops might shoot at the car claiming that we're not able to see the inside.

He even said almost 95% of criminals have dark tint.

he gave me lot of instances, that was when i realized that this guys are giving me advice and it's left for me to take it.

To cut the story short, I told them i really appreciate what they're telling me and I'll be going to get rid of the dark tint and make it more visible to avoid unnecessary attention. Naso dem leave me when they notice say i don get the message.

The moral of the story is that, when you have encounter with the police. try as much as possible not to make the issues escalate, they are reasonable ones among them.
