Yes EFCC may not have a good case, but I can tell you categorically that once that lad is put in the dock and takes his plea, either guilty or not-guilty, na 9ja prison direct till he fulfils his bails conditions.

That what EFCC is looking for: then plenty adjournment, then amended charges.

Naira M, should better prepare and arrange people that will surety him, that's if the bails conditions is not stringent.

Wish him a good life in 9ja jail. Read where he claimed to have been arrested 150times in UK, well like the saying goes, no place like home...

No mind the yeye boy. I blame the likes of Davido who supported him. You are into illegal and you have the boldness to tol because you feel you are in a lawless country. Serves him right.

He is not better than these agberos on the street that behave any how and think they can get away with shit.

I tell you. Very watery charges. And to think they had to duplicate what should have been a one count charge to seven counts, just to 'form competence', is just a joke.

So after all the media noise, this is the only thing they can come up with. We have a long way to go.
Na all of us dey this Nairaland,

Pikin wey no dey hear word. EFCC dey there own jeje you go find trouble. They catch you instead make you apologise you do face like idiot for picture, you come dey rake say they don arrest you 124 cry times for UK. Hmm welcome to Nigeria no AC for prison here. Once is enough for you to have sense. quote author=Mandynews post=78454582]In all, the anti-graft agency in the case marked FHC/L/178c/19, has slammed 11-count charge against the musician and his cohorts, many of who are now at large.

Details of the court papers show that most of the charges border on use of forged or stolen access card to obtain money, offences, which are punishable by the Cyber Crimes Prohibition law of Nigeria.

Count One of the charges reads: “That you, Azeez Adeshina Fashola, aka Naira Marley and Yad Isril (still at large) on or about the 26th day of November 2018, within the jurisdiction of this Honourable Court conspired among yourselves to use access card No. 5264711020433662 issued to persons other than you in a bid to obtain gain and you thereby committed an offence contrary to Section 27 (1) (b) of the Cyber Crimes (Prohibition, Prevention, ETC) Act, 2015 and punishable under section 32 of the same act.

And why are most charges repeated? Smh! This is a complete win win for N.M
'Intention' is a grievous offence on its own. One can be jailed for intention to rape, to commit murder, etc.

bro that is killing, the intention to kill is different from intention to steal. Imagine i visited a site and mistakenly download credit card info to my system. Without even knowing what it means and even when it was deleted, forensic test retrieved the files back telling the court i had intent to use it and defraud people. For real? For what i got and made away with without even using it? Wow!

No case here.. EFCC is a totally hopeless organization. Anybody who has lived abroad and understand the credit card laws and regulation will easily win this case even without a lawyers representation...

EFCC na mumu guys. Do they even understand that for them to score a conviction here, the owner must be present in court to testify that his card was used and his card company will also corroborate it?
Do you know whether Marley has made a confessional statement? So you never can be so sure of victory for him

It's well bro. We can only pray that may we not find ourselves culpable and at the mercy of lawyers.

In Bar Exams bro you are mandated to bring out even more counts self.
The cards are different and so can't be convoluted in one or two counts.
There are rules that must be followed
I understand your point bro. Anyway it's also a function of what proof of evidence of commission of the crimes alleged are. I don't know what the facts are apart from snippets from the media so I'll rest my case and watch as events unfold. Thanks

But if I were the prosecutor
I would focus and prove possession of those cards
And then other counts will fall into place on its own

Nigerian will watch the Suits series without any legal background and begin shouting "a good lawyer will get him out".

Well, in a criminal trial the prosecution needs to prove men's rea and actus reus. Men's rea means criminal intent and actus reus means the act.

Ironically, the criminal intent is more important than the act in prosecution because a "child" and "lunatic" who commit the most gruesome crime would not be convicted because of the assumption of the law that they lack criminal intent.

Furthermore, in law intent can be implied through repeated acts that show intention to commit the crime. From the charge sheet, he has received more than 8 bank cards. If you receive one, an emotional person may call it a mistake, you receive 2, we can argue that it is an accident but receiving up to 8 credit cards when you are not a bank itself is enough to prove mens rea.

Also, the way the card details were received can prove mens rea. The legal questions would be were they received in good faith or fraudulently? I doubt they were received in good faith and that is enough to nail the lad.

If you dey shout up and down say na you be the original Yahoo Boy,

Say Fraud na the best thing since sliced bread,

You need no Lawyer to tell you that finding that kind of evidence on you constitutes ground for prosecution..

If you want go to equity,

Make sure your hands are clean..

If you have ever been to the court in Nigeria or abroad you will know that judges are clouded by emotions. Judges in the US will likely convict a black person for credit card theft with little evidence and a judge in Nigeria would likely convict a dude with dreadlocks that is notorious all over the media .

I thought they had shit on him
intent does not mean a lack of solid evidence. Intent helps the court decide on a fair judgment.

When someone is caught with drugs, two intents can be established:

1. For personal use
2. To trade.

If an intent for personal use is established in court, the offense is ruled a misdemeanor and the sentence would be mild.

If the intent for trade is established, the offense is ruled a felony and the sentence would be relatively heavy.
