The Presidential Election Petition Tribunal (PEPT) has rejected the request by the Peoples Democratic Party (PDP) and its candidate in the last presidential election, Atiku Abubakar for opportunity to re-argue a motion by the All Progressives Congress (APC), seeking the dismissal of the petition.

The tribunal had on June 11, 2019 ruled that the petitioners – PDP and Atiku had no response to the motion by the APC, on the grounds that they failed to file a counter-affidavit.

It was that ruling that the petitioners prayed the court to set aside and allow them formally respond to the motion, a request the tribunal rejected in a ruling on Wednesday.

The tribunal also adopted the schedule of proceedings agreed by parties on Monday, and adjourned till Thursday for the commencement of formal trial – hearing of the petition.

The petitioners are expected to call their first set of witnesses on Thursday.

A motion to dismiss a case is a per-trial motion that must be addressed before the main trial commences.

If the tribunal have accepted APC motion for dismissal and have ruled that, PDP did not submit a counter affidavit, why are they not dealing with that motion before proceeding into the trial proper?

They should have first rule in favor of APC and dismiss the case or rule against APC and continue with the case. You can't have a per-trial motion pending, and what to move to hear witness on the case, unless the witnesses are to support the motion for dismissal and if that is the case, since PDP did not file a counter affidavit, they can not present witnesses.

I remember when Atiku was VP. How nearly 200 million naira EVERY MONTH from Adamawa state allocation was channeled into building his elementary and secondary schools . How after the completion of the school, every local government chairman and commisioner was forced to send a child to the school. If you don't have a child, send a relative there. School fees was about 200k then and people were reluctant to send their kids there.
And then towards the end of their tenure, Jennifer who was Atiku's mistress requested the governors personal house for her birthday and Atiku told Boni Haruna to hand over the keys to his house and build another for himself from the state treasury. It was about 3 months to the end of their tenure, Obasanjo was withholding Adamawa funds. How on earth was Boni supposed to build another house. That house was his only house. It took the intervention of the Lamido Adamawa for Atiku to let go. And then Boni contested for Senate and won but Atiku Ordered Bindow to be announced; because Boni Haruna did not come through him as his God father.
Atiku did not know that one day, he will be looking for this power again and people will be using him to do mumu.
