He had issues with his Gov before the elections, and defected from APC to Accord Party just to get the ticket which was the vehicle within which he won the March 09 House of Reps elections.

He has been an ally to the President from his CPC days, and even went ahead to attempt the Speakership position which he was coerced to drop.
Yes, he is serving now..and can be picked.

All he needs to do is officially defect at plenary, then resign, inform INEC and await his inevitable confirmation.

A bye-election will be conducted in his Constituency at a later date to be announced by INEC.

He doesn't have to go through that process. Not required.

He just have to appear before the Senate for confirmation (as every other Ministerial nominee), then he'll resign from the House after appointment.

In a parliamentary democracy like that in the UK all ministers are elected members of paliarment and members of the ruling party or coalition, you cannot be a minister if you are not elected to the parliament. This is not true of the Presidential system where the President selects his ministers not necessarily from the parliament, and generally not from the parliament.
In the system we operate, When parliamentarians accept to be ministers they become part of the executive and their direct boss is the president so they can’t be in parliament which is a separate independent arm of the government. When Senator Bala Muhammad was given the Minister position by President Goodluck Jonathan , Bala accepted and had to leave the senate. We expect Nwajiuba to do the same.

My people, this is not the first time of nominating a serving lawmaker as minister, in 2003 during former president Obasanjo, he nominated a serving senator, I think it was senator udo udoma or a senator from Akwa ibom or Cross River and he was screened by the senate as usual but when he was given Minister of State (junior minister) he rejected it and went back to the senate. being A MINISTER, not a junior minister is more Lucrative
than being a House of Representative Member. I believe before he was nominated as a minister they have discussed about it and the ministry he will supervise , mark my word if they give him minister of state he will reject it and go back to the National Assembly. He is still an Apc member, he just used another party to get what he wants, he will go back to Apc any moment from now, watch out.
