Not totally true.

INEC is a creation of the law which is saddled with the conduct of elections. INEC is to follow laid down rules and regulations as contained in the INEC Act.

What a petitioner needs to do is to show by evidence that an election conducted by INEC and in which he was a candidate did NOT comply with the Electoral Act and the regulations made pursuant to it.

The petitioner must call credible witnesses, provide documentary evidence and link ALL together to show how INEC did not follow the law. It is only when a petitioner does this that the onus of proof shifts to INEC.

What INEC needs to show is to demonstrate that it complied SUBSTANTIALLY with the law. No more, no less.

The fulcrum of Atiku and PDP's case before the tribunal is that he won majority of lawful votes and relies on a server's result.

Nigerians who follow political developments avidly know that the 2019 election was conducted based on the old law- 2015 Electoral Act. The are also aware that the last minute attempts by Saraki's Senate to amend the law to allow e-voting failed as the president refused to sign it into law as the purported amendment violate existing law and ECOWAS protocol of which Nigeria is a signatory.

I am of the view that is silly to rely on the evidence of a Kenyan who was told by an INEC whistleblower that Atiku won the election based on result sent to a site allegedly from INEC server.

Common...

The most shocking part of the whole mess of a case was when Atiku's national collation officer abandoned the INEC server claim at the tribunal and admitted that collation was in fact done manually.

That sounds the death knell on Atiku's petition.
I hope people like FaraAideed can comprehend this your very elaborate and elementary explanation undecided

The election was rigged by both parties in their strongholds.

I still believe Atiku would be more sensitive to issues than Buhari though.
Re: BREAKING: We Won’t Call Any Witness In Defence Of Petition By PDP, Atiku – INEC by Jones4190(m): 1:38pm On Jul 29, 2019
Do you know that Atiku “had no right to be voted for and returned in the election to the office of President of the Federal Republic of Nigeria held on Saturday 23 February, 2019, having regard to the clear provision of Section 131(a) of the Constitution of the Federal Republic of Nigeria (CFRN) 1999 as amended, which unequivocally stipulates inter alia, that for a person to be qualified for election to the office of President, he must be a citizen of Nigeria by birth.
“Atiku is not a citizen of Nigeria by birth and ought not to have even been allowed, in the first place, to contest the election. From available records, Atiku was born on the 25th November, 1946 in Jada, Adamawa, in Northern Cameroon, and is, therefore, a citizen of Cameroon.
“His father was Garba Atiku Abdulkadir, who died in December, 1957. Prior to 1919, Cameroon was being administered by Germany. “But following the defeat of Germany in World War I, which ended in 1918, Cameroon became a League of Nations mandate territory which was split into French Cameroons and British Cameroons in 1919.
“British Cameroons was administered by the British from neighbouring Nigeria.
“In 1961, a plebiscite was held in British Cameroons to determine whether the people preferred to stay in Cameroon or align with Nigeria.
“While Northern Cameroon preferred a union with Nigeria, Southern Cameroon chose alignment with the mother country.
“The transition took place on June 1, 1961. It was as a result of that plebiscite that Northern Cameroon, which included Adamawa, became a part of Nigeria, and by derivation, the Atiku became a citizen of Nigeria, but not by birth.
“Atiku, therefore, contrary to the assertion in Paragraph 1 of their petition against Buhari had no right to be voted for as a candidate in the election to the office of President of the Federal Republic of Nigeria held on 23rd February, 2019 across Nigeria,” what we are said is that the court should dismiss the Atiku petition, base on the fact that Atiku did not qualified to contest the election, all the votes purportedly cast for the Atiku at the 23 February, 2019 election and as subsequently declared by INEC on the 27th of February 2019, were wasted votes. If you vote for PDP in the last presidential election, your vote in invalid

Atiku should ask for a refund from his lawyers.
The petitioners have done the needful. INEC simply took a swerve to avoid further damage being done to them.

They must explain what happened to the monies hurriedly approved and disbursed for them, yet, gave us a terrible election.

Anyway, that is done with next is APC and buhari to enter their defense.

INEC has a server and they should stop all this public misinformation. I have check their website and I saw it.

Step to assess INEC server

1. Visit www.inecnigeria.org
2. Click on the MENU at the top right corner
3 click on election
4. Click on elected candidate 2019
4. You will see list of election held into different position, the click on the one you want and the PDF of the result will be downloaded straight to ur system.

Kindly share this info among friends who are still being misinformed about the existence of INEC server.
Yes INEC has a website, what is being disputed is whether or not election results were transmitted and collated electronically and all these on a dedicated server.
