Court Orders CBN To Pay N8bn Damages To Benue Communities Over Soldiers Invasion by AgencyReport: 6:37pm On Aug 19, 2019
A Federal High Court sitting in Abuja, has ordered the Central Bank to pay the sum of N8 billion to some communities in Benue State over the invasion of their land by soldiers, Igbere TV reports.

Igbere TV reports that the affected areas include Tiv communities in Ukum, Logo, Kwande and Katsina-Ala Local Government Areas of Benue State.

The order comes following a suit filed by the aforementioned communities in 2001, over the loss of lives and properties during the invasion by the armed soldiers.

Delivering judgement on Monday, the presiding judge, Justice Nyang Ekwo, said; “The CBN is hereby ordered to pay the garnishee sum into an interest-yielding account to be opened and maintained by the Chief Registrar of this court in First Bank of Nigeria Plc.

“The order authorising the disbursement of the money shall be made upon being satisfied with the terms of disbursement including the legal fees jointly singed by Ocha Ulegede, Esq, and J.K Gadzama, SAN, for the ganishors and endorsed by first-class chiefs of Jukun, Logo, Kwande, Katsina-Ala local government areas on behalf of the Tiv Traditional Council.”

The CBN and the Military are yet to react to the development as at press time.

I don't think this is correct! It is the Federal Government who could possibly be liable here and not the Central Bank.

In fact what nonsense judgement is this! Did this judge go to school at all?

You are the one that lacks understanding. CBN is the banker to FG so garnish order will go to them.

I'm assuming a judgement must go against the "direct" before garnishment GT bank applies. I've seen no judgement against the FG here.

You don't still understand the meaning of garnish order. Ok in layman's language, it's court instructions to the bank to pay creditor of its Customer on behalf of the customer. The Customer must not allow to tamper with his/her accounts until such payments are made. I think it's clear now.

I do know how garnishing works. A judgement still first has to be made against the liable party, and I have not seen one here. I expect CBN not to honour this order for that simple reason.

Garnishee proceedings comes after a judgement has be given, in favour of the judgment creditor.

It's a method of enforcement of monetary judgments.

So in Garnishee proceedings, the judgment debtor bank or banks are made Garnishees, and are party to garnishee proceedings.

That's what I thought and have been saying. There might be a judgement, but I have not myself seen one.

Can a garnish judgement be passed against CBN without a judgement against the FG?

looks like there are SAN's here. When odi was invaded and the matter was in court, it was the FG that was found culpable but it went as far as the supreme Court and compensation was paid.Can a garnish order be enforced when the matter is on appeal or will be appealed. I think that a judgement preceeds a garnish order and the judgement provides grounds for appeal.
