Dat is understandable but, let's be realistic, who works for eight years only to hand over the rewards to someone else. There's no altruism in politics, it's all about personal interests.
The SE have everything to gain in 2023. If the north retains presidency, they can laugh at the SW. If they get it themselves, all the better. But politically speaking, it's a long shot for a SE presidency.
My take is the south needs to find a common ground to unite. Who will take the first step between the two major tribes is anyone's guess but two scenario will become possible if this happens.
Either the south produce a joint presidency or the nation breaks up due to the north holding the short end of the stick and thus seeing no reason for being a part of the union. In the end, the people of Nigeria benefit the most in both scenarios
See the igbos work for south west presidency in 1999 /2003 even when south west was Anti PDP

There is nothing like acting CinC. An acting president cannot wield the power of the CinC unless that power is transfered to him even in the US.

Buhari only hands over as Head of Government not as Head of State and Commander-in-chief. That is the reason, he still uses state resources, presidential aides and others when he hands over.

In our democracy, the President is both head of government and head of state.

VP only acts as head of government.

Can the Queen of England, Emperor of Japan, President of Isreal hand over to someone in acting capacity?

No

The only time the power of the president and CinC is transferred is 12AM-12PM May 29 of every 4 years.

The senate president theoretically wields that power but in the US, this vacuum doesn't exist.

The president-elect even sworn-in cannot exercise his powers until 12AM, the exact time the current president's power elapses.

So be guided.
If we were under external attack while Buhari was on sick bed, are you saying we would need his approval before repelling the attack?

Stop the fear, pls.You are not slaves.
Please when your boss hands over to you temporarily and his Secretary misbehaves, sack him or her without your boss' approval and let's see how it goes.

No Acting president can sack an appointee of his boss without consequences. It has nothing to do with fear or slavery, it is due process. Wait for the boss, report the man and recommend his sack. Period!

1. Obono Obla arrested some people on corruption charges.

One of them was Wale Tinubu - Oando Oil

2. Obono received instruction from Deputy Chief of Staff, VP Osinbajo office to hand the case over.

3. Obono refused, insisting instructions to him should come from Chief of Staff in President's Office.

4. AGF Malami got Obono's office sealed and he was locked out.

5. Obono thereafter complained and told President Buhari that both VP & Malami should be investigated for sabotaging works of SPIP., and by extension the anti-corruption crusade.

6. Powers in Presidency sought to cut Obono out.

7. Meanwhile, few weeks ago AGF Malami issued instruction that all contracts issued by any Ministry must come to him for approval.

8. Now, President Buhari has taken SPIP from VP and given to AGF Malami to oversee.

9. Further, contract approvals that are statutorily under VP will now also land at AGF Malami's desk for approval.

I'm surprised President Buhari has not issued the VP a similar instruction as he did to all Ministers to schedule with CoS Kyari before they can see him.

But there is nothing like acting Head of State. Can you remember that Burantai once told Osibanjo that he takes order only from the CinC despite him being in the sick bed?

Wrong!

Its mindset like yours that end with North cheating South. You are the type of Southerner they want in govt.....so they can get away with murder.

Head of State is a military term.

Military you use Head of State
Parliamentary use Prime Minister
Democracy use President
Kingdom use Monarch

They all mean the Head of Govt.

That is the problem with some of you yorubas, you guys behave as if you know all but nothing.

In parliamentary system, the head of state and head of government are separate.

British HoS is the Queen, the head of govt is PM. The Isreali HoS is the Isreali President while the PM is the HoG. The Emperor of Japan is the HoS while the PM is the HoG.

The King of Spain is the HoS while the PM is known as the President of the Government instead of HoG

The Queen was Nigerian HoS between 1960-1963 while Governor General was the HoG.

In the first republic, the Ceremonial Presidential was the Hos while PM was HoG

In military regime, the HoS was both HoS and HoG

In presidential system, the president is both the HoG and HoG.

Other systems of government though not parliamentary separated their HoG and HoS.

In South Korea, the President is HoS while PM is the HoG.

In Iran, the Supreme Leader is the HoS while the President is the HoG.

In Germany, the President is the HoS while the Chancellor is the HoG.

Usually, the HoS is also the CinC but there are instances where the HoG is invested with the power like Isreali PM and German Chancellor

In systems of government where the HoS and HoG are separate and the HoS is the CinC, the operational use of the armed forces are exercised by the PM like in UK, Spain, Canada, First Republic Nigeria but in Iran the Supreme Leader exercises both command and operational control of the armed forces.

Usually, modern day monarchs are HoS have no executive powers (HoG) but there is just a few exemption.

The King of Eswatini (Swaziland) is both the HoS and HoG.

Apart from him, I think there is no other king in the world that is also a HoG.

Be guided!

Nonsense!

British is called United Kingdom, ruled by Monarchy. The Prime Minister will declare war only on the authorityof HRM Queen Elizabeth, complete with the seal of her throne.

Buhar is President, not Head of State. He ovsersees Sovereing power. When he hands over duty of government the Soverengty comes with it.

That is the problem.

You don't know and you are forcing yourself to appear as if you know.

You don't hand over sovereignty. In presidential system of government, sovereignty rests on the people and the constitution is supreme.

In UK, the sovereignty rests on the crown while the parliament is supreme.

The crown is a institution and you can't hand over an institution. The Queen is only the physical manifestation of the crown and head of that institution.

Back to our topic...

A presidential system is a democratic and republican system of government where a head of government leads an executive branch that is separate from the legislative branch. This head of government is in most cases also the head of state, which is called president.

https://en.m.wikipedia.org/wiki/Presidential_system

Head of Government and Head of State are two different responsibilities but in Presidential system, a single person wields both powers.

I know you are focused because our military used the title of Head of State, so you now associate HoS as a military title.

It is just an official identification our military used to identify any military officer exercising the role of a HoS, HoG and CinC.

Libya used Leader but unlike our military, he exercised only the power of a Head of State while his PMs headed the government.

When he addicated that role, he appointed his PM as Head of State for about 3 years. He was in solitude during those period.

When he returned, he assumed his powers again.

I don't know the school you attended, but I will advise you to seek for refund.

Guy, you are dribbling yourself. Stop it!

Stay focused. The talk of monarch, prime minister, president was a side talk to highlight for you your error when you interchange President with Head of State.

1. A president is not a head of state.
2. The constitution is above the president.
3. Our constitution says when proceeding on leave or when incapacitated a president will designate the VP to perform all functions of the president.

Here it is below. Im wasting my time tutoring you. You must think you are talking to some newbie on constitutional powers.

Argue with constitution abeg and park well after you finish.

Chapter VI.
The Executive

Part I

Federal Executive

A - The President of the Federation

145. Whenever the President transmits to the President of the Senate and the Speaker of the House of Representatives a written declaration that he is proceeding on vacation or that he is otherwise unable to discharge the functions of his office, until he transmits to them a written declaration to the contrary such functions shall be discharged by the Vice-President as Acting President.

146. (1) The Vice-President shall hold the office of President if the office of President becomes vacant by reason of death or resignation, impeachment, permanent incapacity or the removal of the President from office for any other reason in accordance with section 143 of this Constitution.

148. (1) The President may, in his discretion, assign to the Vice-President or any Minister of the Government of the Federation responsibility for any business of the Government of the Federation, including the administration of any department of government.
The bold is express. What more do you need to convince that an Acting President has power over any department or business in same measure as is conferred on the President? In fact, the President is instructed to do as constitution says do.

You are tutoring who?

For a starter, the president is a Head of State https://en.m.wikipedia.org/wiki/Head_of_state

The bolden in your comment I quoted showed what I have been shouting into your ears since ages.

The President can only delegate responsibilities that falls under "business of government" but not that of a CinC.

In a nutshell, in a presidential system, the VP can only act as the Head of Government but can never act as Head of State unless the substantive president is incapacitated.

If Buhari goes on leave for a year, he can hand over to Osinbanjo as acting Head of Government but he still remains Head of State and CinC.

He doesn't hand over his powers as HoS and CinC to his VP.

First, you need to understand that HoG and HoS are two separate responsibilities but in presidential system, one person wields both power unlike other system.

SenatorDave1 kindly go through this thread and explain to your friend what a presidential system of government is and who a head of state is.

I am tired.
