Malawian: it is not wrong to disconnect electricity inside your house, it is only illegal to disconnect from the poles or from the meter. any wire that enters your house from the meter, it is up to you to do whatever u like with it. its like saying that it is wrong to wire your house except it is PHCN officials. 1 Like |

Malawian: it is a very dicey situation. 1. does your landlord knows that you subletted the property. 2. can you approach your landlord through your agent to help you to evict them. 3. will your landlord get angry for subletting? 4.did you issue receipts for payments & agreements even if it is a paper that has your signature and that of ur tenants. 5.how was the mode of rent payment, was it through bank account? 6. how many times were this rent payments made? all the answers you give above will determine the solution. 1 Like |

I went through every comment here and I understand your plight. Yes, some suggestions here are good and some are something else. First of all, it is illegal to sublet your apartment. If the landlord should hold you up on this, it won't be funny. NOW TO THE MAIN ISSUE ON GROUND. It is your apartment and no one should dictate how you keep it. I wonder why your landlord's cousin did not house the guy he introduced to you in the first place. Did you tell him you are lonely ni? BACK TO YOU... If you can, cut off the power supply to the two rooms, install jam-lock in the two rooms, change the lock to the main door and your alternative route to your apartment. Tell your landlord that the two people staying with you are not relatives but squatters, let him know his cousin brought one of them to stay for few weeks. Then, you can tell him they no longer stay with you Do not forget, the e is no evidence that they rented the place from you other than the initial receipt and agreement letter you gave to the MIA guy. Look for a place to stay for few days. That way, if in your absence anything happens, you can take other crazy actions. The 24/7 occupant will be forced to call you when he is challenged by the Landlord. Definitely, the landlord's cousin will also be forced to call the other MIA occupant. For the missing occupant, you can also do this: Get some trusted friends to go with you, film you while you open the door, pack up all his things, install jam-lock and look for where to store his things, maybe that is where your landlord's cousin comes in, to possibly collect the things and store for his 'friend'. That recording is evidence enough. Remember, it is your apartment and you paid for it. Going legal can be time consuming and money consuming and just as your lawyer has indirectly told you with his actions, it is a waste of time and money. Trust me, I have been there and I know. Also remember, don't try this again. Total strangers in your home, a place where you rest after a stressful day. It is well with you. 1 Like |

EbonyQueen001: You obviously 'dont know' and you are certainly advising, based on 'emotions', which is misleading! Going "legal" is time and money consuming but going 'rogue' can ensure the actor/accused spends even more money and longer time in JAIL! That 'recording with trusted friends' IS NOT enough or good evidence in a court of Law! Only the presence of a 'neutral entity recognized at law' like the Police or Court Baillif, is good and enough evidence. Cutting-off electricity or any other utility for that matter or such similar action, in order to forcefully eject a tenant is unlawful.... it is stated in black and white in section 44 of the tenancy Act 2013 (amended) so l wont advice that at all. That 'initial receipt and agreement' is enough evidence that they rented the place from him. FYI, Rent agreement can even be 'verbal', where no written documentation is made! And please, stop making all these 'assumptions and generalisations' on behalf of the Op, he knows best what transpired between them, all you need to do is just advice, based on what is lawful. 1 Like |

Oh! What a pity. The human mind is really wicked. I don't know the kind of landlord that you have or your relationship with him/her. It's high time you open up to your landlord by first apologising for subletting his house and humbly give him genuine reasons why you did it (to help your self moreover they have been your good friends). Save your self the side spendings and keep it for a take-you package to your landlord if he's the greedy type because he might decide to charge you for helping you or use the opportunity to increase your rent. So what is the deal? He will officially prepare a quite notice and paste it on your door as usual after which you will go about begging and begging him. Sometimes, he will come to the house to shout and remind you of the notice and you will kneel down to beg him(while they peep through the window and laugh at you). Remember that you will pay for all the logistics - transportation, phone calls, lawyer's involvement if the house has one. Sometimes, you will inform the landlord or his lawyer when the other guy is around so that you people can play the drama before them. Try removing your things to somewhere pending when the place will be vacant then you come back. Only a good landlord will do this for you, remember. Another option is to be patient till the expiration time and quietly pack out. Any intelligent lawyer you bring in on your own will tread with caution because it's an illegal act; unless the initial agreement with your landlord includes subletting. Be wise! |
