Guys, i need your advice on this. In my former place of work, i wasn't given any appointment letter but was just told to start. Also i was told by the boss that i would have to give them two months notice else i forfeit my one month salary before leaving.

Recently i left without the two months notice because my new place needed my services urgently. Now my boss has issued a letter to me stating that i breached the agreement. My question is, does he have any right to sue me? Afterall there was no legal binding between us, moreover i have forfeited my one month salary with him. Lawyers in the house i need your input on this. Thanks

Boss move on.
He didn't give you an appointment Letter, so there's nothing binding you to his company.

Moreso, this your new place, did you collect an Appointment Letter? Or na word of mouth them still give you
If you haven't been given one, quickly request to be given one stating the terms and conditions of your appointment with them.

Because when them go join hand carry you go station, they won't allow you have access to nairaland o.

No i didn't. There was no letter of appointment given to me. I was only verbally told that i would have to forfeit my one month salary if i fail to give them two months notice. I have forfeited and moved on, yet he's saying i didn't leave the way i was supposed to leave

Thanks sir. At the moment, I was served a letter by a mediation center to come. Should i honor the invite or get a lawyer to write them as i won't be available on the said day of the meeting or just move on

Bro, move on with your life. Bosses fire employees everyday. No one serves them letters from mediation centre.

Let me quickly add to this if its not too late. Except you will have to deny the statement that he told you about the notice period and the conditions that comes with it then you will be fine. The reason is that, they can argue that contract does not have to been written for it to be binding. It can be formed orally and you being there working and earning salary showed there is a contract. So, if you admit that he told you and you accepted to work there, then be quick to chip in that he also told you that you will forfeit one month salary in lieu which is what you have done. But if you have a lawyer friend that can go on your behalf, the matter will be buried at once.

Bro the response u are getting from nairaland is not enough to help you.

My advice:
Meet a layer in person and tell him this.
If it demands the lawyer to write letter, he should write and also ask him if you should honor the invitation.

And again, since there is no written document, please deny that nothing like that was told to you, since your employer no get any evidence.
Just deny, I repeat again, deny that he didn't told you anything like given notice before resigning.

You know as Nigeria be; Poor man no get right for Naija, na only the rich know there right.

Because as it stands, if you disobey the invitation and later it was found that you are not guilty, they will now lay hold on disobeying invitation, carry one name give am, as crime wey you commit. And use that one against you.

So gently meet a lawyer in person for advice.
