Human rights lawyer, Mr Femi Falana (SAN), who leads Mr Omoyele Sowore’s defence team, has asked the Nigerian Bar Association to take disciplinary actions against lawyers in President Muhammadu Buhari’s cabinet over what he described as desecration of the court with Sowore’s rearrest at the Federal High Court in Abuja, causing a disruption of court proceedings.

He said his legal team would meet on Saturday to determine the next line of action.

He said there were 10 lawyers with four of them Senior Advocates of Nigeria, who ought to live up to their oath to defend the Constitution and other laws of the country, by ensuring that the rule of law was observed by the government.

The SANs in the cabinet are Vice President Yemi Osinbajon (SAN), Attorney-General of the Federation and Minister of Justice, Abubakar Malami; Minister of State for Labour, Mr Festus Keyamo; and Minister of Works and Housing, Mr Babatunde Fashola.

He said, “Even though President Muhammadu Buhari has a duty to caution the Department of State Services, the blame of the desecration of the court today (Friday) rests squarely on lawyers in government, who are under a duty to ensure that the rule of law is observed.

The SANs in the cabinet are Vice President Yemi Osinbajon (SAN), Attorney-General of the Federation and Minister of Justice, Abubakar Malami; Minister of State for Labour, Mr Festus Keyamo; and Minister of Works and Housing, Mr Babatunde Fashola.

He said, “Even though President Muhammadu Buhari has a duty to caution the Department of State Services, the blame of the desecration of the court today (Friday) rests squarely on lawyers in government, who are under a duty to ensure that the rule of law is observed.

“They have all taken the oath to respect the Constitution and other laws of the country. That Constitution guarantees the independence and impartiality of the courts.

“They therefore cannot sit in a cabinet under a regime that terrorises the courts and subverts the rule of law.

“It is a matter the Nigerian Bar Association should take up against the lawyers in the cabinet by instituting disciplinary proceedings against them.”

Faulting the arrest of his client, he described it as contemptuous.

He also noted that it was not backed by any arrest warrant or detention order of court.

He said, “There is no warrant of arrest, there is no detention order. What the DSS did today was the height of contempt of court.

“Nobody is above the law. You either abolish the courts or allow them to function effectively.

“This is a situation where the DSS operatives invaded the court and forced the judge to adjourn proceedings; they chased the judge out of her court, disrupted the proceedings and forced the judge to adjourn all cases.

“These are manifestations of fascism, which cannot be accepted in any civilised society. This has never happened in Nigeria where you take over a court forcefully in order to arrest an unarmed citizen.

“You remember that it was the illegal invasion of the National Assembly by masked DSS men that led to the dismissal of the former DG, DSS, by this government.

“So for the same barbaric conduct to occur again is unacceptable. This is a regime that parades 10 senior lawyers, including four Senior Advocates of Nigeria.”

Asked if he had been informed of any reason why his client was rearrested or whether he was going to be freshly, he said “no”

Ordinarily buhari a crude military dictator cannot outlive a democratic govt guided by the rule of law except there are sell outs and deceitful beings such as osibanjo, Keyamo and Co who pretend to be good people.

They have provided him the skills to overcome the norms of the judiciary thereby aiding him in raping democracy and destroying the rule of law but judgement awaits them.

We hear him and his sycophants say he will take over from buhari but that will only happen if God stops to exist.

It's unfortunate that Femi Falana, Omoyele Sowore, Tunde Bakare, Tinubu, occupy Nigeria Ojota protesters etc all enthroned this tyrannic govt despite knowing past Buhari's antecedents in the histroy of Nigeria.

Now the tiger have bare its fangs, they now remember due process.Well that said, this is truly a pivotal basis for the stooge-CJN, NJC, League of Benchers, NBA & all Nigerians of conscience to rise up against this continued bastardization of legal & democratic process in this nation.

The AGF should have long invited the DSS boss or Mr.President that he is answerable to explain all these lawlessness or give reason why they should not be committed to prison for violating the Nigerian constitution.

Sowore is gaining popularity as well as public sympathy both locally and internationally. This would greatly boost his image and in the future help his political dreams.

The only way Buhari can stop him is to kill him and if he dares to do that, there would be a very strong revolution Buhari would not know what hit him.

I am just laffing grin This people will continue to be speaking English while whatever's will happen will happen until we are ready yo do something drastic or God decides to help us.

I don't understand how they think even any advise from the lawyers within the cabinet against things like this will be considered. In fact the lawyers are the ones orchestrating and helping to plan this anomaly using the law grin

The lawyers themselves will not even have mouth to oppose anything when the plan is being hatched. Anyone that opens his mouth to oppose it will be removed from his chopping position.

We are in a tyrannical democracy and rule of law can be interpreted according whatever the "rulers/cabal" feel it means.

Except the NBA will ask the lawyers in the cabinet to resign.

How will people that are chopping resign? grin

Its like asking the Nass to pass a bill for the restructuring of the country. You want them to remove the 15 or 29million a month salary with their own hands.

No. This is not the solution.

We, Nigerians, are the solution.

If Nigerians are aware of their rights, by now, Nigeria would be on fire because of this. The streets of Abuja would have been flooded with protesters because our collective rights have been raped by those we entrust to protect us. No chief of army staff or police boss would quell legitimate protests or kill protesters if the number is overwhelming. It is also an international crime. Buhari would have been forced to fire the DSS boss, like Osinbajo did when our national assembly was desecrated by the DSS. He would have been forced to address the nation and plead for calm.

Until Nigerians get fed up and enforce their rights, this nonsense would continue to play out. Freedom and liberation from oppression comes with a price. We either chose to pay it or we chose to accept the norm. It is Sowore today, who might it be tomorrow?

I remain adamant that Falana is a very useless man ..like the typical coward he is instead of blaming Buhari who is responsible for all this he has instead chosen a softer target in the person of Osinbanjo . Why is Falana always scared of mentioning Buharis name ? Under Jonathan did you ever here Falana blame the VP Sambo? Hell no they always blame Jonathan even for problems caused by governors because they saw Jonathan as a soft target ..
