Amend constitution: Police Decentralization One Way Forward by Blue3k(m): 9:30pm On Jul 17, 2017
In order to combat the rampant curruption and systematic failure of the Nigerian Police force decentralisation is required. Decentralized police will offer better protection of the people in Nigeria due to them being local and a part of their community. This is due to it being funded by local community thus being less prone to ethnic tribalism (real and perceived) and political agendas from the central government. Section 214 (1) of 1999 constitution would have to be amended to allow for multiple tiers of police.

In this scenario Local government Area's will set up their own police that will do the majority of law enforcement. This will be opposed state police that the likes of Governor Ambode, former President IBB, Jonathan etc. call for. LGA police departments called Sheriff Departments will be headed by a Sheriff who will be elected by people in community. The requirements for position be resident of community, 5 yrs police service, at least highschool degree, pass background check etc.

The Sheriff department jurisdiction will stretch to their local government Area. There main responsibility will be keeping the peace and general law enforcement activity.

The State government can set up a department of Public safety that will have State police as child agency. They state police will have state wide Jurisdiction. The chief of police will be appointed by head of DPS.

The State police responsibility will be running the jail and Prisons, bailiff services, supervision of patrol officers, detectives, support for police departments, evictions, patrolling capital complex etc. Governor Akeredolu and Former president Jonathan already expressed interest in state prisons. The prisons will be for inmates awaiting or undergoing trial and convicts found guilty of State offence.

The Nigerian police force will still exist to carry out functions. They can be specialized into other departments or operate like FBI. In cases of emergency they can be called in to assist local police. The state governor and federal government already has power to call state of emergency.

The point of this decentralization of police force is to get maximum efficiency. States can choose to follow different models to reflect their society. An Easy example could be Police chief is appointed by local government chairman or local government council. This will lead to less conflicts and reflect principles of federalism.

We achieve our feat by simply contacting politicians at NASS. Then make sure we have base of support in State Assembly. In order to get any of this done the constitution needs to be Amended. What is need to so is steer policy direction in NASS in right direction since devil will be in details.

The process may already be in motion Deputy Senate President Ike Ekweremadu Already said NASS has 23 bills that would reduce federal government powers. The cause of has support base already with Lagos who wI'll like champion the bill through then build support with other states. We also have interest groups like SOKAPU advocating for local policing at NASS.

Anyway as long the Amendment simply grants multiple tiers of policing states will have that power. The next thing to do would be each state come up with its own policy how it wants to go about policing. Local would be best as far as I'm concerned.

Side note I forgot. In order to have states run prisons it has to be removed from exclusive llist. It's item 48.

Bumping dead thread.

It interesting to note both governors and president have pardon powers. The language suggest they can only pardon for offences under their tier of government. This would create an interesting dynamic if both police and prisons are decentralized. The Federal government will prioritize certain types of offenders.

Im guessing when the police force is decentralized we will see millitary take a back seat. The fact is the police are over stretched hence why they need the assistance currently. I dont know if the corruption will be transferred to new thugs in uniform extorting drivers. Maybe they'll just hand out tickets and impound cars to revenue generate for city.

It is necessary we can't be having one mallam from the north coming to be CP and coming to police people he does not know or care about because he is not from that community. That's why Bubus boys Fulani are doing whatever they want.

If I was a governor I will not welcome anyone that is not from my state as cp the whole north have northern cp the south don't have one from the state.

It's time we stop avoiding the core problem being the centralized police force. The constitution needs to be amended. The federal government just declared Amotekun illegal. It doesn't matter the government thst these guys wouldn't have guns. The fact is the Buhari administration has been again state police.

If this constitution amendment actually sailed it would answer an obvious question. Does the president need to assent to constitutional amendments. I believe its obviously no.

We will have to face the recurring problem of money/ funding.
How would the current police budget be shared if it I'd removed whether totally or partially from the FG?
On the basis of crime rate? Is that fair to all?
Reality idwe cannot tackle the restructuring issue bit by bit

Reality is we cannot tackle the restructuring issue bit by bit

The federal government police probably wont be disbanded and the other security agencies will exist. Their focus will simply be shifted to other areas. If your state still needs them use them.

If your state has budgetary issues generate more tax revenue and cut the waste. Most states dont even generate up 2% in terms of tax to GDP. That issue doesn't require a constitutional amendment.

It's fair to all since it will reduce crime rate and engender more power locally. It's better for the prisoners and practical for the federal government. The FG prisons are over crowded the prioritize certain interstate crimes like banditry, drugs dealing, human trafficking, smuggling etc.

I notice alot of people asking why hisbah of CJTF is legal when it doesn't matter. The supreme court may agree all these things are clearly illegal. Then you're back to a need to amend the constitution. I really dont why people just avoid doing the hard work.

The sections of constitution to amend from the exclusive list are as follows.

2. Arms, ammunition and explosives.
45. Police and other government security services established by law.
48. Prisons

And again i feel that South south , South West , South East and North Central have the numbers to press in NASS to ensure that states have their own state police inorder to put a stop to this fulani herdsmen madness.

Actually they're 1 state short. You need 2/3 of state assemblies to agree. South and North central only add up to 23. If the supreme court rules correctly and bans hisbah and other security agencies everyone will forced come to table. Plan b is to get one state to agree to decentralize police.

The constitution already allowed for sharia courts. The northern states voted to add sharia law to penal code. Hisbah is illegal and unchallenged in court just like any other state security agency.
