My take on this matter is ;what was the substance the SC used to accept the cancelled votes? were there ballot papers presented? one would have thought that inec must have based its cancellation of the votes on credible evidence. As it is an unanimous decision of the court would suggest a fair judgements because all the judges could not have been wrong, however if the judgements of the Imo people themselves is otherwise then we might have activated a brew of chaos.

pdp was leading APC with about 180000 votes. Results of 188 polling units were cancelled by inec. most likely apc won with minimum of 1000 votes in each PU. that is interesting

This guy is dumb. The court simply agreed that the results from 388 PU's where Hope Uzodinma won but we're not added to the tally (unlawfully). should have been added.
When the results from these 388 PU's were added, he had the majority of lawful votes cast and has also fulfilled all the other constitutional requirements. Therefore he is the winner.

Only the votes of Hope Uzodinma were cancelled for reasons known to INEC and not that of the entire polling units which was why the votes for the other candidates were not added.

I also have my reservations to the judgement like what was INEC's justification for the cancellations in the first place amongst others

The question is, did the other parties not score any votes in the 388 polling units? The supreme Court judgement does not make Judicial sense.


We have too many lazy youths on NL,other parties? Right? Y didn't other parties appeal ? So Supreme court should appeal for them? Stop been sentimental, APC of Hope Uzodima appeal and got what he bargained for.

Although the full judgement has not been made to the public but What should be in the mind of an objective person is
1. Why was it initially excluded.
2. Who excluded the results
3. Were the results signed off by the parties/inec
4. Were the results reconciled to voided votes
5. How come a massive 338 PU were excluded
6. Can the election materials be examined to affirm this results.
7. Could have be a posibility of a rerun election in those units.
8. What is lawful and unlawful result.

Electoral judgements in Nigeria will always leave much to be desired. Until we moved to more verifiable and a better reformed election process, we continue to have thieves govern us without fear of removal.
All these arguments should have been done at the tribunal or Court of Appeal. The screen shot below gives you an idea of how the issue was handled.

The apex court said it was satisfied that the lower tribunal wrongly evaluated Uzodinma’s case, when it failed to countenance a proof of evidence that was brought before it by a police officer that testified before it as the PW-54.
It held that records before it proved that election results from 388 polling units were unlawfully excluded from the overall collated results.
It noted that results from the cancelled polling units amounted to 213, 295 votes, adding that Ihedioha was returned elected, based on wrong computation of results.
Therefore Uzordinma total votes as at today are 96,458 INEC allotment 213,295 Supreme Court restored INEC cancelled votes
Total votes as at Supreme Court judgement is 309,753 greater than any other candidates votes in IMO State.

its like this thing dey pain you well well. for your information, the proceedings of the court were not done in secret. all parties to the case are aware of this so called 236000. it was not manufactured overnight.

I think the total number of accredited voters was around 800,000 & votes cast about 780,000+ with over 25,000+ votes declared invalid... These were all accounted for in the calculations & it tallied...

So if an extra 213,000+ votes are credited to APC, doesn't that make the total number of votes cast higher than total number of accredited voters?

I hope this would be cleared up soonest...

INEC a body controlled by FGN and the APC gets Zamfara and Rivers among other losses? Controlled? Really?

If The current governor of Imo state fancies his chances, he can ask the SC to review the judgement. Oh sorry I forgot, the SC is controlled by the FGN.

But,

when the PDP was winning court cases left right and centre in its 16 years ( exception being the SW where the CoA judge was booted out) it didnt know that those cases would form judicial precedent in favour of another party? When SC ruled against PMB three times saying that fraud was not enough to invalidate an election and it must be shown that the fraud must be of such enormity as to reverse the result, PDP did not know that it would come to haunt them in 2019? I would estimate that over 90% of judicial case law being used in election cases tiday come from the first 16 years of democracy..

The cane that is used on the wife is the same cane that will be used on the concubine. If this government goes the same way as PDP it will similarly haunt them when they lose the election.

Hope Uzodinma's petition was predicated on the fact that INEC unlawfully cancelled results in most polling units where he scored majority votes. He contended that INEC lacks the power to nullify the election of a polling unit after the Presiding Officer had declared the result in that polling unit.

He further argued that if you calculate the votes in the polling units unlawfully cancelled by INEC and add it to the existing ones, he scored the highest number of valid votes cast and he ought to have been declared the winner of the election.

Hope Uzodinma through his counsel tendered those results sheets where he won and INEC did not deny that those results were written by their agents (the Presiding Officers).

There were no contradictory results tendered by the Respondents in respect of the polling units where Uzodinma claimed he won.

The law is already settled that once results have been declared by a presiding officer, the INEC has no power to nullify or cancel the result.

Only a competent election petition tribunal has such power.

Secondly, the Apex Court could not have ordered for a rerun or run off because Hope Uzodinma met the constitutional requirement of securing 25% votes in 2/3 of the Local Governments in the State and he won the highest number of valid votes cast in the election.

In any event, the petitioner/appellant Hope Uzodinma did not seek such a relief from the tribunal.

Thirdly, the argument on the effect of the Uche Nwosu's judgment was not canvassed at the Supreme Court in the Uzodinma's case.

The Supreme Court has no power to delve into issues not canvassed or presented before it.

There was no cross appeal or issue canvassed at the apex court on whether Hope Uzodinma was a candidate of the APC in the IMO Governorship election or whether his appeal has become incompetent in view of the recent decision of the apex court regarding the dual candidacy of Uche Nwosu.

In any event, Hope Uzodinma was not a party to that other case nullifying the candidacy of Uche Nwosu.

The decision of the apex court is not meant to massage the sentiments of a few persons.

The Court of law decides a case based on the issues formulated before it and marrying the evidence led at the trial to the law.

That to me, is what the Supreme Court just did. We however await the full judgment of the Court so we can make better meaning out of it. We only have to respect it. Of course intellectual critiques are welcomed.
