It will really be very unfair and will even go out of the standard requirement of a visit visa. The most important thing for visa issuance is to determine that the applicant will come back to his home country.

Hello all, I have been a silent reader preparing for my 4th US visa application in a couple of months. I have read from pg one to the current page of this Part 4 thread specifically because of concerns the public charge rule.
Is it really fake news, I have been trying to understand the public charge rule that has now gone into effect from 24 Feb 2020. TWoods touched on it way back in the thread on 29th Oct pg 151 to be exact, I can't seem to quote that far back but I've included a screenshot of the comment further below.

I would appreciate more input from any US consular law experts in the forum on whether or not this rule is applicable to B1/B2 visa applications, if yes then my understanding is that you have to earn a certain percentage about US federal poverty guidelines, TWoods mentioned 125% but the USCIS website actually states 250% in their FAQs as quoted / copied out below:

"Q. What factors weigh heavily against a determination that someone is likely at any time to become a public charge?
A. The following factors would weigh heavily against a finding that an alien is likely to become a public charge:

The alien has household income, assets, resources, and support from a sponsor, excluding any income from illegal activities or from public benefits, of at least 250% of the Federal Poverty Guidelines for his or her household size.
The alien is authorized to work and is currently employed in a legal industry with an annual income of at least 250% of the Federal Poverty Guidelines for a household of his or her household size.

Nna ukwu, i am not aware of any consular lawyers on this portal most of these folks become overnight " experts/pros/travel and visa agents" once they get a visa approved and to the best of my knowledge COs have stopped answering questions here

Your best bet will be to call USCIS directly, contact US immigration attorneys or visit immigration portals like visajourney and immihelp

To answer your question , the public charge rule is not applicable to that category of visa what is applicable is you developing ties to your home country and overcoming any immigration intent.

It is obvious that with your sheer curiosity about public charge rule ( solely for those with immigration intent) it will be hard to determine ties to your country
It is the least of things you should be worried about when planning to visit the USA!

Im not a pro about this visa stuff but i think you're looking too deep into it,People has gotten a visa on 80k salary! When it comes to B1/B2,They don't really care about your money! Their major concern is that you'll return back home after you're done with your conference/holiday whatever! (Ties)

As long as you can afford the trip yourself or through a sponsor! You should be fine! Why would you be applying for a visa if you can't afford the trip anyway?! By the way im curious,You've never had a US visa or those previous applications were renewals? Anyway, It's good that you're researching,be curious,investigate and make your application!

I used to think that they did care about money in the sense that they'd want to make sure the applicant or their sponsor can afford all travel expenses. In fact this is what made me think the public charge rule would affect b1/b2 applications. My limited understanding of the rule has me thinking that sure they are concerned about immigrants being a drain on US resources by using benefits and all, but also that they'd want to make sure non immigrants are not taking undue advantage of medical resources and the like. I think I read somewhere that with the implementation of the rule b1/b2 visa applicants' salaries would be considered to ensure they can afford 6 months medical insurance as that's the duration DHS tends to give on arrival at the border. Unfortunately I don't have a link for this but perhaps the site was erroneous or maybe I was just looking too deep like you say

Per your question I have had about 3 US visa's granted in the past, I have never been denied a visa to the US or anywhere else...thus far...and forever and ever in Jesus Name amen!

LOL @ overnight experts! Ah I would be happy if it doesn't affect visit visa categories oh abeg! And yes I have been very interested in the public charge rule but only as concerns my holiday grooves. I have good ties in Nigeria so that's not an issue nor has ever been one in previous applications (all granted like I mentioned to UhnNah)

In the past she has applied as self sponsor but since we are applying together I wonder. Since we got married we have taken every overseas trip together but we have both applied separately in the past and been granted US visas at least 3ce each but this is the first time our renewals are coming up at the same time.

If you want to apply with child(ren) I believe you should be the sponsor, if just 2 of you, you both take any options you want.

Hi, I need your suggestions on this. My parents was denied B1/B2 visa to visit me. The interview was at Abuja last week. The consulate asked them 1) their occupation, my dad is a senior lecturer at the university and my mum a nurse at teaching hospital.
2) about their other children location? They are all in Nigeria.
3) About me and how long I have been in the us? They answered two years and I travelled through immigrant visa.
Then she still denied them visa, I am just confused so much cos they have a reputable income, good jobs and children in Nigeria. I just wonder what other ties they need. They had documents to show landed properties too but the VO didn't ask for any supporting documents.
I just want them to visit that's all.
I need suggestions on how to go about it for their next application.

I did for my parents snd they are not even staying here ( too old school to live overseas)

I have just one kid. I am a permanent resident. Even if I am a citizen, my parents dont want to live here, they just like the idea of visiting. Like your parents, they are too old to live here, invested a lot of their time in Nigeria.
Its lagos better, they plan to just visit for two weeks.

How soon you reapply depends on you. They recommend 180days wait but hey its all about that composure they exude and how important the trip means to you and them
