Section 22 of the LUA prohibits any person to whom the Governor has granted a statutory right of occupancy from assigning, mortgaging, transferring, subleasing or howsoever adversely dealing with the land against the terms of grant, without having first had and obtained the consent of the Governor. Under the LUA, each transaction will need to be signed off by the Governor, to approve land for the developers. Also, should those RSA holders seek to mortgage their titled property as collateral to obtain loans, they will need to get their assignment signed off by the Government. This makes Home Equity Line of Credit as a financing option very expensive in Nigeria. The LUA leads to transaction bottlenecks, is cumbersome, tiresome and creates “negative wealth” as all land without C of O cannot be brought into any formal transaction. 1 Like |

What I still don't quite get is "when you say the land should be transfer to the people" do you mean the local chiefs, the subsistence farmers that has been using the land for ages or divided among all the indigenous families that can lay claim to that locality-eve at this, how will the land divided among these families? I'm in support in giving the land back to the people because that will allow farmers, property developers and the general public to use the land more meaningfully for general economic activities but I want to know how this land will be distributed among people. |

myobjective: Homestead principle says land belongs to the person who settled on the land and making improvements. The second way is to buy said land. The land should be owned by individuals who have title or "hold" it already. Remember 97% of land is untitled.The people who have title or hold the land would simply formally register it with state. This just neccessary to track who owns what. The complications come with communally owned spaces. There's probably local laws sd customs. The courts and local legislatures sort that out. Beachside: You dont seem undecided since you restated support for position. You want the government to own all the land because you're not in favor or private land ownership even though it lead to dead assets, higher transaction cost, bureaucratic red tape, agricultural unproductivity etc. The government already has the power you mentioned and failed miserably in the housing sector. Simply put if therw were less hurdles to property development the market would step in naturally. The role of local and state government should be to regulate real estate development with zoning laws, building codes and keeping title history. The idea of the state buying up all the houses and starting over isn't feasible. Alot the land is farmland so you're not going to just replace it. Did you even consider the market for these properties? Ps: it's weird you guys comment of thread about land ownership but dont have thought out positions on the subject. 1 Like |
