Appeal Court Okays APC's Direct Primary, Strikes Out Restraining Order by dokxavi: 11:59pm On Jun 18, 2020
The Court of Appeal in Benin has set aside the order of the Federal High Court from conducting the June 22 Governorship primary using direct mode.

The appellate court also ordered the continuation of the trial at FHC, which will hold on Friday morning brought by the suspended chairman of APC, Comrade Adams Oshiomhole on jurisdiction of the court.

On June 8, the Federal High Court presided by Justice Mohammed Umar had restrained the All Progressives Congress from conducting the June 22 governorship primary election in Edo State using direct mode.

But Justice Morenike Ogunwomiju who headed the three-man Justices set aside the order by the lower court, saying the trial judge gave a problematic order that was not sought by the parties.

In the lead judgment in the suit by APC, delivered by Justice Ogunwomiju and backed by Justice Oseji, she said: “The trial judge (Justice Umar) gave a problematic order that was not sought by the parties to the suit. As at the date (June cool the order was given, the political party (APC in Edo State) had 14 days to organise its governorship primary election. Every judge must be a democrat.

“The appellant (APC) was not given an opportunity to be heard by the trial court. The injunctive order of the trial court of June 8 is hereby set aside. The administrative orders subsist and the issue of jurisdiction should be determined by the trial court.”

In his dissenting judgment in the APC’s suit however, Justice Adumein declared that the injunctive order of FHC ought not to have been set aside, insisting that the appeal was interlocutory, incompetent and should be struck out.

Adumein noted that the trial court did not make any mistake in the matter, in line with Section 285, Sub-section 8 of the 1999 Constitution of the Federal Republic of Nigeria, as amended, adding that court should not decide cases based on sentiments

In the second suit filed by Oshiomhole, the only judgment was read by Justice Oseji, who declared that the appeal lacked merit and it was premature, thereby striking it out.

makes me believe that betrayal cry cry is real when I see shocked WATER participating in cooking the fish.* Beware of all in your surroundings.

Betrayal is the breaking or violation of a presumptive contract, trust, or confidence that produces moral and psychological conflict within a relationship amongst individuals, between organizations or between individuals and organizations. Often betrayal is the act of supporting a rival group, or it is a complete break from previously decided upon or presumed norms by one party from the Others.

While being betrayed can be a devastating experience, like all negative events, it also represents an opportunity for reflection and reevaluation.

Now back to the matters arising in my beloved Edo state. Some political analysts are of the opinion that my able governor betrayed his once benefactor. Well it might sound true to the man of rigid thinking. But to me and my entire Edo brethren, it is a blessing in disguise.

I personally don't really know the real truth on what went wrong between my governor and the former APC chairman, neither have I been to the Edo government House before (if you like call me a bloody civilian I don't care). But what I am hearing around my community is that my governor has stopped sharing our yams to some politicians and they are very angry with him because they spent a lot of money on his journey to the government house.

Let me use this medium thank my governor for the massive projects he has been doing across the state, most especially the grading of numerous street roads. Although I am also very disappointed with my governor on this projects because he is awarding them to amateur contractors. They are just doing sub standard projects everywhere. Roads done last year have started developing pot holes everywhere.
Governor Obaseki should go and locate the contractor that built the pedestrian bridge at UNIBEN ugbowo campus. That bridge will last more than 100 years. If he wants to see a quality work he should go to uniben tomorrow and see it. And then give them a call. I hate seeing all this c~oc.k and bull contractors around. I hate nonsense.

Our judiciary is a mockery. This judgement was expedited because it will benefit certain class of people. There are people languishing in jail with no hope of when the courts will hear their prayers. How about the people with corruption allegations whose case will drag on until it's forgotten

Trial and error in our judiciary, let us be guided accordingly because a day of reckoning is fast approaching, just because of a man's ambition the real issues are no longer cared for showing lack of direction among our leaders, Nigeria is one of the nations that for the past 4 months our higher institutions are closed but in other climes people graduate on daily basis this is a great error

Those who praised the judiciary over Giadom's matter would insult the same judiciary over this one. They are more mentally unstable than Obaseki.

As for Obaseki, with the way he's foot dragging, it is NCDC that would give him ticket.
