But your postulation is more tinted towards morality and the philosophy of law.

But the truth is that the law is blind and law is quite different from morality.

Law is law and morality is morality just like the Atlantic and the Pacific oceans, they don't mix.

Negotiation and diplomacy. In as much as o want you to know your rights and enforce it, I also don't want you spending the little income you earn on lawyers.

I am on the side that prefers helping you make more money than spending money. For example the money spent defending ignorance of the law.

It is case that is most often dead on arrival. But a hungry lawyer will not tell you that.

The truth is , you will know when your lawyer is telling you the truth. He will explain a single position to you over and over again.

That position will never changed, but it might be modified from time to time.

But it is better we avoid getting ourselves backed into a corner in the first place. Everyone will suck you dry and leave you for the vultures, If you are lucky you survive.

It is not always good to rush to court, except court is all you have.

There lies the place of deplomacy and negotiations. I recently saw a video.

So house I humbly request can any one authenticate and verify that in Truth, the Litigator is truly an Authentic Lawyer, for I do not think that He is a Lawyer, Registered on the Roll, Having Fulfilled all the requirements of Law for the Practice of Law in Nigeria.

I agree with you that God is not a Christian, He is interested in anyone who serves him with a complete heart (irrespective of the religion/tribe/status of the individual).

Hi.
He is a sound Lawyer. He is not just an ordinary lawyer. He is a managing Associate and runs a firm on the island. One of the best I have seen. He cracks impossible cases.

Some weeks ago a hacker cleared my account and the bank refused to acknowledge their mistake and refused to trace the money and refund me. We went in circles without any result. It was litigator who got the bank to cooperate in 24 hours. I got my money and cleared all accusation.

I have referred him to my dad who has been dealing with assorted lawyers for the past 45 years. There is a 22 year old case which my dad has been on and he spent millions of naira to solve but he has not been able to. We have been to the Supreme Court thrice for it. He is already doing well with it. The case is between my dad and the government.

I will recommend him any day any time.

The last time I checked I don't remember a meeting spot for lawyers on nairaland. He does not owe you any explanation for his threads.

Stop following the litigator about and spamming his thread.

We are learning from this thread. When people like you come spamming the thread, it becomes difficult for ordinary people like us to understand.

I was following this thread with keen interest until you came with your arguments.

He doesn't need anyone to verify him. The lawyers you are calling, did they collect their license and school certificate on the same day.

In fact, I have vex, if you think you can do a better job than he has been doing, I throw you a challenge,

Come and solve my father case of 22 years with the government then I know what you are a good lawyer.

When you see someone doing good. Commend the person and stop looking for if he is bad or not or if he has ulterior motives.

He has given advice to many on this forum which we will spend so much to get if we are to consult with any of you.

Apart from lawyer in property section and litigator I don't see any other lawyer teaching us how to become better citizens.

Bases for standing surety for an accused person; responsibility of a surety

Position of the law.


"A person who is standing surety for an accused person should do so after proper consideration and personal knowledge of the accused.

Standing surety for an accused based on recommendation can be very dangerous. The bases for standing surety is that the accused is personally known to the surety. It is a vote of confidence on the accused by the surety. He is saying the accused is of good character.

It is based on that assurance that a Court allows the accused to go on bail. It is, therefore, a big responsibility on the shoulders of the surety. A surety inability to produce the accused is therefore seen as an act of deceit on the Court and this will be taken seriously.

The surety, therefore, has a great burden to show it did all within his power to bring the accused. Taking an accused on bail as surety should not be seen as a business.

This is also dangerous. By this, I mean a situation where people do it as a business just as others go about their business. The Court should discourage such attitude."

This is the position of our criminal law books.

My professional experience

So said Alhaji Adebayo smiling broadly from side to side. Well! My ultimate task was to ensure my client went home, and I didn’t care much about the surety as long as the suspected fraudster’s family member brought it.

I knew both sureties were professional sureties, who were in the business of standing suretyship for accused or suspected persons under custody to enable them to secure their bail while making money from the trade at the same time.

Before the family went on a voyage of seeking a qualified family member or acquaintance that could take their son on bail, I had taken time to school them on the need to avoid professional sureties and the danger it could occasion them and the sureties.

There is, most professional sureties know very little about the suspect in custody, and are unable to explain in details their relationship with the suspect they seek to be released to them on bail.

Once you are unable to verify your relationship with the suspect or end up presenting cloned or fake documents to those stern-looking E.F.C.C officers at Ribadu, Ikoyi, Lagos, you are in a big soup. A boiling smelling soup!

I even went to the extent of educating them that they and the child could remain in custody if it were discovered they were involved in professional surety racketeering. I gave instances of lawyers who were present in E.F.C.C custody for soiling their names and with the criminal allegation of perversion of justice and criminal conspiracy to pervert justice hanging on their nacks.

Some persons do get away with it no doubt, but that does not make it right.

I stayed back watching T.V in a friend’s office while the duo went into Oga’s office for an interview.

I became worried when they were taking too long and sort permission to find out what was happening. Alas, the sureties were both in handcuffs. They have been caught for acting as professional surety. The C of O the suspect’s alleged uncle brought was a cloned copy, a fake!

The government worker could not explain his relationship with the suspect. They will be detained and possibly charged to court for prevention of justice and criminal conspiracy to commit same.

What ought to end in a single day, took an extra tiring week, despite all pleas, power games and connection pulling, including sending officers to plead with the Oga the gave the detention order before the trio regained their freedom.

I chop triple money sha. So it was a good deal for me at the end of the day.

But what is the position of the law? How dangerous is this path? Can one land in jail for being a professional surety?

Let's look at what the courts have said in cases where someone was charged before court for being unable to provide the surety he/she took on bail and how they landed in jail.
