That case is contestable because the APC National leadership stood with the EXCO that produced Uzodinma.

Nwosu was desperate because his fear was that...if he takes it to Court, he might win but APC will have no candidate.

if the sc disqualified his candidature of AA on the grounds that he won APC primaries, they are saying he is APC candidate but jumped ship thus APC had no candidate and the exco that produced him is the legitimate exco. uzodinma is a product of wishful thinking and upgraded by Abba ...

So why is he not the governor of Imo state as at today since APC was deemed to have won?

Imo matter confuses me I swear.
There were so many gaffes with the Judiciary in the Imo saga.

They were no major gaffes.we have tackled this issue severally.the case was purely between aa and nwosu.apc had no business there.he had a chance to pursue his case in apc but failed

But again....it was an ex-parte until the substantive suit is decided.
In most cases as this, the NWC wins plenty of the time.
Diri v Alaibe.

Yes.....but the pre-election matter that was brought up out-of-time is one that does have grave implications.

The ANDP cited it during Diri's tribunal case.

You are smart.it was an exparte which is transient.an owerri high court later decided in uzodinma case and it was never appealed.

Mary odili closed that chapter.but in a way, they were partially right.technicalities should not always be an excuse to further glaring illegalities

Exactly....the one in Abuja was exparte., and was gotten Oct 2018.
Justice Ojiako's of Imo State High Court was definite in Nov 2018 and wasn't appealed.

That is why I get angry when people bring up that issue again.the case was conclusive.the supreme court were saying he was nominated by apc is just like saying that i kept money for you yesterday but since you didn't come,I spent it all or gave to another.it was a mere judicial consolation

Lokpobiri's case against Lyon was struck out for been statute-barred.
He could claim as well...that there were illegalities in the Primaries.

It was a dead case because even if you declared Heineken as the primary winner,he can't benefit from the victory still.
But I think it is mostly by discretion and looking at the weight of the case and technicality involved.if technicalities will make you deliver a landmark judgment, you can overlook the technicality

It then becomes subjective.
Depending on the Judge.

All the same that Imo case is an isolated one sha

It is not.it only reinforced the sanctity of the form ec8a and powers of the judiciary and prayers canvassed at court.the appeal court decided similar cases in akpabio vs ekpenyong and Gaul vs egbona where the pdp and inec got the appeal court to cancel the contentious result sheets

The Imo case matter I speak is not in the judgement. That is a case for another day.
The pre-election ish out of time.

BREAKING NEWS...
Its Now Official...
The AA case at S'COURT that started on
26th/06/2020 has finally come to an
end today 29th/06/2020, even though
they're no longer interested in the suit.
The Supreme court nullified Uche
Nwosu nomination in AA on the account
that he had contested for nomination
under APC.
The spirit of the law forbids anyone to
contest for nomination under two or
more parties in same election or even
started the process of being nominated
by procuring the nomination form.
Obaseki has contested for nomination
under APC and PDP in this same Edo
2020 Gubernatorial Election.
He is technically on OFFSIDE!

In line with Supreme court judgment and
interpretation of contest of primary
election in a political party according to
electoral law:
1. When an aspirant obtain an
expression of interest form and paid the
fees as required by the party.
2. When an aspirant obtain the party
nomination form and pay the required
fees by the party.
3. When the aspirant submit himself or
herself to the authority of the party for
screening and other processes
thereafter, the aspirant is deemed to
have contested in that political party and
therefore not eligible to contest same
election in another political party.
Governor Obaseki has contested Edo
State Governorship election in APC and
was disqualified. In the eyes of the law
he is no longer eligible to contest the
same election in any political platform.
What's your take?
Nigerians will protest if they trauncate the already concluded elections

I can sense a lot of anxieties here. People analyzing situation as if they are lawyers or SANs. The only question I want to ask is that " did Obaseki purchase an APC nomination form for the gubernatorial primary before he was disqualified? "
