My brother, do what you have to do... But I believe mba is not going anyway, nor do they have liquidity issues. I also faced a lot of challenge when I was recovering my capital but I did get my capital even though it took almost 2months and now I have gone online. Cheers
Congrats!! For the 2 months it took did they pay you the ROI for those periods. If they didn't, I think that's wrong of them, that's what I want to guide against.

You guys should consider the consequences of what you say here. If you want MBA to survive, don't encourage anyone to file a suit against MBA. Don't try it or all of you would suffer it. The court would grant an injunction which would direct that all MBA's bank accounts be frozen. All funds would then be unaccessible and that would affect everyone.

Read the MOU very well and get familiar with the clauses there in and give to a lawyer to interpret very well. probably a SAN

You think your civil contract would protect you from a criminal complaint of fraud?
Do you know what happened to BTD? Go find out.
Whatever happens, no injunction should come near MBA accounts. Even if it would be lifted, it can take 6months. Can MBA survive with its accounts frozen for 6 months?

Before they lift the injunction, the court can say MBA should provide evidence of payment of WHT and other Taxes since it began operation. That is when everything would scatter.

No genuine investor either here or off-line who eats from MBA will file a suit against MBA for the court to freeze the company's accounts. MBA as far as am concerned has not declared bankruptcy and will never go down as long as the forex market still remains. But whatever the case may be, I believe MBA has the capacity and well qualified lawyers to crush any disgruntled miscreant either on this thread or off-line.

Doesn't even need personal journey through the courts. Complaints to the SEC will trigger the necessary regulatory moves against this unregulated entity, yes, including bank account freezes.

As an 'investor', this is how to kill the goose if you're getting jittery and your ROI held up but at least any money in the accounts will be preserved.

This might also be the convenient excuse the ponzi Sponsors are praying for.

Good luck and good day.

My friend get away here, when reasonable arguement are being made, you will just jump out of your hole like a rat. All the times you have spent idling around here, why can't you go and report mba to SEC
I can give you a contact in SEC if you want.

If an account is to be frozen, it is done through Exparte Court orders. Before MBA has an opportunity to respond, it would take at least a week. Once response has been filed, the court fixes a date to hear it. That is another 3 weeks. Plus at least 2 adjournments, that is minimum of an extra 1 month.
Which financial organisation can survive with its accounts frozen for 2 months?
That is why litigation against MBA should be prevented at all costs. It would destroy things.

I believe MBA has persons in SEC. If not, SEC would have done this a long time ago. Besides, if SEC wants to do this, MBA can know beforehand.
Unlike SEC, an ordinary Magistrate Court in Birnin Kebbi or Nkalagu can freeze MBA's accounts and it would be done. It is very valid and MBA won't see it coming.
All forms of litigation must be discouraged and prevented. It is easier to destroy than to build.

Well, litigants have to have adequate facts and points on ground before any court can agree to freeze mba account. If this is how easy it is to freeze a company account, then most Nigerian companies would have been shut down because most are debtors.
A lot of this people here threatening court case haven't even read their contracts properly. Arguing with them is just like arguing with primary school pupils.
These same miscreants threatening a court case against mba probably didn't comprehend or understand the clause in their contract which states that conflicts between them and the company would have to go through an arbitration process first and if not resolved, the courts will have the final say.
I just laugh at the foolery of some people here

The Contract is a civil one and the Arbitration clause only applies to civil matters. If a criminal matter arises, that clause is very useless and doesn't mean anything. That is the difference between Breach of contract, Fraud and OBT.

Once you report a case of fraud or financial crime to the Police, the police can approach a Magistrate court for an order freezing all bank accounts belonging to that company. Once the order is granted, the banks are compelled to comply.
The Police and the courts don't even give the company an opportunity to reply because the complaint is a criminal matter of fraud and informing the company would prejudice their investigations. So, the company doesn't know until they go to the bank and they can't collect 1 kobo. Even the bank won't know until they get the court order and they must comply immediately.

After bringing your facts and information, the Court may eventually lift the order, but after how many months? Can you wait for 5 or 8 or 13 months for the account to be unfrozen before collecting your money?

Sensible investors avoid litigation. Only ignorant ones see litigation and jump into it. MBA should not fall for that trick.

You guys should take a chill pill on all this talk of lawyer, court, sec etc. If old investors who have recovered their capital are talking like this, what do u want new investors like myself who invested heavily to do?

The mgt of the company has addressed investors and taken time to explain things. Please lets give them benefit of doubt for atleast the 1 month window they said (or 7 to 14 days from due date).

Dont plan with November ROI so as to avoid unnecessary apprehension/panic. Baba has said they will extend the contract just in case the ROI does not come in this month.

Abeg make una chill... My money still full MBA.

Thank you

I believe all these naysayers belong to a body or business who sees MBA has a big competitor/threat to their existing or upcoming business.

They think their plan to destroy another person's business will create room for their success.

Untrue. Very untrue.

One Special adviser was invited to a forum last year he knew not much about, was well fed and then propped up to give a rambling speech essentially saying not much except name checking MBA. It is not even related to his portfolio - he was almost sacked and has been advised to wind his neck in.

I wonder why some people daily prayers is that the worse should happen to MBA FX. You that is making that prayer or having that prospect, even your own life is not tolally safe. Jabolo and co are now jumping like frog, praying that MBA is coming to an end. Debating that they should freez MBA's bank account. These set of people are the typical SATAN we have in this life. They expect every body to remain in thesame position with them, if they don't have it nobody should have it. GOD WILL PUT YOU ALL TO SHAME!

It is all part of the game. On the 6th I tried to terminate my investment which expired on Nov 4th at the Lekki branch they told me it would take 3 weeks for me to be refunded. But the most annoying is that they would not start processing the termination until I produce the bank statement showing the last ROI,. Yet they have refused to pay the last ROI and no one could tell when the payment would come. I won't fold my arms and MBA would use various tactics to delay payments. I verily believe that the CEO will bail out, hence the deal with WCEP who incidentally deals in obtaining second citizenship. Everyone has to decide what is the best step to take. I am in PH now and will go terminate my investment at the Eliozu office on Monday though the contract expires in January. If I choose to terminate earlier, the clause 10 of the Contract expects me to give 30 days notice after which I will not be entitled to ROI. My 10th ROI was due Nov 9th and I know I am not getting payment any sooner.

Wcep has already sent the message cheesy
Maxwell should have like 3 to 4 passport by now with fat real estate portfolio around the world
Wcep a non existent travel kiosk with no reasonable
location and mgt acquiring a multi billion naira trading company. While the ceo. Hides as director and ready to exit anytime with vodina west .and people are smiling like all is okay

They dont even return capital any longer with multiple payment delays. If anyone is smart he will see the signs on the wall.
Paying 30 percent of pending payments and ignoring g the rest will set confusion among investors as they will keep hoping for their ROI till they give up and when they complain. The few ones who get paid will shout them down.

PLS LET ME ASK YOU THAT IS ASKING US TO RUN AWAY FROM MBA

1) DID WE BORROW MONEY FROM YOU TO INVEST?

2) PLS THE INVESTMENT NA OUR OWN OR YOUR OWN?

3) LETS EVEN SAY THAT WE FINALLY LOST THE MONEY WE INVESTED IN MBA, PLS NA YOU GO CRY?

4) WHY ARE YOU TAKING PANADOL FOR OUR OWN HEADACHE. OUR HEADACHE NA YOUR OWN HEADACHE?

IF YOU HAVE BRAIN, YOU WILL RETHINK AND KEEP QUIT INSTEAD OF FOOLING YOURSELF UP AND DOWN.

IF YOU HAVE A BUSINESS TO INTRODUCE BETTER DO IT AND YOU WILL FIND SOME THAT WILL FOOLISHLY FOLLOW YOU.

YOU PEOPLE ARE THOSE KIND THAT RUN PEOPLE DOWN TO GET NOTICED.

FINALLY, IF SERIOUS MINDED MBA INVESTORS WILL IGNORE SUCH PEOPLE AND ONLY COMMENT ON TALKS THAT HOLD WATER IT WILL BE FINE.

WE PRAY FOR A BETTER AND STRONGER MBA.
