...Court orders re-assignment of case to another lower court's judge The Court of Appeal sitting in Port Harcourt, Rivers State, has ruled that a former Governor of Bayelsa State, Senator Seriake Dickson, has a case to answer in a suit seeking to disqualify him from contesting the concluded Bayelsa West Senatorial election. The three-man panel of the court also disagreed with the Federal High Court’s decision to dismiss the matter saying the judgement of the lower court was wrong. The panel presided over by Justice U. Onyemenam, ordered the suit to be reassigned to another Federal High Court judge. The Appellant, Owoupele Eneoriekumoh, had through his lawyers, Pius Danba Pius and Ebikebuna Augustine Aluzu approached the Court of Appeal seeking to set aside the ruling of the Federal High Court sitting in Yenagoa. The court in Yenagoa presided over by Justice J. Inyang, had dismissed the case, but the appeal court on Thursday agreed with the appellant lawyers after faulting the judgement of Inyang. Justice Onyemenam held that the lower court dismissed the matter in grave error. Dickson, who had been sworn in at the National Assembly to represent the Bayelsa West, had been compelled by the judgement to go and open his defence at the Federal High Court. The Appellant is seeking Dickson’s disqualification and removal from the Senate. |

Nemere2020:Fergie,where are you? I saw this coming.justice Jane inyang deserves to be called a corrupt, rascalised and roguish judge.I knew the appeal court will disturb her useless ruling.. But after some thoughts,I feel that the appeal court made a mistake.they should not have sent the case back for retrial since the case is time bound and since Dickson did not file a no case submission.they should have gone ahead to look at the substantive matter and deliver judgment based on the merit.justice Jane inyang must be sanctioned by the njc,she's worse than okon abang...cc kahal,mosdii,bayelsaowei,obuksbayelsa,fergie,unigrad,cktheluckyman,aaa569, vicdom |

Dansuqi:You've said everything, the judgement by Justice Jane Inyang is an aberration to law. I don't see anything coming out from the case though Dickson is very much guilty of the allegations leveled against him. The Nigerian judiciary is the most corrupt organ of the Government. The judgement will still go his way because money must change hands. |

AAA593:Dickson will have to pay something in return for Lyon's loss one way or the other...the tribunsl case was never clearcut,it was neither here no here...for this one,it is straightforward.the judge is a hatchet lady for Dickson...theres a big case here,Dickson forged and fortunately when it concerns nass members,the supreme court dont shy away from quickly dispensing justice |

Dansuqi:Well...... technically, NO. NIMASA was petitioned by a Mr. Victor or so, that Stephen Odey (then a staff of NIMASA) had fraudulently swindled him to the sum of millions of naira. NIMASA suspended Odey and set up a disciplinary committee....he was queried and after his response was sacked, with no remuneration. Immediately he was sacked, the Nigeria Police charged him to a Magistrate Court but the petitioner refused to show up and the Judge discharged and acquitted him. Odey went ahead to the FHC that he be reinstated and paid his salary for the months he was suspended and subsequently sacked. The FHC concurred and said NIMASA's action had been estopped by the judgements of the Magistrate Court. NIMASA been unhappy went to the Appeal Court, with the Presiding Judge, Uzo-Anyanwu JCA disagreeing with the trial Court. NIMASA complained that Odey had been accused of gross misconduct which doesn't involve only taking money from anybody but also allegations of forgery etc. The Appeal Court agreed that whilst Odey has been acquitted, NIMASA is not under law to reinstate or pay him.
