On Tuesday February 9, 2010 the National Assembly empowered the then Vice President Goodluck Ebele Jonathan to serve as Acting President. This was done to resolve the constitutional breach by the ailing President Umaru Musa Yar'Adua who failed to send or transmit a letter to the National Assembly. He failed to hand over to his then Vice President Goodluck Jonathan in line with section 145 of the Constitution of the Federal Republic of Nigeria since November 23, 2009.

According to David Mark the then President of the Senate. The constitution never foresees a violation that will create a leadership vacuum we found ourselves since November 23, 2009. After the then Vice President Goodluck Ebele Jonathan was empowered to serve as the Acting President, the next thing he did was to dissolve the cabinet. He did this because most of the minister appointed by Umaru Musa Yar'Adua owned allegiance to Yar'Adua. Jonathan reconstituted his own cabinet.

On April 6, 2010, Goodluck Ebele Jonathan cabinet was formed. Umaru Musa Yar'Adua died on May 5, 2010. Goodluck Ebele Jonathan was sworn in as the President the next day. He appointed the then Kaduna State Governor, Namadi Sambo as his Vice President.
