Arbitrability simply considers whether or not a dispute can be resolved by arbitration. If the dispute is not Arbitrable, the arbitral tribunal is limited in its jurisdiction and the claim must instead be submitted to domestic courts.
The Arbitration and Conciliation Act doesn’t list issues that are not Arbitrable but there is a general limitation on issues which affect the legal status of persons. Disputes relating to crimes, interpretation of statues or the Constitution and issues specifically reserved for the sphere of domestic Courts under the national laws (e.g. political and economic issues) are generally non-Arbitrable.

The term was coined from the 1856 English case of Scott v. Avery. Chapter IV of the Constitution of the Federal Republic of Nigeria copiously sets out the fundamental rights donated to every citizen. These rights span from the right to life, speech, association to liberty, etc.
The Fundamental Human Right Enforcement Procedure Rules (FREP) allows persons to enforce their human rights through the court not only when such right is breached but even when reasonably perceived to be about to be breached.
The rules also allow public interest litigation, where a party not directly affected by a breach can sue in the stead of the actual person whose right was breached, in the interest of justice.
The suit is commenced in the Federal High Court or High Court of the State where the infringement occurred, by any originating process.
Note that there is no restriction on the time frame to bring fundamental rights suits.

On the 19th of January, 2019, the Corporate Affairs Commission via its twitter page announced the option of obtaining same day services for post incorporation. The effect of this is that post incorporation fillings, searches and other services can be applied for and gotten the same day, although with an additional cost. This is also reflected on the CAC official website and is pursuant to Regulation 7 of the Company Regulation, 2021.
The regulation states that the Commission’s Same-Day post-incorporation/registration service shall be available subject to the following –
(1) Receipt of the complete and competent application for the service not later than 1:00pm same day;
(2) Confirmation of payment of the applicable fee for the service not later than 1:00pm same day.
(3) Same-Day post-incorporation/registration service shall not apply to applications that would require inputs from any authority or organization at the instance of the Commission.
