If you are in the USA 🇺🇸, UK 🇬🇧, or Canada 🇨🇦 buying property in Nigeria from abroad, this is the most expensive mistake you can make. Many Diaspora HNIs pay ₦150M+ and still do not legally own their land. Why? They confused a Deed with a C of O. The difference is not grammar. It is law, and it determines if your investment is safe.

DANGER WARNING ☠️
A receipt and a survey alone will not protect you in court. Thousands of Diaspora buyers have lost properties because they stopped at "family agreement."

CAUTION ⚠️
Agents will tell you "C of O is in process." That phrase has cost buyers ₦50M in litigation. Process is not possession.

RED FLAGS 🚩
1. Only a Deed of Assignment is offered for a Governor’s Consent area
2. Seller refuses to show Gazette or approved Layout
3. "Omonile receipt" presented as final title
4. Pressure to pay 100% before documentation

THE LEGAL TRUTH: LAND USE ACT, 1978
Under Section 1 of the Land Use Act, 1978, all land in Nigeria is vested in the Governor. That means you cannot get absolute title from a private individual alone.

1. Deed of Assignment: Evidence of transfer between two private parties. Important, but not conclusive.
2. Governor’s Consent: Section 22. Mandatory. Without it, any sale or mortgage of land in a statutory area is void. This is your legal shield.
3. Certificate of Occupancy C of O: Section 5 and 9. The highest evidence of a statutory right of occupancy for 99 years. Bankable, transferable, and globally recognized.

10 KEY ACTIONS TO PROTECT YOUR INVESTMENT FROM ABROAD

1. demand to see the gazette and government approved layout first
No Gazette means no government backing. Get a certified true copy before any payment.

2. verify that the survey plan coordinates match the physical plot
Use an independent registered surveyor to do charting at the Surveyor General’s office.

3. insist on governor’s consent as a condition precedent in your contract
Your lawyer must state: "Balance payable upon evidence of Governor’s Consent application."

4. buy only in estates with government approved layout to avoid omonile
This eliminates community interference and guarantees infrastructure.

5. pay only to the company’s corporate bank account and collect an official receipt
Never pay cash. Never pay to a personal or "community" account.

6. collect all 5 documents: gazette, survey, deed, payment receipt, and consent
Treat them as your property passport. Send scans to your solicitor abroad within 24 hours.

7. book a complimentary virtual site inspection with live video and drone
We run weekly Zoom tours for USA, UK, and Canada clients. See the land before you commit.

8. reject family receipts and community agreements as final title
They are proof of payment only. Upgrade immediately to Deed + Governor’s Consent.

9. confirm who manages security, service charge, and estate regulations
Professionally managed estates protect asset value and prevent land grabbing.

10. register and obtain certified true copies within 60 days of execution
File at the Lands Registry. CTCs create a legal trail even from overseas.

REAL CLIENT STORY
A client in London paid ₦120M for "cheap" land in Ibeju. No Gazette. No Layout. We stopped the deal and moved him to a Governor’s Consent estate in Sangotedo. 8 months later, his documents are with his lawyer in the UK and his asset is secured.

Don’t let document confusion cost you your dream home. The window to buy bankable Lagos property at today’s prices is closing.

Properties › Why Omonile Disappears After Governor’s Excision — And Who Legally Replaces Them by RealtorMichael(op): 3:06am On Aug 28
Estate Guide Series 129 | Why Omonile Disappears After Governor’s Excision — And Who Legally Replaces Them

If you are in the USA 🇺🇸, UK 🇬🇧, or Canada 🇨🇦 buying land in Lagos, you have heard the name "Omonile" and the fear that comes with it. Here is the truth that will save you ₦20M in extortion: Once Governor’s Excision is published, Omonile legally disappears. The problem is most Diaspora buyers don’t know who replaces them, and that gap is where fraud happens.

DANGER WARNING ☠️
Paying "development levy" to Omonile after excision is illegal. You are funding extortion and weakening your title.

CAUTION ⚠️
"Excision in process" for 3 years is a red flag. Process without Gazette means the land is still under family control.

RED FLAGS 🚩
1. Seller demands payment to "youth chairman" after showing excision papers
2. No Gazette number or date on the excision document
3. Estate has no layout approval from the Ministry of Physical Planning
4. Refusal to issue corporate receipts and Deed of Assignment

THE LEGAL TRUTH: LAND USE ACT, 1978
Under Section 1 of the Land Use Act, 1978, all land is vested in the Governor. Section 28 gives the Governor power to revoke customary rights for public purpose and grant excision to original families.

When Governor’s Excision is published in the Official Gazette, customary rights are extinguished. Omonile loses legal authority. Who replaces them? The State Government, through the Ministry of Lands, and the Estate Developer/Company holding the approved Layout. From that day, all payments, approvals, and security must come through legal channels only.

10 KEY ACTIONS TO BUY EXCISED LAND SAFELY FROM ABROAD

1. demand the official gazette number, page, and date of excision
Verify it at the Ministry of Justice. No Gazette, no excision.

2. confirm the layout approval from the ministry of physical planning
This proves the government recognizes roads, setbacks, and infrastructure for the estate.

3. insist that all payments go to the developer’s corporate account only
After excision, any payment to "community" is extortion. Get an official company receipt.

4. ensure your contract references section 22 of the land use act for governor’s consent
This converts your allocation into a legal and bankable title.

5. collect deed of assignment plus allocation letter from the excision beneficiaries
These two documents, plus consent, form your legal chain.

6. book a complimentary virtual inspection with estate security and management present
We do live Zoom tours for USA, UK, and Canada clients every Saturday to show real site control.

7. verify that estate security is employed by the developer, not omonile
Professional security is the first sign that Omonile has been removed.

8. reject any request for "omo-onile levy" during construction
Report it immediately to the estate management and police. It is illegal post-excision.

9. obtain certified true copies of all documents within 60 days
File at the Lands Registry. This creates a public record that blocks future claims.

10. join the estate residents’ association for protection and updates
A structured association replaces community influence with corporate governance.

REAL CLIENT STORY
A client in Canada paid ₦18M "Omonile fee" after excision was published. We intervened, traced the Gazette, and stopped further payments. His estate management refunded part of it and issued a formal warning letter. Today his title is clean.

Omonile thrives on ignorance. Excision ends their power. But only if you act with the right documents.
