EXPOSED: How Rotimi Amaechi Procured Appeal Court Judgements On Rivers National Assembly elections. Reports have emerged as to how the controversial judgement of the Court of Appeal on the National Assembly Elections Petitions of Rivers State which nullified all elected National Representatives of the PDP in Rivers State was procured by the Minister of Transport and former Governor of the State, Mr. Chibuike Rotimi Amaechi. Based on available evidence, between the 9th and 10th of December, 2015, prior to the delivery of the controversial judgment, the Abuja home of the former Governor repeatedly hosted the Chairman of the Court of Appeal Panel on Rivers State National Assembly Election, Hon. Justice A. B. Gumel, of the Court of Appeal Ibadan Division. During the visits, the Hon. Justice Gumel was at all times in the company of a renowned Senior Advocate of Nigeria of North Eastern extraction, who himself is a confidant of Mr. Amaechi and the conduit by which he had been ferrying huge sums of money to induce Justices and assure them of promotions being the Chief financier of the All Progressives Congress (APC). Justice Gumel was appointed to superintend over the Rivers State National Assembly Elections Appeal Panel by the President of the Court of Appeal, Justice Zainab Adamu Bulkachuwa, wife to a founding member of both the CPC and the APC, Alhaji Adamu Bulkachuwa. Justice Bulkachuwa, since the commencement of sittings of the Election Petitions Tribunals has come under severe national criticism over what many term her Pro-APC leaning. In a particular instance, in Calabar of Cross River State, anti-Bulkachuwa protesters who carried placards and green leaves, dumped an empty coffin in the front of the tribunal venue, singing and shouting anti-tribunal and anti-Bulkachuwa slogans around the casket. The protesters said they were expressing their displeasure at the manner in which the National/State Assemblies Election Petitions Tribunal (Panel 1) was “deliberately” constituted to ensure that the petitions against the Peoples Democratic Party (PDP) candidates never got justice. The rejectionists were of the Cross River State Diocese of Wesley Synod International African Foundation, and the Cross Rivers State Chapter of the College of Clergies in Politics. They protested “alleged crafty and wicked legal academic blunders” perfected during the tribunal’s six months sitting in Calabar and called for the cancellation of all illegalities. It is the same crafty and legal blunders that have also characterised the judgment of the Court of Appeal in the Rivers State National Assembly Elections Petitions appeal in which the elections of members of the National Assembly from Rivers State who were elected on the platform of the Peoples Democratic Party (PDP) were annulled on the basis of noncompliance with the electoral guidelines, chief among which was the non- use of the controversial card readers. It would be interesting to note that the same Court of Appeal in the case of Agbaje vs. Ambode and in a well-reasoned judgment delivered by Justice Obande Festus Ogbuinya held thus: “The extant Electoral Act (2010) which predates the concept (of card reader) is not its parent or progenitor. Since it is not the progeny of the Electoral Act, fronting it as a ground to challenge any election does not have its (the Electoral Act’s) blessing, nay Section 138 (1) of it. Put simply, a petitioner cannot project the non-presence or improper use of smart card reader as a ground for questioning an election. It does not qualify as one.” On the strength of the aforesaid, and without it adducing any basis founded in law to sustain its position, it then follows that with the position of the Justice Gumel led appeal panel, the Court of Appeal has been dragged down the slippery slope of judicial partisanship and veered off the hallmark and import its sworn duty to administer justice without fear or favour. Many jurists, lawyers and citizens have expressed worry over the fact that almost all tribunal judgments in PDP controlled States, especially in the South-South, have been reasonably skewed to undermine clear provisions of the law and for the benefit of the APC. Apart from the established discrepancies and conflict of judgment within the same Court of Appeal on the issue of the non-use of Card Readers, the Bulkachuwa led Appeal Court, which constituted the Tribunals is also faced with conflicting positions on the issue of 21 days compulsory notice to the Independent National Electoral Commission before the conduct of any Primary Election as mandated in S. 85(1) of the Electoral Act 2010. S. 85 (1) of the Electoral Act 2010 provides as follows: “A registered political party shall give the Commission at least 21 days notice of any convention, congress, conference or meeting convened for the purpose of electing members of its executive committees, other governing bodies or nominating candidates for any elective offices specified under this Act.” The fundamental basis for nullifying Darius Ishyaku’s election of Taraba State was that Peoples Democratic Party (PDP) didn’t comply with Section 85 of the Electoral Act, 2010, in notifying the Independent National Electoral Commission of its primaries. But on the same issue, the Appeal Court ruled differently in the appeal brought by the APC against the PDP National Assembly Candidates in Rivers State claiming that a notice served before a change in date for the Primary and without another notice served to INEC of the new date, amounted to a proper notice of the new date. Where in the world does that happen? Does this action by Justice Gumel not amount to toppling the law and turning it on its head in every material particular, and writing a judgment that is legally laughable and in the service of his President, Justice Bulkachuwa, wife to an APC chieftain, Adamu Bulkachuwa and Rotimi Amaechi, the chief financier of the APC, rather than to serve the cause of justice? Does the fragile polity deserve the combustible heat being generated by the judiciary and by effect the APC? What good does it serve to continuously dash the confidence of the people in democracy? Why should the judiciary make itself the tool to undermine justice and democracy? Are the authorities deaf and dumb and blind to these atrocities? Why do we have sacred cows who weigh down the judiciary with the burden of their corrupt practices and undermine the progress of our democracy? Why does the Adamawa-born SAN, who has been serially manipulated in countless corrupt deals within the judiciary continue to go scot free? Is he higher in rank or superior to the SANs who have been debarred in the past for conducts such as his? Is this the new face of the judiciary where anything goes; the hallmark of the so-called anti-corruption government? Nigerians around the country and diplomats alike expressed disappointment with rewarding Mr. Amaechi with a ministerial appointment in spite of his being a man burdened with corruption and having cases to answer in court. With the inducement of Judges, right inside his home, the Minister for Transport has elevated the art of corruption to statecraft. What remains to be seen is a decisive action by the President to distance himself from such actions rather than endorse them with his silence. Justice Gumel is already pestering the Court of Appeal panel empaneled with the Appeal of Governor Wike and the Rivers State House of Assembly to undermine the cause of justice. How far will this riotous deviation from the norm be allowed to go? Why is the Nigerian government deliberately creating an atmosphere in which the people themselves in upholding democracy should find themselves in a situation where they are faced with the choice of resorting to self-help? Never in the history of Nigeria have we had a challenged judiciary as we currently do; and, in truth, the challenge to self-correct and remedy itself is entirely its and to its advantage. In the entire travesty that Nigeria has become, one thing has become clear, in rewarding corruption as in the case of Mr. Chibuike Rotimi Amaechi, he has been empowered to expand on his enterprise and the unfortunate consequence is that this path can only lead to the destruction of our most cherished values as a people if allowed to fester. I never stole Nigeria’s
money –Alison-Madueke

A former Minister of Petroleum Resources, Mrs.
Diezani Alison-Madueke, has said she did not
use her position to steal Nigeria’s money.
Alison-Maduekwe, who looked frail told the
Publisher of Ovation Magazine and TheBoss
Newspaper, Dele Momodu, said she performed
her duties to the best of her knowledge and
abilities.
Alison-Madueke was recently arrested by
officials of the National Crime Agency, United
Kingdom over suspected money laundering
activities.
The former minister had been alleged to have
used her position as minister to steal billions of
naira from the country’s coffers.
In June 2008, Alison-Madueke was subject to a
Senate probe after it emerged that as
Transport Minister she had paid N30.9bn
($263m) to contractors between December 26
and 31, 2007. She is said to be worth over N1bn.
However, she has never been officially charged
or tried for these allegations and has strongly
denied any wrongdoing. She was alleged to have
spent billions of dollars inappropriately on
private jets and responsible for some missing
$20bn.
She is also widely accused of reckless spending
of government funds.
In October 2009, the Senate indicted her and
recommended prosecution for the alleged
transfer of N1.2bn into the private account of
a toll company without due process and in
breach of concession agreement.
However, the allegations have never been taken
to law, and the former minister had
maintained innocence.

The Federal Government may have spent about
N5.8bn on the 10-aircraft Presidential Air
Fleet it inherited from the former President
Goodluck Jonathan’s administration, findings
by Saturday PUNCH have shown.
The PAF is the third largest fleet in the
country, coming after Arik Air and
Aerocontractors Airlines which have 23 and 12
aircraft in their fleets respectively.
Other domestic airlines including FirstNation,
MedView Airlines, Dana Air, Air Peace and
Overland Airways have less than 10 aircraft
each in their fleets.
According to calculations done from estimated
data obtained from aviation parastatals and
domestic airline operators in the country,
President Muhammadu Buhari’s administration
will have spent about $58.58m (N11.598bn) on
running and maintaining the 10-aicraft
presidential fleet by May 29 next year when it
turns one year in office.
This means that the half of this amount,
$29.29m (N5.799bn), is expected to have been
spent in principle on the large fleet when
administration turns six months in office by
November 29.
According to findings, the PAF contains two
Falcon 7X jets, two Falcon 900 jets, one
Gulfstream 550, one Boeing 737 BBJ (Nigerian
Air Force 001 or Eagle One), and Gulfstream
IVSP.
Others are one Gulfstream V, Cessna Citation 2
and Hawker Siddley 125-800 jet.
Each of the two Falcon 7X jets were purchased
in 2010 by the Federal Government for $51.1m,
while the Gulfstream 550 costs $53.3m, a
former Minister of Information, the late
Professor, Dora Akunyili, had said.
The factory price of other aircraft in the fleet
could not be obtained online. However, airline
CEOs put the average price of Falcon 900 at
$35m, Gulfstream IVSP at $40m, Gulfstream V
at $45m, Boeing 737-800 (Boeing Business Jet)
at $58m, Cessna Citation at $7m and Hawker
Siddley 125-800 at $15m.
This brings a combined estimated value of
Nigeria’s PAF to $390.5m (N77.319bn).
According to airline chief executives and
industry experts, airlines spend between 15 and
20 per cent of the cost of an aircraft on its
operation yearly. They say that averagely, a
little less than one-fifth of the cost of the
plane is spent every year on insurance, flight
and cabin crew, maintenance, fuelling,
catering and training.
Using the least figure of 15 per cent, it means
that about $58.58m (N11.598bn) will be spent on
the presidential fleet (which is valued at
$390.5m or N77.319bn) when the new
administration turns one year by May 29 next
year.
Apparently, by November 29 when it turns six
months in office, about half of this amount
($29.29m or N5.799bn) should have been
budgeted for the running and maintenance of
the planes.
According to the Nigerian Air Force’s website,
the PAF’s current staff strength consists of 47
NAF officers, 173 airmen/airwomen and 96
technical and administrative civilians.
“The operational headquarters of the fleet is
located at the presidential wing of the Nnamdi
Azikiwe International Airport, Abuja, while the
administrative personnel are at the federal
secretariat. The fleet has a liaison office at
the Presidential Villa. Flight operations,
training, aircraft maintenance and general
running of the fleet are funded by the
Presidency,” according to the website.
Nigeria happens to be one of few countries of
the world with a large PAF.
Most major countries in Europe and Asia
maintain two aircraft in their PAF, according
to Wikipedia .
According to the online portal, Japan
maintains only two Boeing 747-400 planes in its
PAF.
The two aircraft, mostly for the prime minister,
the emperor and his wife, and other members
of the Imperial Family, is operated by the
Japan Air Self-Defence Force.
The aircraft were constructed at the Boeing
factory at the same time as the United States’
Air Force One. Both Japanese aircraft were
delivered in 1990.
Wikipedia also states that the Netherlands
government operates only two aircraft, a
Fokker 70 and Gulfstream IV to transport the
Dutch Royal family and government officials
such as the Prime Minister and other ministers.
They are also used for international
conferences and for private trips by the Queen
and the Prince of Orange. For long haul trips,
the Royal Dutch Airline is used. Often the upper
deck of a Boeing 747 is used.
The Queen of England and the Prime Minister,
David Cameron, often go on British Airways
chartered flights for long trips. Cameron was
recently criticised by the United Kingdom
media for chartering a foreign plane instead
of a British.
According to Wikipedia, the Royal Squadron of
the Royal Air Force maintains a fleet of Agusta
A109 helicopters, BAE-125 mid-sized business
jet and BAE-146 regional airliner to support
short travel by the Royal Family, the Prime
Minister and senior members of the British
Government.
Countries like Ghana, Algeria and a host of
others in Europe maintain only one aircraft in
their PAF.
A few weeks after his inauguration, Buhari had
reportedly ordered the immediate disposal of
some of the planes in the PAF.
However, the Senior Special Assistant to the
President on Media and Publicity, Garba Shehu,
later denied knowledge of such directive.
“The story of the order for the sale of aircraft
in the Presidential Fleet, about which so much
interest is being expressed, is not known to us,”
Shehu said.
The exact size of the PAF is treated as
classified information and aviation sources
believe the aircraft in the fleet is about 16.
Chief of the planes in the fleet is the Boeing
738 BBJ, NAF 001 or Eagle One, used by the
president for his travels.
With its luxury configuration comprising a
master bedroom, washrooms and showers, a
conference and dinning area, and a living
area, the plane seats 25 to 50 passengers and
would cost at least $100m to replace.
Eagle One can spend 12 hours in the air,
covering 11,489 kilomtres or 6,200 nautical
miles.
Apart from the Eagle One, the fleet boasts of
Gulfstream 550 jet. The Gulfstream 550 can
seat eight to 18 passengers, depending on the
configuration, and has a cruiser range of
12,501 kilometres or 6,750 nautical miles.
There are reports that Buhari may also order
the sale of about 25 aircraft owned by
ministries, departments and agencies.
These include Nigeria Customs Service, which has
four aircraft namely two Bell helicopters, one
Dornier 228 and one Cessna Citation private jet;
the Nigerian Police Force, which has 10
helicopters and one Cessna Sovereign private
jet; and the Nigeria Immigration Service, which
has six aircraft that are being used for border
patrol.
Others are the National Emergency Management
Agency, which has four helicopters and one
Cessna Encorprivate jet; the Ministry of
Aviation, which has a Hawker Siddley
calibration jet that is not being used; and the
defunct Power Holding Company of Nigeria
which has six German-made helicopters that
are no longer serviceable.
Aviation experts said there was need for Buhari
to reduce the size of the PAF.
The General Secretary, Aviation Round Table,
an industry pressure group, Group Captain John
Ojikutu, said Buhari needed to reduce the PAF
and sell aircraft belonging to most of the
MDAs.
A former Assistant General Secretary, Airline
Operators of Nigeria, Mr. Muhammed Tukur,
also said the aircraft could be sold to both
airline operators and private individuals who
could use them for commercial purposes.
He said that this could generate more revenue
and create jobs.

Defence Minister Re-opens Old Wounds, Chides Mimimah over Buhari's Certificate Minister of Defence, Brigadier General (rtd) Monsur Dan-Ali *Says December deadline to end Boko Haram on course By Senator Iroegbu and Adebiyi Adedapo in Abuja; Michael Olugbode in Maiduguri The new Minister of Defence, Brigadier General (rtd) Monsur Dan-Ali on Friday stirred up a hornet's nest by remarking that the immediate past Chief of Army Staff (CoAS), Lt-Gen. Kenneth Minimah (rtd) and the Nigerian Army under him did not show respect for President Muhammadu Buhari during his WAEC certificate controversy before the 2015 general election. Dan-Ali, who assumed duties at the Ministry of Defence (MoD), Abuja, began his tenure on a note many regarded as controversial by opening old wounds concerning the Buhari certificate crisis without backing it up with facts. The new Minister of Defence told the officers at the MoD: “Where is your integrity when your own Chief of Army Staff (Minimah) stood up and said his Commander-in-Chief of the Armed Forces (sic) has no WAEC. How? Please let us be sincere with ourselves. Because you should have stood up and said ‘no’; because you were there, you could not. If you leave the job, is it the end of your life? If you leave the job there are other ways; better ways God can bless your life." During the heat of the certificate crisis preceding the 2015 elections, Buhari claimed that his original WAEC certificate was with the military authorities. But the military denied it. Dan-Ali also said President Buhari was a man of integrity who had clearly and openly shown that he was ready to fight insurgency in Nigeria. To this end, Dan-Ali urged the officers and men of the armed forces to imbibe the spirit of integrity, honesty and transparency in their work, which he noted, is the hallmark of excellent leadership. "Gentlemen, the military is all about leadership. The President is a military man and he had shown leadership. Whether you like it or not, the President is a military man and he has shown leadership. We, the followers must show leadership. And what is leadership if I may ask? Leadership is all about integrity, honesty and transparency. "There cannot be a good leader without these three things. You cannot be a good leader if you do not have integrity. You cannot be a good leader if you don’t have honesty, so also, transparency. Forget about corruption. Corruption can never come near you if you have these qualities. So gentlemen, we should imbibe these three qualities," he said. Speaking further, Dan-Ali promised to improve military welfare, and as well as resolve the nagging troops rotation problem, especially those involved in counter-terrorism and counter-insurgency operations against the Boko Haram in the North-east. He frowned at the situation where some officers and men had been deployed to the conflict zones for years without being replaced and directed that no personnel should be allowed to stay in a conflict zone for more than one year. "On troops rotation; gentlemen, let's not take it as a joke. If the Chief of Army Staff is deployed in the front without seeing his family, how would he feel? So also the soldiers you are sending there? Please for God sake, let's make it maximum, one year. I will ensure that it is my cardinal principle that no soldier… unless, it is not possible, exceeds the maximum of one year," he said. In a related development, the minister called for accountability in procurement of arms and as well as cooperation amongst different military services and other security agencies. Dan-Ali also stated that the changes in strategy introduced by the Buhari administration had ensured that the terrorists are defeated well ahead of the December deadline. "The APC has promised even before the coming of the Buhari administration that they would fight insurgency. The terrorists are on their way out. Even before the December deadline, they would be routed. I am not in doubt that Nigerian soldiers are the best and among the best in the one," he said. Earlier, the Chief of Defence Staff (CDS), Gen. Abayomi Olonisakin, who spoke on behalf of other Service Chiefs, described the appointment of the new Minister of Defence an inspiring "home-coming" Military repels Boko Haram in Gwoza… It also emerged yesterday that Boko Haram terrorists attacked Gwoza town, in southern Borno State but were repelled by the troops of Nigerian Army. Addressing a press conference in Maiduguri, the Media Coordinator of Operation Lafiya Dole, Colonel Tukur Gusau said the terrorist group despite their obvious losses made "a desperate but costly attempt to attack Nigerian Army in Gwoza.” Gusau said: "The encounter which started at about 5.00am lasted for almost two hours. Although details are still being collated, suffice to state that seven terrorists were gunned down and the following weapons recovered; 1 Toyota Hilux vehicle, 11 AK-47 rifles, 1 Shilka Gun, 1 Rocket Propelled Grenade Tube, 6 Hand Grenades. Others include several rounds of Shilka Gun and Machine Gun ammunitions. "Troops are at present on hot pursuit of the attackers who fled into Sambisa forest with a view to eliminating all of them while the Nigerian Air Force is bombarding their locations." He said the Boko Haram terrorists’ ability as a coherent fighting force had been degraded over time by troops through relentless attacks, patrols and aerial bombardments. Gusau said: "The desperate attack today (Friday) was a failed attempt to project an image of strength. It is part of the last struggles of a dying evil." The spokesman also revealed that troops of 7 Division Garrison and 112 Task Force Battalion on Thursday while on fighting patrol recovered weapons in Busheshe village in Mafa axis of Borno State. He revealed that the weapons recovered include two Hillux vans, two anti- aircraft guns, three 81-millimeter bombs, 101 60-millimeter bombs and twenty ammunition boxes. Also recovered were 20 rocket professed guns, large quantity of 7.62 millimeter special ammunition and cache of different calibre of ammunitions. He lamented that during the operations, one soldier was wounded but in a stable condition and currently in the hospital receiving medical care. Dambazau promises to act with speed… Also yesterday, the newly appointed Minister of Interior, Lieutenant General Abdulraman Dambazau (rtd) promised to swing into immediate action to ensure relative internal security in the shortest possible time. The minister also said that Nigeria must do away with the state-centric security approach and adopt a people oriented human security approach. Dambazau stated these Thursday evening in Abuja, at his inaugural meeting with directors in the ministry and Service Chiefs of para- military organisations under the ministry.
