An APC House of Representatives member and one of the foremost advocates for the enactment of the Administration of Criminal Justice Act, Mr. Kayode Oladele has said that the new criminal justice administration bill will help expedite criminal cases and assist the Buhari Administration in its fight against corruption and terrorism.

Describing the new law as very progressive, timely and in conformity with international best practices, Oladele said that by far the most important part of the law are the sections dealing with the expedited hearing and speedy dispensation of criminal cases. According to Oladele, who was the immediate past chief of staff at the Economic and Financial Crimes Commission (EFCC), apart from the fact that the new legislation has abolished the dichotomy that presently exists between the Criminal Procedure Code (in operation in Northern Nigeria) and the Criminal Procedure Act (in operation in Southern Nigeria), by repealing both Acts, the new Act will root out malignancy of delays in the criminal justice administration in Nigeria.

In his words, “the repealed criminal justice administration laws were very primitive and represented relics of colonial legislation that dealt with situations as they existed then, hence, many people currently manipulate the system to achieve their personal objectives at the expense of the state. These laws were therefore, unable to cope with contemporary challenges in Nigeria particularly considering the provision of Section 36 (4) of the 1999 Constitution as amended which states that whenever any person is charged with a criminal offence, he shall, unless the charge is withdrawn, be entitled to a fair hearing in public within a reasonable time by a court or tribunal. So what the new Act has done is to amplify the provision of the constitution to ensure speedy dispensation of justice and I think this is very commendable as justice delayed is justice denied. Perhaps, the only beneficiaries of the slow dispensation of justice under the old criminal justice system were the money bags and powerful public officials”.

“When I was at the EFCC, one of our challenges then which is still a major challenge to the work of the EFCC is the slow pace of criminal justice administration in the country. Powerful individuals standing trial for corruption cases often drag cases for years to the point that hearing becomes unlikely let alone conviction. These protracted cases have led many accused persons standing trial for corruption and related offenses to contest and win elections into very sensitive positions in the country with many of them enjoying immunity from prosecution. What this means is that the new Act, if properly implemented without introducing the Nigerian factor into it, will ensure speedy trial of corruption, financial crimes terrorism and narcotics cases which will ultimately prevent unscrupulous people from manipulating the system to their advantage”, Oladele commented.

Speaking on the establishment of the central criminal records registry which is one of the highlights of the New Act, Oladele stated that the central criminal records registry system established in Part 2, Section 16 of the Act will serve as an authentic database of all offenders in the country. This according to him is to present a comprehensive criminal history of people and it will help the police and other security agencies in the country including employers of labor to conduct quick criminal record checks of offenders or persons seeking employment.

In conclusion, the international lawyer who is representing Yewa North/Imeko-Afon Federal Constituency in the 8th National Assembly while commending the Nigerian Judges for their hard work even under such harsh conditions, urges the Judiciary to embrace continuing legal education and also update their practice directions in line with the new legislation so that cases are handled more efficiently and speedily.

A civil rights organisation, Independent Service Delivery Monitoring Group, has called on President Muhammadu Buhari not to assent to the amended Tertiary Education Trust Fund Act, 2010, which included the Nigerian Law School as one of the agencies that would be benefiting from its services.

The organisation warned that presidential assent to the bill would dilute the functions of TETFund and drag his government into an unprecedented and unwanted industrial crisis.

The group described the bill as “a self interested proposition” by a former chairman, House of Representatives Committee on Legal Matters, Ali Ahmed.

The Executive Director of ISDMG, Dr. Chima Amadi, and Director, Babatunde Oluajo, at a press briefing in Abuja, wondered how the NLS, an institution for the licensing of lawyers in Nigeria which is owned by the Council of Legal Education, can be a beneficiary of the TETFund.

Amadi said, “TETFund is supposed to be an interventionist agency but amending the law and making it universal is going to dilute its function while its impact may not be felt. Several organisations and state governments will come up and will over-burden the agency and the impact will be very minimal.

“We will embark on cost-effective means to stop the passage of the bill into a law. Assenting to the bill will be sending us 10 years backwards. We appeal to President Muhammadu Buhari not to assent to this bill for the simple reason that it is not only counterproductive, but will drag this government into an unwanted industrial crisis.

“The fact that the bill was rejected in 2012 by all stakeholders and unions is a pointer to its non-acceptability by these unions and civil society organisations.

“The most bewildering aspect of the amendment is the explanatory memorandum. Once this is allowed to stand, it will take us back to the old Education Trust Fund era which was restructured owing to the limitation brought on her activities as a result of interventions in too many institutions.

“This law will bring about the proliferation of institutions which will negate the change from ETF to TETFund and that change, being a discussion at the Federal Executive Council under President Yar’Adua which proposed that an Executive Bill be sent to the National Assembly, which was passed and then sent to President Goodluck Ebele Jonathan for his assent.

The ISDMG reminded Buhari that as the head of the Petroleum Trust Fund, the danger of allowing PTF to intervene in every activity of the government only whittled down the impact of the intervention.

The group queried if the legislators have paused to reflect on the wider implication of allowing the amendment to stand, especially in the face of several other institutes that regulate and licence professionals, such as the Institute of Chartered Accountants of Nigeria, the Teachers Registration Council of Nigeria, the National Teachers Institute, the Council for the Regulation of Engineering in Nigeria, the Architects Registration Council of Nigeria and the Medical and Dental Council of Nigeria.

“This may just be the opening of the flood gate since they are all established by law. Let us state here that the TETFund has supported the training of lawyers through wholesale construction of faculties of law, equipment of law libraries, moot-courts and training of law lecturers.”

Vice President Yemi Osinbajo on Thursday reiterated the present administration’s commitment to fighting corruption.

Osinbajo said this in Lagos at the 3rd Annual Christopher Kolade Lecture On Business Integrity.

Speaking on the topic “Beyond Compliance: Imbibing A Culture of Business Integrity”, it was not possible for anyone without integrity to still have integrity in his business.

“Integrity must reflect in behaviour, it is an accepted standard,” he said.

Osinbajo said that the vision and mission of the present administration was to give meaning to the life of every Nigerian.

The vice-president said that the decision to fight corruption was in the interest of Nigeria and Nigerians.

In his remark, Dr Christopher Kolade lamented that Nigerians had almost resigned their fate to dominance of corruption in all sections of the nation’s life.

“If we look at our society today, we have almost resigned to corruption.

“The world would be a better place if everyman can stand for integrity.

“Integrity is something that is meant to be natural to human being but with the situation of the country, it is hard to practise integrity,” he said.

Kolade, however, said that it was possible to be a man of integrity to still get to the top.

A former President, Chief Olusegun Obasanjo, has called on Nigerians to celebrate themselves at all times.

He said this on Thursday in Abeokuta at a ceremony organised in honour of His Lordship, Josiah Odowu-Fearon, on his appointment as the Secretary-General of the World Anglican Communion.

Obasanjo said Nigerians should not wait for outsiders to celebrate them, adding that Nigerians have always been celebrated from people outside the country.

He said, “We should celebrate ourselves all the time. Nigerians have always been celebrated by outsiders. We should try to honour ourselves like what we are doing here today.”

Fearon, who said his relationship with the former President dated back to the 70s, also urged Nigerians to shun anything that could endanger the unity of the nation.

While he described Obasanjo as a true national leader, Fearon called on Nigerians to shun religious violence and emulate the former President who though a Christian, built a mosque at his presidential library complex, in Abeokuta.

Also calling on Nigerians irrespective of religion to embrace one another, he stressed that “we serve only one God with different approaches.”

He urged the Yoruba in the South-West to teach their northern counterparts how people of all faith should live in harmony.

He, however, advised Nigerian youths to emulate Obasanjo by cultivating the culture of reading, who he noted, would soon complete his Ph.D programme.

The dignitaries at the event include Ogun State Deputy Governor, Mrs. Yetunde Onanuga, Cardinal John Onaiyekan, Senator Tunde Ogbeha and a presidential aspirant of All Progressives Congress, Sam Nda-Isaiah.

Banks’ chief executive officers have called for further devaluation of the naira and restoration of liquidity to the foreign exchange market.

Key players in the banking and oil and gas sectors have also raised the alarm over the “disappearing” flow of funds into the banking sector as well as another round of fuel scarcity in the country.

The concerns were expressed on Thursday in Lagos at a conference, where the Chief Executive Officers of First Bank of Nigeria Limited, Zenith Bank Plc, UBA Plc, Mobil Oil Nigeria Plc, Seplat Petroleum Development Company Plc and Oando Plc were panellists.

It was at the CEO roundtable organised by Bloomberg and the Nigerian Stock Exchange.

The Group Managing Director/CEO, First Bank of Nigeria Limited, Mr. Bisi Onasanya, said the banks could not support the naira at the present artificial level of less than N200 in the official market, calling for further devaluation of the currency.

He said, “It is not sustainable, and the longer we continue to hold unto this, the more we send signals to the international market that we are not serious as a country.

“There has to be some adjustment in the present level of the naira. There has to be a re-opening of the market for activities to continue in the market otherwise, the economy will be at a standstill.”

The Group Managing Director/CEO of UBA Group, Mr. Phillips Oduoza, who was represented by the bank’s Executive Director, Treasury and International Business, Mr. Femi Olalokun, also indicated that there should be a little bit of adjustment in the currency given the current situation, stressing the need to diversify the economy, broaden the base of income and restore liquidity in the foreign-exchange market.

“I think we need to increase the rate of interest for funds to come in,” he said.

The First Bank boss also said the Nigerian economy was contracting owing to the decline in oil revenue, which account for about 85 per cent of foreign exchange and from which the totality of the country’s import bills are financed.

Noting the decline in the country’s Gross Domestic Product to 3.8 per cent in the first quarter of this year, he said, “This has signalled that the economy is contrasting and mainly as a result of dwindling government revenues.

“So, you can’t take the banking sector out of that equation. I believe very strongly that this will impact deposits in the market, the volume of deposits in the market and the rate at which funds can come into the system.

“Savings rate will slow down. Funds that come into the purses of various states today are barely enough to meet their overheads; 18 states today are defaulting in the payment of salaries. So what does that tell you? The flow of funds into the banking sector that used to help in accretion of deposits to fund the real sector of the economy has slowed down, if not disappeared.”

Onasanya said he was not surprised that the Central Bank of Nigeria decided to average out the cash reserve requirement between the public and private sector deposits, because in reality, public sector deposits had disappeared from the market.

“The reality is that we have a contracting economy; we have an opportunity, however, to see this as a process to start looking within and rebuilding the Nigerian economy from the basis,” he said.

On his part, the Group Managing Director/CEO, Zenith Bank Plc, Mr. Peter Amangbo, said, “The major challenge we are facing now is having the availability of this foreign exchange to foot the country’s import bills.

“When you have challenges like this, what you find is that the issue of confidence comes in. People are scared, and the next thing you see is panic. Almost everybody has rushed out; everybody wants to buy foreign exchange, and you see quite a lot of backlog that we have in the system now.”

On their part, oil industry players, including the Chairman and Managing Director of Mobil Oil Nigeria Plc, Mr. Adetunji Oyebanji; Chief Executive Officer of Seplat, Mr. Austin Avuru; and Group Chief Executive, Oando Plc, Mr. Adewale Tinubu, all stressed the need to deregulate the downstream sector of the industry.

Avuru, however, warned that fuel scarcity might resurface in the next three weeks if the government did not have enough money to pay for subsidy.

“We have a little respite now because some people that owe government some money are bringing in ships. In another three weeks, we will be back to scarcity because we simply do not have the money to pay this subsidy and therefore no banks will give these people money."
