One of the interesting facts about Real Estate in Nigeria is that the LAND USE ACT 1978, CAP L5, LFN 2004 governs all Real Estate dealings in the country. The Government is not unmindful of the difficulties associated with acquiring lands and landed property and has gone ahead to make laws to regulate, oversee and supervise the sale, lease and ownership of lands in Nigeria.
The most significant thing about the LAND USE ACT 1978, CAP L5, LFN 2004. is that it vests all the land in each state in Nigeria to the Governor of the State to hold in trust and Federal lands to the President. As a trustee to all the land, the Governor/President becomes the overlord while the original exclusive owners technically become tenants. (Section 1 Land Use Act)

Letter of Allocation: A letter of allocation is issued either by the President or Governor in respect to lands in the state or Federal Lands within the control of the above authorities. Note that upon the receipt of the Letter of Allocation, the owner is required to apply for the Certificate of Occupancy.

Certificate of Occupancy: A Certificate of Occupancy (C of O) is issued by the State Government to officially lease the land to the applicant for 99 years. The Certificate of Occupancy recognizes the right of the holder as the legal owner of the property and it can only be issued to ONE person.

Deed of Assignment / Registered Conveyance / Governor’s Consent : After the Deed of Assignment has been exchanged between both parties, it has to be recorded in the land registry to show legal proof that the land has exchanged hands and for the public to be aware of the transaction. Such recorded Deed of Assignment come in the form of either a GOVERNOR’S CONSENT or REGISTERED CONVEYANCE.
Governor’s consent can be applied for and obtained multiple times, as many times as possession of such land is being handed over to multiple purchasers over time.

Excision & Gazette: Excision is therefore the process by which the government releases a part of already acquired land to the natives or indigenes of the area. That is why it is also called “Village Excision” and given to a community and not a person. A Gazette is an Official record book where all special government information are spelt out, detailed and recorded.
