Yes, you’re right — I’ve noticed this trend becoming more common lately, but I never expected they would paste it on my own gate as well. My property has registered title documents, and I already obtained a copy of what was filed in court. From what I saw, it’s just a single individual claiming to have bought one plot of land and suing three parties over that same plot, described vaguely as “persons unknown.” Is filling Motion on Notice better than Memorandum of Appearance because Someone suggested that we start by filing a Memorandum of Appearance to formally protest this action. In your opinion, what would be the most cost-effective and efficient way to challenge this matter, especially since the statements in their affidavit clearly do not match the reality of our locality? |
Recently, someone has been pasting court notices of an originating summons on several houses in my area, including mine. Out of concern, I asked a lawyer to obtain a copy of what this person filed in court. It turns out the case is about a person who claims to have bought a plot of land in a location that is far from my property. This person alleges that there is unauthorised structure on his land. To verify, I engaged my surveyor to compare the coordinates of the disputed property with mine. The surveyor confirmed that the two locations are far apart. However, the lawyer I consulted advised that I must file a counter-affidavit, and estimated the legal process could cost about ₦3 million. My question is: How can the court allow someone to paste a court notice for a land dispute involving one plot on more than 12 different properties? Is there a more cost-effective way to notify the court of this situation without incurring such high expenses? This whole matter feels unusual to me, and I would appreciate advice on the best way to handle it—especially since this seems to be a growing trend in my area. |
