It is an unfortunate thing that happens every now and then. The sad thing is that, it has put some unsuspecting persons in the most vulnerable situations you may think about. Some unsuspectingly signed off their own properties while some spent a lifetime in the pool of litigation and others are in the middle of heated court proceedings over this.
My steps are simple, legally sound, seemingly technical though but crucial you when your properties are lost or missing:
a. Conduct a search at the Lands Registry;
b. Get a police report to the effect of the loss;
c. Place a CAVEAT on the property – state among other things in your application that the documents are stolen or lost and attach the relevant documents to that effect;
d. Depending on the surrounding circumstances, you may need to place a physical CAVEAT EMPTOP (Buyer Beware) like “NOT FOR SALE” on the property to alert any unsuspecting prospective buyer;
e. Apply for the Certified True Copies of the land documents from the Lands Registry;
f. When you have gotten the Certified True Copies, apply to withdraw the initial CAVEAT;
g. You may equally withdraw the physical Caveat placed on the property;
h. Conduct a fresh search at the Lands Registry which should reflect the placing and withdrawal of the caveat.
