OlowoB: Don't ever state in your application that you overworked as a student (this is my opinion). I have once also over worked and reapplied in the UK and got my visa. This is not to say that overworking as a student is a good thing but trust me, you are not the first nor the last. Try as much as possible to avoid such a situation in future. answer all other questions sincerely.
I don't even think that there is any place on the tier 4 visa application form where you will be asked if you over worked as a student (for someone who has already gotten a visa in time past), they will only ask for your NI number and thats all. Who knows, they may check or may not check your past history as a student.
Apply and hope for the best. cheers Thank u so much |

TobyAn: Before applying for a new tier 4 visa I think key questions would be asked as to sincere purpose of going to the UK; there is the clause of progression that would be put into consideration, is the course at a higher level than his previous course or at the same level. If it is at the same level then I believe given the circumstances, the ECO would consider if the applicant has genuine reasons to come back for study. If it is at a higher level, then maybe the genuine nature of his intentions may be considered. With regards to stating he overworked.. that will be shooting his/herself in the leg as he is obviously stating he intentionally went against the rules .. what would suggest he wont do the same if granted another visa?... There is no section stating you should reveal that he went against the work rules on his prior so my suggestion would be avoid stating it if he/she still wants to take the risk of applying...Future advise to others granted visas, please dont contravene the terms of your visas to avoid this kind of situation; you may want to go back sometime in the future for further studies Thanks for ur reply. Of course there is academic progression. Just d overworked part that is d dilemma.... |

Cc Justwise and other gurus in d house
A friend wanted to apply for student visa and he overworked in his previous student visa. He had stayed outside UK for more than a year. He is afraid of being refused on general grounds. Should he state in his application that he breached his previous immigration rule bearing in mind that he has been outside UK for more than a year.
Pls your urgent response is highly needed. Thanks in advance |

utijerry: thank you for your responce @elope and thyme2fly i also need your advice on What is the National Insurance number, should we leave it blank or fill it with his IHS reference No -IHS00000111111 ? , NI is issued in d UK. Its used usually when u want to work. I had one when I was in UK, and now that am filling another application, I had to include it as that is what they will use to check if I exceed my 20hrs/week (I guess). If ur bro don't have one, he should leave it blank |

muami: Dependants are not normally interviewed whether they apply together with, or, separately from, the main applicants.
However, as with the case in all visa application, the DM reserves the right to conduct an interview if and when necessary. Thank you |
